Georgia Court Rejects Argument That Chemical Tests Are Allowed for Alcohol But Not Drugs

While the vast majority of DUIs arise due to alcohol consumption, drivers are also arrested for driving while under the influence of drugs. These two types of DUIs are treated similarly by police officers and the courts, and chemical testing can be requested to detect alcohol or drugs, both prescription and illegal. In a recent case before the Georgia Court of Appeals, a defendant made the argument to attempt to dismiss the chemical tests for his drug. A.J. was arrested for driving while intoxicated for being under the influence of drugs, possession of marijuana, and speeding. At the time that A.J. was stopped, the officer on the scene requested that he take a blood test to confirm the substances present in his body. A.J. was read the implied consent notice and then asked to consent to chemical testing. A.J. agreed to the test. However, at trial, A.J. moved to suppress the results of the test. We hear a lot of news about hate crimes, which seemingly relate to every form of crime, from offensive graffiti all the way to murder. Many people are confused about exactly what hate crimes are and how they are treated in the criminal justice system. Hate Crimes Defined In its simplest form, a hate crime is an act that would otherwise constitute a crime with enhanced penalties if that crime was committed with the motive or intent to discriminate, or if the victim was selected because of a particular race or religion. So, someone who graffitis the side of a building is certainly committing a crime, but when that graffiti contains racial or religious insults, now that crime is being committed with the intent to discriminate against, or with malice towards, a particular group. The penalties for the underlying crime are then enhanced and additional charges may very likely result. Continue reading

Lawmakers Look to Change Michigan State Law Regarding Sexual Predators

Currently in the state of Michigan there are four degrees of CSC, or criminal sexual conduct, which a person who allegedly commits a sex-related crime may be charged with depending on various factors. These include first-, second-, third-, and fourth-degree criminal sexual conduct, with first-degree the most serious of all and leaving the defendant potentially facing life in prison if convicted. Some Michigan lawmakers, including Representative Holly Hughes, are looking to change state law in an effort to not only protect children and families from sex offenses, but also to secure justice for victims who were allegedly sexually abused in the past, some decades ago. If a new bill sponsored by Hughes passes, it will result in additional prosecution of individuals who are allegedly sexual predators. In 2001 the statute of limitations was eliminated by the legislature, however Hughes wants to make the law retroactive which would mean those who claim to have been sexually abused…

Let’s say I wasn’t a lawyer, but I really wanted to be. I couldn’t go to law school, couldn’t afford to squander three years of my life or the tuition.
