Robert Hillman In their forthcoming article, What We Buy When We Buy Now, Aaron Perzanowski and Chris Jay Hoofnagle richly capture today’s digital media marketplace and rightly raise concerns about consumers’ understanding of their legal rights upon licensing a book, movie, or song. They focus upon vendors’ use of the language “buy now” on their websites and test consumer comprehension of this language empirically. The results, showing, for example, that 83 percent of respondents believed they “owned” their media, certainly raise alarms. The article proposes a sensible and inexpensive solution, supported by the authors’ empirical evidence, that would help clear up the “buy now” confusion, namely “adding a short notice to a digital product page that outlines consumer rights.”…

BSO Sergeant Ivan Roiz Arrested for Grand Theft and Official Misconduct

Broward Sheriff’s Office (BSO) sergeant Ivan Roiz was arrested on September 22 for allegedly falsifying work hours for an off-duty detail and fraudulently receiving over $1,000 in payment. He faces charges for grand theft, official misconduct, and organized scheme to defraud. Roiz, 47, was released on bond the next day. News sources did not name an attorney for Roiz. According to the police report, Roiz allegedly submitted invoices to the Weston Homeowners Association for off-duty work between July and September this year. An investigation by the BSO’s public corruption unit revealed that Roiz never did any off-duty work during those months. The report states that a tracker placed in Roiz’s marked vehicle showed that he was either at the Pompano Beach district office or at home during the times he was supposed to be working his off-duty detail in Weston. He was reportedly paid over $1,000 by the homeowners association during the three-month period he…

Dismissing A Protective Order and the Mota Case In Mota v. Mota, the Utah Court of Appeals addressed dismissing a protective order. Mota v. Mota, 2016 UT App 201 involved an interesting issue regarding dismissing a protective order. In April 2011, Jennifer Mota was at home holding the parties’ child. Lawrence Mota II threatened to commit suicide and picked up a handgun. When Jennifer attempted to call 911, Lawrence pointed the gun at Jennifer and their child and threatened to kill her if she dialed 911. In June 2012, Jennifer filed a request for an ex parte temporary protective order, which the district court granted. The district court held a hearing and entered a permanent protective order, and no appeal followed. Lawrence repeatedly attempted to obtain a dismissal of the protective order, but he was unsuccessful. In August 2014, Lawrence filed a request for dismissing a protective order under section 78B-7-115 of the Utah Code, which allows a district…

Can you own a gun with a domestic violence charge?

Most domestic violence charges, if you're convicted, are going to federally prohibit you from owning a firearm. It doesn't mean you can't go out with a bow and arrow, but a firearm, you'll be prohibited. That means a rifle, a handgun, semi-automatic, or revolver. Any essentially rim-fire or center-fire weapon, you're prohibited from owning. If you're convicted of something like Domestic Violence Reckless Conduct, that may not end up in a federal prohibition, but Domestic Violence Assault is a lifetime prohibition from ever using, owning, or possessing a firearm, and if you make the horrible mistake of disregarding that prohibitions and six or seven years from now you decide to go hunting with your buddies up in the Allagash, and you get pulled over by the warden and you get arrested, you're now facing a federal felony for which you can be imprisoned for five years. By Alice Dahl, AIUSA’s Women’s Human Rights Co-chair In early August 2014, extremist fighters, who were attempting to create a new Islamic caliphate, the so-called Islamic State (IS), attacked towns and villages in the Mt. Sinjar region of northern Iraq. These combatants are known by various names, including ISIS, ISIL and Da’esh. Their plan began with an ethnic cleansing of the non-Muslim population in the area, with a particular focus on the Yazidi (also spelled as Yezidi) people who had lived there for thousands of years. The Yazidis follow their own ancient religion, and their own culture and identity have evolved over the centuries. Before the invasion of the IS, this tiny minority group made up about 1.5% of the population of Iraq. During the IS attack in 2014, more than 5,200 Yazidis were abducted, and more than 400,000 were forced out of their homes. Many fled into the Sinjar Mountains…

The Murder trial of Justin Ross Harris will require the jury to piece together the circumstantial evidence of the prosecution and determine the intent of Harris, did he accidentally leave his son in the car as the defense content or was it intentionally, as the prosecution claims.  Monday’s opening statements showed defense attorney Maddox Kilgore refer to his client as being responsible, for a “tragic accident” and not for malice murder. The defendant, Justin Ross Harris, has plead not guilty to charges of malice murder, two counts of felony murder and first degree cruelty to children. During the trial, Attorney Kilgore plans to use testimony from Harris’s ex-wife who- despite hostility towards Harris and the ending to their relationship- will testify that Harris was a good father and loved his son. I was thus immediately drawn to Jordan Blair Woods’s fantastic article, which analyzes this complex problem through the lens of LGBT identity. Let me explain the underenforcement-overenforcement issue: Individuals who belong to marginalized groups, such as racial and sexual minorities, disproportionately bear the brunt of crime and law enforcement. When minorities are victims of violence, especially violence motivated by bigotry, liberal advocates tend to support policies and practices that are tough on such crime. When minorities suffer police harassment, revolving door criminal justice, and mandatory sentences, liberal advocates call for police restraint, decarceration, and discretionary leniency.
