A nonprofit is charged with falsely depicting a veteran as a sex offender and evicting him from his home. According to PIX 11 News, residents of a Brownsville neighborhood in Brooklyn, New York saw posters throughout the community warning them about former U.S. Army Specialist Ellison McKnight. The posters claim that McKnight was a level-three sex offender. Mike Erber, the operator of the nonprofit, Mutual Assurance Guaranteed Veterans, or MAG-V, is alleged to have put up the fictitious fliers. According to Peter Kempner of Brooklyn Legal Services and the Director of the Veteran Justice Project, Erber has falsely accused McKnight of being a sex offender thus, endangering his safety. Kempner claims it was a plan to evict McKnight from his apartment. During a hearing at a Brooklyn Housing Court, Erber said that the U.S. Department of Veterans informed him that McKnight was a sex offender. When Erber was asked to produce documents supporting his claims, he could not do so. The…

Jesse Gary of KTVU in San Francisco has this report with the above title on the effects of Proposition 57, passed by the voters last November. The killing of Madyson Middleton struck at the core of California's conscience because it was a hideous crime committed in a Santa Cruz arts center apartment complex. The slaying of the 8-year-old [girl] was made more shocking because the identity of the suspect was the victim's then-15 year old neighbor.*           *          *The suspect, identified as Adrian Jerry Gonzalez, was charged as an adult for killing and sexually assaulting the girl before her body was dumped into a recycling bin.Almost two years after the crime, the suspect still hasn't been brought to trial.*           *          *The trial delay is directly linked to an act…

9th Circuit: Faulty search warrant affidavit nixes computer search; search waiver of which police were unaware failed to validate search of person; drug sentence vacated for failure to follow statutory procedures

United States v. Perkins, — F.3d —, 2017 WL 957205 (9th Cir. Mar. 13, 2017): Agent’s omission of relevant information from warrant invalidated computer search There’s an old story about a two-car race, orchestrated during the height of the Cold War, between a driver from the United States and a driver from the Soviet Union. The race is close, but the American driver narrowly wins. The next day’s headline in the state-run Soviet newspaper reads: “In historic race, Soviet driver finishes second, while American driver barely manages to finish second to last.” It’s all true, of course, but the omission of material information renders it rather misleading. Amusing enough, as a parable of state propaganda; less so as a template for drafting a search warrant affidavit. Which brings us to Mr. Charles Perkins. Mr. Perkins was en route to the United States through a Canadian airport when Canadian law enforcement agents learned that he…

Iowa Arrest Warrants: How To Find Out If You Have An Arrest Warrant

Do I have an arrest warrant? This is a question we field almost every week at Stowers & Sarcone, PLC. When a typical arrest warrant is filed in Iowa, it is sealed. That means you cannot see it on Iowa Courts Online. Many people do not know for sure if they have a warrant until the cops show up. So what can you do if you suspect there is a warrant our for your arrest? Well, you can start by calling us. It maybe very difficult for you to determine if you have an arrest warrant. Often the police, the jail, the prosecutor or any other person you call, cannot or will not reveal that information to you. However as your lawyer, we are in a better position to obtain that information. The same people who will not give you any information will often give us the information. Thus, it makes sense to hire a lawyer. The other upside is that we can work with the police to arrange to have you cited and released, or for a turn in date, or avoid the warrant altogether. If all else…

The FBI is investigating a sitting president to determine whether his campaign colluded with Russia  in the 2016 election.  As CNN reported, U.S. officials have indicated that "associates of President Donald Trump communicated with suspected Russian operatives to possibly coordinate the release of information damaging to Hillary Clinton's campaign."  Have we become so inured to the day-to-day craziness of the Trump Administration that this isn't an earth-shattering revelation?  Then there is the pervasiveness of Trump's conflicts of interest, which is also staggering.  A recent report by Public Citizen detailed how: Trump has failed to isolate himself from the management of the Trump Organization;  the company has, contrary to Trump's assurances, continued to pursue new foreign deals; Trump has not, as promised, donated profits from his Washington D.C. hotel to the U.S. Treasury; and…

Healthcare: Breaks and Brakes

It’s not unprincipled to simultaneously believe in rugged individualism for those who can and a safety net for those who can’t. We can quibble over where to draw the line, and the conflicting ideologies may make purists cringe. But for anyone who believes that no person should lack for health care in America, it’s hard to shrug off poverty with the cartoon character of the welfare queen. There are poor people in America who didn’t do anything wrong to be there. Some suffered misfortunes outside their control. We have a severe dearth of decent-paying jobs, despite the lie of low unemployment. Technology has produce massive structural un- and under-employment, even if your enjoying hipster heaven coding for cash. There are hard-working poor who need health care and can’t afford. There are people with serious illness who need it. And there is a vast middle-class whose real earnings have declined seriously since 2007, with no hope of improvement, who…

Why Jacoby & Meyers Didn’t Go Pro Se

$

When Jacoby & Meyers began, it was supposed to be the People’s law firm, solid lawyering at prices regular folks could afford. Some wags might argue that this was merely a marketing stance, as they wanted money as much as any other law firm. When they didn’t get it, they pivoted to a personal injury firm. There was a structural argument with the concept of low prices that doomed it to failure: if you don’t make enough money, then you there’s no point in running a business. If your intention is to run a charity, that’s a different story, J&M was no charity. Their lawyers want to get paid, and paid enough to enjoy the comfortable lifestyle their mommies promised would be theirs if they just hunkered down, went to law school and became professionals. There is nothing wrong with that, even if the nice folks who want cheap lawyers fails to grasp that their cheap comes at the lawyers’ expense. Same goes with the advocates of Access 2…
