Dunedin Man Accused Of Sexual Battery On A Minor

A Dunedin man was arrested last week on charges of sexual battery on a minor. The Pinellas County Sheriff’s Office alleges that a 15-year-old girl was in the care of the 32-year-old man when he engaged in sexual activity with her on at least two occasions. The teen apparently told an adult what happened, who reported it to the sheriff’s office. The man is charged with one count of sexual battery and one count of lewd and lascivious molestation. He was booked into the Pinellas County jail. Anyone can be accused of a sex crime. Once you have been accused, police will investigate and usually make an arrest. All it takes is one person’s word against yours. When children are involved, police and prosecutors tend to side with whatever they say happened, regardless of whether it’s true. Because of this, you must take appropriate action to protect yourself and your future. You need a criminal defense attorney who can tell your side of the story and make sure…

The Residential Drug Abuse Program (RDAP): An Overlooked 18 Month Sentence Reduction

$

Defendants seeking to reduce their federal sentences rely on their attorneys to make legal arguments pursuant to traditional methods; oftentimes, however, only the best New York federal criminal lawyers are well-versed in another avenue which can reduce a sentence by 12 months and garner a full six months of halfway house: the Bureau of Prisons’ Residential Drug Abuse Program or RDAP for short, passed into law by 18 U.S.C. § 3621.  Since 12 months off is 12 months off no matter how you couch it, shouldn’t you ensure that you receive such a reduction if eligible – especially if your sentencing judge is not inclined to give you any kind of break otherwise?  What is RDAP? When the Federal Sentencing Guidelines became advisory instead of mandatory in 2005, defendants have based requests for lower sentences upon not only traditional downward departure motions and departures due to cooperation with the government (§5K1.1 motions) but also…

COMENTARIO: El articulista …

An Homage To The Electoral College

Let’s get the obvious out of the way. The only reason the New York Times is calling for the end of the electoral college is that it’s candidate lost. Had Hillary Clinton won, there would be cries, no sad tears, no editorial. But disingenuous motives don’t change the merit of the argument. By overwhelming majorities, Americans would prefer to elect the president by direct popular vote, not filtered through the antiquated mechanism of the Electoral College. They understand, on a gut level, the basic fairness of awarding the nation’s highest office on the same basis as every other elected office — to the person who gets the most votes. Cool links, but neither supports the proposition for which it’s included. Americans love platitudes, as they eliminate the need for deeper thought or greater understanding. Smart people, and make no mistake, the nice folks on the editorial board at the Times are smart, use that to their advantage, to manipulate…

WHAT MAKES A GOOD JUDGE PART II

$

In part one of our post, we posited that a good judge needs 15 years of legal experience, ten of which are spent in courtrooms as a PD or ASA. Once the judge has the experience, we move on to the issue of character. Character counts for the judiciary. It's easy to do the popular thing. It's much tougher to do the right thing.Lawyers and the judiciary are viewed through by the public through a media and pop-culture lens of unrealistic results. Movies and TV shows portray the justice system as an over-worked bureaucracy where high-paid lawyers routinely get evidence suppressed and cases dismissed based on technicalities like finding that a defendant's middle name in a document in a murder case was spelled wrong. In the movies, an angry and over-worked judge releases the killer who then goes on a mass murder spree while a defense attorney laughs in his or her new Tesla (which are really really great cars btw). The reality is that since the mid-1980s there has…

Above And Beyond? Reasonable Doubt Is Unethical

Both of the writers, Christopher Wareham and James Vos, are putative ethicists. Not lawyers. Not here. Not anywhere. They don’t even teach law. Which naturally frees them from the constraints of facts and reason, an enviable position to be sure. Conviction rates for sexual assault against women are shockingly low, to the extent that, even in a developed nation such as the United Kingdom, only 6 per cent of rape allegations result in a conviction, a far lower rate than for any other violent crime. As The Guardian columnist Julia Bindel puts it, ‘rape might as well be legal’. What are the chances you might actually click on the 6% link? The writers must be betting slim, since it kinda makes them look idiotic. Of those cases that completed to the point of guilty or acquittal at the magistrates’ court or Crown Court in 2011, just under two thirds were convicted. This is eight percentage points higher than 2005. The foundation upon which everything that…

Minnesota Joining National Movement To Reduce Solitary Confinement

Minnesota’s prison system will partner with the Vera Institute for Justice in 2017 to look into alternative forms of punishment in hopes of moving away from a system that relies on solitary confinement as a punishment for difficult inmates. The Vera Institute for Justice is a national criminal justice reform group that wants to help abolish the practice of solitary confinement across the United States. They have selected the Minnesota Department of Corrections to take part in a 21-month program designed to work with prison administrators to discover and introduce alternatives to long-term isolation. The ultimate goal is to find alternatives to the practice – which the group claims can take a severe mental health toll on prisoners – without sacrificing the safety of other inmates and guards. “Solitary confinement is used widely in U.S. prisons and jails,” reads a news release from Vera. “But research has documented for decades its harmful…
