He crossed the center line of the roadway and went off the east shoulder where he rolled his vehicle and lost his load of logs. The truck came to rest off the road on its side and the trailer came to rest in the northbound lanes of SH3. The northbound lane was blocked for approximately 6.5 hours. Rodney Ellis hailing the passage of the so-called Michael Morton act requiring Texas prosecutors to implement open-file policies.Ellis/Duncan landmark reform revamps Texas’ discovery statute for first time in half century(Austin, Texas) The Texas House today passed SB 1611, the Michael Morton Act, landmark reform revamping Texas’ discovery statute for the first time since 1965. The reform legislation now goes to the governor’s desk.The legislation by Senator Rodney Ellis (D-Houston) and Senator Robert Duncan (R-Lubbock) will provide for a reliable justice system by ensuring that all relevant evidence that speaks to a defendant's innocence or guilt is revealed.  It creates a uniform, statutory "open file" criminal discovery policy for the State of Texas. “This is an incredible day for justice in Texas," said Ellis. “We must weigh all relevant evidence and ensure we bring all the relevant facts to light to safeguard the innocent, convict only the guilty, and provide justice the people of Texas can have faith in.”“I have long been an advocate for an efficient, effective and uniform court system across Texas.  This legislation is a giant step forward in reaching that goal," Duncan said. "I am proud that stakeholders from across the state were able to come together and set aside their differences to improve our criminal justice system.”The legislation is the culmination of weeks of talks between stakeholders and relevant parties  who put countless hours into this effort with Senators Ellis, Duncan, West, Huffman and Whitmire, their staff, judges, particularly Judge Barbara Hervey, prosecutors, criminal defense attorneys, the Governor's office,  Thomas Ratliff,  Michael Morton and his attorneys, and more.   Each of these men, women, and organizations put the interests of justice ahead of self-interest, and by coming together helped created a truly historic justice reform.  "Passage of SB 1611 will increase transparency and accountability in criminal cases at a stage when we can still prevent wrongful convictions like Mr. Morton's," said Ellis. This has caused the usual amount of huffing and puffing from those who don’t understand the whole point of human rights. The basic story:A Supreme Court ruling has forced the Government reluctantly to draw up new rules allowing serious sex offenders put on the register for life to have their place on the list reconsidered.The Home Office plans were opposed by child protection campaigners and Conservative MPs, who said some offenders could never be considered completely “safe”. The new rules were drawn up because the Supreme Court ruled that automatic lifetime inclusion on the register breached the Human Rights Act. What the Supreme Court is really saying here is that one law passed by MPs conflicts with another law passed by MPs. And in a country that is under the rule of law this cannot be allowed to happen. The law must be possible to follow after all: we can’t have it that you both must do something and cannot do something at the same time. Similarly, we cannot have it that we’ve a system of protecting people from politicians (which is what human rights are all about) and at the same time allow politicians to breach those rights for people they don’t like very much. As usual, at least one MP decides to grandstand instead of grasping the point:Priti Patel, a Tory MP, said the court ruling added to the case for reform of the Human Rights Act. “Sex offenders are vile criminals,” she said. “Why are these people allowed to use human rights laws to protect themselves? What about their victims?” Because human rights are for everyone, not just those you think are not vile criminals. They accrue by virtue of being human, thus the name. It really is a very basic point and slightly worrying that those who would make the law in our name don’t get it. This Human Rights Act, Ms. Pratel, is to protect us from you. Woman Charged with DUI after Crashing into Squad Car

A 27-year-old Los Angeles woman was arrested after rear-ending a squad car while under the influence of alcohol. According to a news report in WeHoNews.com, the car crash occurred at Santa Monica Boulevard and Orange Drive in West Hollywood. Officials say they were conducting a pedestrian stop when a vehicle rear-ended their squad car. The deputies were not hurt in the crash. The driver allegedly registered .24 and .22 blood alcohol content (BAC) readings during the preliminary alcohol screening tests, which is nearly three times the legal limit of 0.08 percent. She was treated at a nearby hospital and detained on suspicion of driving under the influence (DUI). You can face criminal charges for driving while under the influence of alcohol or drugs with a blood alcohol level of .08 percent or higher. Under California Penal Code 23152 (b), you can be found guilty of DUI if your BAC is .08 percent or greater regardless of whether you were actually under the influence of alcohol or drugs. The prosecution only has to prove that you drove a vehicle and that your BAC was above the legal limit. There are enhanced consequences for those with a BAC of .15 percent or higher. Before 2006, enhanced penalties were reserved for drivers with a BAC of .20 percent or higher, but now individuals with a BAC of nearly twice the legal limit will face a six-month alcohol program instead of a three-month program.

