Maryland marijuana laws have changed in recent years and it is important to be aware of these changes, as marijuana-related offenses can still result in significant legal consequences. Decriminalization vs. Legalization People often use these two terms interchangeably, but they do not mean the same thing. In fact, there is a significant difference between the two. Legalization refers to the ability to do something without facing any penalty, criminal or civil, whatsoever. Decriminalization means that the act is still viewed as a crime, but with lesser penalties and minimal risk of facing incarceration if convicted. First Time DUI Offenders: Florida DUI Ignition Interlock Bill Passes House Committee

There could be more severe penalties on the way for first time drunk driving offenders. A bill that would require an ignition interlock device on someone’s vehicle after their first drunken driving conviction has passed its first committee in the Florida House of Representatives. The bill (HB 949) passed the Transportation and Infrastructure Subcommittee on Tuesday. It must go through two more committees before reaching the House floor. The interlock device prevents a vehicle from starting if the driver has been drinking. The current law makes it mandatory for six months for a first offense if the person’s blood alcohol content is higher than 0.15 percent or a minor is in the vehicle. The devices are also mandatory for multiple DUIs. Florida would join 28 other states and the District of Columbia with similar laws. Vicki is a victim of child pornography. It began when she was 10 years of age. Pictures and videos depicting her bound, raped and sodomized was, and continues to be, widely distributed on the Internet. Her pornography became known in the courts as the “Vicki Series.”  Her case is an example of inhuman abuse that no child should suffer and justifies the harshest of punishments.  Her abuser was sentenced to 50 years in federal prison.   Restitution Cases   Vicki is now 25 years of age. US v. Crooked Arm, No. 15-30277 (4-11-17)( O'Scannlain w/Clifton; dissent by Nguyen). The 9th finds an Apprendi challenge foreclosed by law of the case.  The defendants had pled guilty to a misdemeanor (sale of protected bird parts -- feathers) but were mistakenly sentenced for a felony. The 9th in that appeal had found error in some counts being felonies when they should have been misdemeanors.  It seemingly affirmed a conviction for a conspiracy, and remanded for resentencing.  On appeal from the resentencing, the defendants argue that the conspiracy should be a misdemeanor, because the object of it was a misdemeanor.  At the original plea colloquy, the defendants admitted to only selling feathers, a misdemeanor, and therefore it could not be a conspiracy felony conviction.   The 9th rejected this argument under "law of the case."
