Short Take: If You’re Happy And You Know It

Most of us never give much thought to the exclusion of deaf people. And deaf people don’t give a damn about the exclusion of blind people, because they’re deaf and not blind, and deaf is definitely worse based on a poll at Gallaudet University. This is why clapping is literally horrifying. Britain’s largest national student union has told attendees of its annual conference they would face “consequences” for cheering and clapping because these forms of expression exclude deaf people. What those consequences might be is unclear, though it clearly involved repeated warnings, public shaming, and the occasional burning of a witch. And like all truly exhausting problems, it required the institution of official rules to make it so. In response to the complaints, the Durham University student union proposed a motion at the conference that would see clapping and whooping banned at all future NUS events. According to the motion, “access needs of…

Melanie’s Law Not Often Used in Drunk Driving Cases in Mass.

While it is good that there has been a strong push to enhance drunk driving laws, especially in cases involving serious or even fatal drunk driving accidents, it will not do any good if the new stricter laws are not enforced when the opportunity presents itself.  However, according to a recent news article from the Boston Globe, that is exactly what is occurring. For those who are not familiar with Melanie’s law, it was passed more than a decade ago.  The purpose of the 2005 law was to make the penalties for drunk driving offenses much tougher in Massachusetts to prevent serious drunk driving accidents, including fatal ones that occur in Boston and other parts of the state. While there were various changes to the already existing drunk driving laws, the major change, as pushed by Mothers Against Drunk Driving (MADD) and other groups, is to require an alcohol breath ignition interlock device on a defendant’s vehicle, and it would be on it until defendant…

Harris County hearing officers Pants-on-Fire testimony in bail litigation lacked credibility, finds federal judge

Amazing news! Congrats to Civil Rights Corps and the Texas Fair Defense Project, who secured a remarkable 193-page injunction against Harris County from federal District Judge Lee Rosenthal declaring that the local bail system unconstitutionally deprives poor misdemeanor defendants of their freedom because of their inability to pay. See the Houston Chronicle's coverage. Grits uploaded her ruling here.Judge Rosenthal heard testimony from the Hearing Officers setting bail amounts on the front lines and poignantly found them non-credible:  "The Hearing Officers' testimony that they do not 'know' whether imposing secured money bail will have the effect of detention in any given case ... and their testimony that they do not intend that secured money bail have that effect, is not credible." In fact, she attributed "little to no credibility in the Hearing Officers' claims of careful case-by-case consideration." In the hearings she…

Drug Dealers Charged with Manslaughter for Overdose

Drug Dealers Getting Charged for Overdose Deaths In recent years it has become popular for illegal drug dealers to mix highly potent drugs such as the heroin with a substance known as fentanyl in order to generate a more profound high for those who are taking the drug. Fentanyl is the dangerous opioid drug compound that has produced far too many deaths in Massachusetts and the New England region as a result of its use. People who receive drugs that are mixed with fentanyl have a substantially increased risk of accidental fatal overdosing. In response, prosecutors are seeing drug dealers charged for deaths resulting from the drug dealing activities.  Illegal opioid drug use that prompts fatal overdosing is one of the biggest epidemics that Massachusetts law enforcement and the legislature has had to face in the recent past. According to a 2016 data brief study by the Massachusetts Department of Public Health, fentanyl-related deaths are on the rise in Massachusetts.…

In U.S. v Vargas the defendant was charged with conspiracy to possess with intent to distribute and possession of cocaine after Alabama law enforcement officers discovered cocaine and methamphetamine in Vargas’ vehicle. Vargas filed a motion to suppress on the grounds that Vargas’ traffic stop that led to the discovery of the drugs violated Fourth amendment. Here, Alabama law enforcement officer pulled over the defendant for following too close and failing to maintain its lane. The driver immediately admitted that he did not have a driver’s license. The officer asked him to come back to the officer’s car where the officer asked him routine questions about where he was going. After about three minutes the officer informed him that he was issuing him a warning for following too close. He continued to ask defendant some questions to complete the warning. He then approached the passenger to determine whether he could operate the vehicle. When the…

When Government Breaks Rules For Ohio Administrative License Suspensions

There are few instances when the government can take our property without first holding a hearing.  An Ohio Administrative License Suspension (A.L.S.) is one of those instances.  If a driver refuses a chemical test or tests ‘over the limit’, an officer takes the driver’s license on-the-spot.  Accordingly, to protect drivers’ rights to due process of law, Ohio has rules which must be followed for an A.L.S to be imposed.  A recent A.L.S. case in an Ohio Court of Appeals demonstrates what happens when the rules are not followed. There Are Rules For Imposing License Suspensions The case is Toledo v. Ferguson.  Ferguson was stopped and given field sobriety tests.  The police officer charged Ferguson with OVI and imposed an A.L.S.  For the A.L.S., the officer completed a BMV 2255 report and sent a copy to the court.  However, the report was sent to the court six days after the arrest, and Ohio Revised Code section…
