In order for the police to be able to search your home for evidence of a crime, they either have to have a valid search warrant or they have to have consent from the owner or someone with proper authorization to give that consent.  For the latter method, the police are generally allowed to walk up to your front door, knock and ask to come inside.  As long as people give the police permission to come inside their homes and search, the police almost never have to get search warrants by explaining to a judge what legal reason they have to enter a residence.  Therefore, it is important for people to understand that they can always (and usually should) refuse when police ask to search their property. As just about every Massachusetts resident with a pulse is now aware, the voters decided on November 8th to “legalize” marijuana possession in the Commonwealth. Well, kind of. I intentionally used quotation marks because there are significant caveats to the new act under M.G.L. c. 94G of which most people are unaware and thus many pot smokers will unknowingly violate.  The most important fact is that the Controlled Substances Act, long- governed by M.G.L. c. 94C, is still in full effect. The new Act passed last month merely provides certain “personal use” exceptions for adults, both decriminalizing previously illegal conduct, and in some cases fully LEGALIZING other previously illegal conduct. Last Week the New York Times reported that mass deportations would negatively impact the housing market, as evidenced by research showing that mass deportation of more than three million undocumented immigrants between 2005 and 2013 helped exacerbate foreclosures.  Simply speaking chronologically, the massive pile-up of foreclosures during the housing crash, one in five of which affected homeowning Hispanic households, seemed to coincide with the mass exodus of undocumented immigrants, about 85 percent of whom were working Latin American men. According to a recent study published by sociologists Jacob S. Polk County Undercover Prostitution Sting Yields 114 Arrests

A recent Polk County six-day-long undercover sting resulted in 114 arrests. The sting — dubbed “Operation Not So Silent Night” — focused on suspects allegedly advertising prostitution in online ads and human trafficking. While a total of 114 people were arrested, warrants were filed on two others. During the investigation, female undercover detectives posted fictitious ads online, and male undercover detectives responded to ads posted online by others. The suspects ranged in age from 17 to 64 years old. In a news release, the sheriff’s office highlighted some of the arrests. As I have discussed on this blog, a DUI not only results in a suspension of your driving privileges, criminal probation, mandatory DUI classes, and costs you a bunch of money, but it also can jeopardize your job and even make you unqualified for certain volunteer positions. So why would anyone drive drunk again after getting a DUI? Well, according the National Highway Traffic Safety Administration, approximately 33 percent of all DUI convictions are for repeat offenses. In California, that means any DUI conviction after the first in a ten year period. We might make the reasonable assumption that a portion of this 33 percent—probably a good portion— are people who are addicted to alcohol (or drugs as the case may be). As one of the researchers explained: “Mental illnesses can be viewed as maladaptive or extreme variants of personality traits.” The researchers studied the genetic profiles of 260,000 people focusing on the five long-established personality traits (extraversion, neuroticism, agreeableness, openness to experience and conscientiousness) that are considered the basic categories of personality. What the researchers found was that these personality dimensions when identified on a person’s genome map (yes, there are “personality genes”) strongly correlated to gene variations that predicted various mental illnesses. THE ULTIMATE PUNISHMENT California is one of 30 states in which the death penalty is legal. In the last election, California voters voted to keep capital punishment legal (Proposition 62) and, beyond that, voted to speed up the process (Proposition 66). Proposition 62 would have replaced the punishment for those convictions under which a person could be sentenced to death to life imprisonment without the possibility of parole. The California voters soundly defeated this proposition with 53% of the voters voting nay. A corollary proposition, Prop 66, approved by 51% of the voters, shortens the time a death row inmate can take to appeal his or her sentence to a maximum of five years. Opponents of Proposition 66 have filed a lawsuit in the Californian Supreme Court challenging the legality of Proposition 66. That lawsuit is pending.
