All 50 states in the U.S. have had some form of ignition interlock law on the books since at least 1993, and new research published in the American Journal of Preventive Medicine suggests they’ve helped save countless lives. According to AJPM, mandatory laws that require every person convicted of a DUI to use an interlock device were associated with a seven percent decrease in the number of fatal drunken driving crashes. “Prior to this study, we didn’t have any evidence on whether ignition interlock laws … reduce alcohol-involved fatal crashes — which is of course the goal of the law,” said Emma McGinty, assistant professor in the Center for Injury Research and Policy at the Johns Hopkins Bloomberg School of Public Health and Colorado School of Public Health. “So that was the big question: Do these laws work?” Should All States Be Mandatory? At National Review, David French takes the Fourth Circuit en banc to task for failing to toughen up. There’s an old saying that “bad facts make bad law.” In other words, the desire to punish bad people and prevent perceived miscarriages of justice can lead judges to craft overbroad or oppressive opinions that ultimately lead to far worse outcomes. But judges are supposed to wrestle with bad facts, tease out the true and appropriate legal standards, and keep in mind the consequences of their opinions. So, no, bad facts don’t make bad law. Bad judges do. He has a point, that the job of judging isn’t limited to easy cases with clean, sanitary answers. But to contend that there are “true and appropriate legal standards” is painfully naive. The law is a Rube Goldberg machine, built over centuries, replete with rights and doctrines in perpetual conflict, and when they clash, the answers get messy and ugly. Somebody’s rights will end up…

This week we heard news of $20 million (hidden in a box spring) being seized by the federal agents in its ongoing investigation of TelexFree, a multi-level marketing company that the government says was a massive Ponzi scheme. You can read all about the TelexFree case on Patrick Pretty’s blog. News reports about TeleFree refer to it as a Ponzi scheme (also called pyramid scheme). What isn’t mentioned anymore is the fact that it operated as a multi-level marketing company, just like Amway, Mary Kay, Herbalife, LuLaRoe, and hundreds of other companies you hear about on a daily basis. That being said, it seems the company behind one of the most popular personal breathalyzers on the market has settled with the Federal Trade Commission (FTC) over false claims of its accuracy. On the fifth season of ABC’s hit show “Shark Tank,” CEO and founder of Breathometer Inc., Charles Michael Yim, won over the “shark” investors with an invention called the “Breathometer” that allowed users to a detect their own blood alcohol content through their smart phone. The device attached to smartphone, would be blown into by the user, and the smartphone would calculate the BAC through an app. Yim’s pitch included the prospect that the Breathometer could prevent incidences of driving under the influence of alcohol.  The investors were so impressed with Yim’s invention that they offered up a $1 million dollar investment in…
