Most TDCJ sex assault victims housed in just a few units, most victimized by staff
Here are a few highlights from a recent report on sexual assault in TDCJ put out by the Texas Association Against Sexual Assault and the Prison Justice League.Their report represents a significant bit of research. They examined federal Bureau of Justice Statistics data on sexual assault in prisons, and sent a voluntary, confidential survey to prisoners who had self-reported sexual assaults at some point during their incarceration. This research was supplemented by correspondence with inmates who responded to the survey.A disproportionate number (41.2 percent) of inmate sexual assault victims self-identified as LGBTQ, the survey found, confirming a pattern where inmates deemed gay or even just effeminate may be more likely to become victims.Survey respondents reported sexual assaults at 15 prison units across the state with the majority of reports coming from three units: Estelle (Huntsville), Robertson (Abilene), and Allred (Iowa Park). Criminal case negotiations – Precision is essential
Settlement negotiations are an essential part of most criminal defense work, whether the negotiations seek an outright dismissal, continuance for possible dismissal with or without dismissal conditions, or any other number of resolutions right up to convictions involving amended or dropped charges and/or agreements as to sentencing or caps on sentencing. Not all cases settle. If a case goes to trial, that usually indicates that settlement efforts were attempted but unsuccessful. Brandon Tate recently learned about the importance of precision in written guilty plea agreements. U.S. v. Tate, ___ F. 3d ___ (4th. Cir., Jan. 11, 2017). Tate entered into a federal drug felony guilty plea, whereby the prosecution agreed to recommend the low end of the “applicable [voluntary federal sentencing] guideline range”. Rebecca E. Zietlow, A Positive Right to Free Labor, 39 Seattle U. L. Rev. 859 (2016). Anne Marie Lofaso In her article, A Positive Right to Free Labor, Professor Zietlow recounts the history of the working person’s claim to free labor. Zietlow traces that history from its roots – in the antislavery and labor movements of nineteenth-century antebellum America – right through to the post-Title-VII era of today, showing us that there is much more work to be done. Professor Zietlow begins by defining a positive right to free labor as including “the right to work for a living wage free of undue coercion and free from discrimination based on immutable characteristics. Not merely the negative guarantee against the state’s infringement on individual equality and liberty, a positive right to free labor is immediately enforceable against state and private parties.” (P. 861.)