California Man Guilty in $250 Million Ponzi Scheme

A federal jury has returned a guilty verdict against a California man for masterminding a massive Ponzi scheme that bilked investors out of over $250 million.  James Stanley Koenig, 60, was found guilty of all but one of the three dozen criminal charges levied against him by prosecutors.  Koenig will remain in custody until his June 11, 2013 sentencing, and could receive a sentence of up to 50 years in prison. Koenig ran Asset & Real Estate Investment Company ("AREI") along with fifty affiliated companies, telling potential investors that it specialized in senior housing centers.  Beginning in 1997, AREI controlled more than twenty senior housing and residential assisted-living centers, representing that they were suitable as a secure and profitable vehicle for tax-sheltered property exchanges.  After purchasing an assisted living facility, Koenig would then sell ownership shares in the property to investors.  Eventually, more than 1,000 victims would invest hundreds of millions of dollars with Koenig. However, while Koenig represented that investor funds and facility revenues were reinvested back into the facilities, this was not the case.  Instead, Koenig used investor funds to to pay returns to existing investors, as well as finance a luxury lifestyle enjoyed by himself and two co-conspirators.  This lifestyle included an 80-acre castle estate, a Lear jet, luxury homes and fancy cars.   While investigators charged that AREI was insolvent no later than May 2007, Koenig continued to bring in new investors based on promises of false profitability.  After an investigation, criminal authorities arrested Koenig in 2009 and charged him with 77 criminal charges - 40 counts of securities fraud and 37 counts of residential burglary that were predicated on Koenig's entry into investor homes to induce them to invest in his scheme.  Investor losses were estimated at over $200 million. According to authorities, Koenig failed to disclose to investors that he had a previous 1986 conviction stemming from his role in a gold-selling scam.  He served two years in federal prison and was ordered to pay over $5 million in restitution to defrauded investors.

Often, what we think is the matter is just a superficial symptom of a deeper emotional injury. Mistake #4. Lying to yourself and others. DOJ obtained Associated Press phone records; AP demands return and destruction of data

The Associated Press announced today that the Justice Department obtained two months of telephone records from more than twenty AP office telephones just over a year ago. The DOJ notified the AP of the investigation on Friday. AP's President and CEO has "demanded the return of the phone records and destruction of all copies." According to the AP, the process for obtaining records from news organizations is "strict." A subpoena can be considered only after "all reasonable attempts" have been made to get the same information from other sources, the rules say. It was unclear what other steps, in total, the Justice Department might have taken to get information in the case.  A subpoena to the media must be "as narrowly drawn as possible" and "should be directed at relevant information regarding a limited subject matter and should cover a reasonably limited time period," according to the rules.... News organizations normally are notified in advance that the government wants phone records and then they enter into negotiations over the desired information. In this case, however, the government, in its letter to the AP, cited an exemption to those rules that holds that prior notification can be waived if such notice, in the exemption's wording, might "pose a substantial threat to the integrity of the investigation." The full guidance from the DOJ is available in the department's United States Attorneys' Manual. The investigation involves an attempt to find the source of a leak of classified information to the media.

Leonard Ansill of Jupiter Farms, Florida was arrested Wednesday for allegedly defrauding his investors out of more than $1 million, news sources report. Ansill, 77, was booked into the Palm Beach County Jail on charges of organizing a scheme to defraud and grand theft. His bail was set at $70,000. It is not yet known whether Ansill has hired an attorney. According to reports, Ansill told potential investors that received mortgage payments for multiple valuable properties. These properties included Comfort Inn & Suites locations in both Jupiter and Lantana, as well as several various locations throughout Miami, Sunrise, Pompano Beach, and Fort Lauderdale. Ansill purportedly told the investors that he would share a portion of the mortgage profits in return for their investments. At least two investors say they began investing with Ansill in late 2009. In June, detectives began investigating Ansill after receiving several complaints from investors. Detectives spoke with the Jupiter and Lantana Comfort Inn & Suites owners, and both reported that they had never heard of Ansill, sources say. It turned out Ansill never truly held mortgages with either of those properties, as he allegedly led investors to believe. Instead, detectives say Ansill operated a Ponzi scheme, paying investors with other investors' investments. In all, sources say Ansill made off with $1.12 million from six investors. It remains to be seen whether investors will be able to recover any of these allegedly stolen funds. In other news, Mason Scott Beuning and Wolfe O'Meara of Gainesville were arrested Tuesday for allegedly stealing bomb-making materials from a Wal-Mart, reports say. Detectives later learned that Beuning had created an explosive device and may have been trying to steal materials to make another. Beuning, 18, and O'Meara, 18, were booked into police custody on charges of shoplifting. Beuning faces additional charges of possessing a destructive device. It is unclear whether the duo qualified for bail or hired legal representation. According to reports, the incident occurred on Tuesday at a Wal-Mart Supercenter on Northeast 12th Avenue in Gainesville. The store's security staff reportedly caught Beuning and O'Meara stealing items that could potentially be used to make a bomb. Wal-Mart security held Beuning and O'Meara at their office until police arrived.
