Sessions announced this month that he has suspended a Justice Department review of widespread flaws in FBI forensic expert court testimony. The announcement comes on the back of a record number of exonerations in 2016. It has alarmed criminologists, defense lawyers, crime writers, and scientists. Sessions announced that he would not renew the National Commission on Forensic Science – a partnership set up between the U.S. Department of Justice (DOJ) and the National Institute of Standards and Technology, on the eve of its expiry. Genetic testing is currently the subject of numerous qui tam cases and investigations by the Office of Inspector General. This is in addition to any investigations by private insurance carriers. A recent federal qui tam case shows that the government is going after those involved in the ordering of such tests as well as the laboratories.One issue that arises is where genetic tests are ordered by physicians who are not the regularly treating physicians of the Medicare patients. In order to be considered medically necessary and thus reimbursable under Medicare, the general rule is that the laboratory test must be ordered by the physician treating the resident. What happens when a laboratory test is ordered by a physician who is not the regular treating physician of the patient? For example, what if the physician is an outside physician whose only role is ordering a genetic test? In a recent Illinois appellate case, the defendant appealed after being convicted of armed robbery, which is a Class X felony.  He was sentenced to 21 years in prison, which is the six-year minimum plus a 15-year enhancement for using firearms.  He was indicted based on a theory of accountability.  Prosecutors claimed he knowingly took money from the victim’s person by threatening the use of force while carrying a firearm. The defendant was separately charged with attempted armed robbery, and he pled guilty to that charge. He was admonished of his right to a jury trial, and he agreed to waive his right. The case at hand was set for a jury trial, but a few months before the trial, the defense attorney told the court that sentencing in the attempted armed robbery case was supposed to occur on the same day. Here is a bit of anecdotal evidence on drug shelf lives.The picture on the left comes to us courtesy of retired DEA agent Fred Gregory.  In the 1960s, the DEA's responsibilities included checking pharmacy shelves for expired medications.  This bottle of medical heroin was "expired" over 30 years before it was pulled.  Analysis showed it to be 100% pure and potent nonetheless.

In his 16th batch of clemency petition decisions since taking office in January of 2015, Illinois Governor Bruce Rauner granted pardons authorizing expungement to five (5) individuals on April 14, 2017: one (1) individual was granted relief from a 1992 felony theft case in Champaign County, there were three (3) felony drug cases ranging in years from 1996 to 1999 (two (2) in Cook County, one (1) in McLean County) that were pardoned with leave to file a petition to expunge and finally, one (1) individual received executive clemency authorizing expungement on a 1999 felony aggravated battery case out of Macon County. Approximately one hundred forty (140) petitions for executive clemency were denied by Governor Rauner this time around. With Rauner’s “grant rate” for pardon petitions hovering at just three percent (3%), I am certain there are a good amount of deserving individuals who are falling through the cracks, which is unfortunate. After more than three years of legal recreational marijuana in the state of Colorado, and in an effort to obstruct illegal marijuana trafficking, both the Colorado House and the Colorado Senate have approved new legislation that lowers the legal limit for residential marijuana growers from 99 plants to 12 plants per household. Medical marijuana patients and their caregivers can ask the state for an exemption that will allow them to grow up to 24 plants. The legislation substantially reduces the ability of Coloradans to grow marijuana at their private residences. Law enforcement authorities say that large-scale pot distributors and international crime organizations are taking advantage of the current 99-plant limit. The legislation is part of a wider effort this year by Governor John Hickenlooper to enhance law enforcement in the “gray market,” where cannabis is cultivated legally but is distributed and sold illegally.
