A quick status update on #cjreform bills at the #txlege

Let's take a quick moment to see where are the session's significant criminal justice bills at the Texas Legislature after a week of important House deadlines. Few bills of any stripe have been sent to the Governor yet, but a number of good bills are still moving throughout the process and have a decent chance of passage. For starters, both the House and Senate budgets envision closing four more TDCJ prison units, continuing a happy and fortuitous trend. Since it's not a point of conflict, one would expect this to stick in conference committee barring unforeseen shenanigans.Bail reform (SB 1338) passed the Senate. Judges must evaluate risk assessment data on defendants before making individualized bail decisions and use the least restrictive means necessary to ensure their return to court. This news comes on the heels of a major court victory by our friends at the Texas Fair Defense Project, along with Civil Rights Corps and attorneys at Sussman-Godfrey, in which…

Fighting Connecticut Arrests for Unsupervised Children in Cars

The good ol’ days of leaving your child in the car while you run a quick errand are long gone. Too many tragic cases of baby hot car deaths and heat suffocation deaths have caused law enforcement to enforce a zero tolerance policy. But what about when it’s not hot? Or when you just want to run into a store or your friend’s house for just a minute while your toddler is sleeping and the air conditioning is keeping your children cool and safe? It’s still illegal—here’s why…  How Old Can a Child Be Legally Left Alone in a Car Unsupervised in Connecticut? It depends. A year or two ago, I wrote a blog about my concerns with Connecticut criminal laws that have been enforced by police in the wake of a then-highly publicized hot car child death. Connecticut police routinely charge parents and nannies with one of two charges for leaving an unsupervised child in a car: the misdemeanor charge under CGS 53-21a (which prohibits leaving a child…

Dear Diary...simply put the best week ever!!!Here's how the week went down. Last weekend I was in a bit of a bad mood. And nothing makes me feel better than firing some people. So first Manuelo, who's staff at my golf club in New Jersey brought me two scoops of ice cream for my dessert Saturday night. I have given specific instructions that I am to be give two and one half scoops of ice cream with my dessert. I made that very clear from day one. "Manuelo, you're fired!" Then I had the secret service hustle him out. I felt a little better. Sunday morning I saw that little so and so Peter Ryan on the news shows. Thinks he's a big shot being speaker of the congress and all. So I called him up I did. "Petey, you're fired. I'm making changes in the senate." "Mr. President" he says, "You can't fire me, I was elected.""Elected" I sneer. Did you see my inauguration crowds? Bigger than yours…

Barber shops in Georgia and across the country serve a multitude of individuals on a daily basis. These shops often have regulars who are around nearly all the time. When one or more of these individuals is suspected of a crime, the entire facility may soon be under investigation. A recent search of a local barber shop led to the arrest of three men who are now facing multiple drug charges. After allegedly receiving information indicating there were drugs and guns at the shop, authorities launched an investigation into the matter. They claim to have used this information to secure a search warrant and several warrants for arrest and proceeded to enter the barber shop. The agents allegedly uncovered various types of narcotics during the process, along with a firearm and some ammunition. Although the agents asserted that there were numerous individuals in and around the shop at the time, they arrested three men following the search. All three reportedly remain…

Additional Nominee for FBI Director: Karen P. Tandy

It's being reported that the President has narrowed his list for head of the FBI.  I have previously suggested Judge Julie Carnes of the Eleventh Circuit.  I now want to add a second name  --  Karen Tandy.Karen and I started off as Assistant US Attorneys.  I was immediately impressed with her diligence, concentration and fearlessness.  She went on to become an Associate Deputy Attorney General for George W. Bush who, in 2003, nominated her to be Administrator of the DEA.  I joined her there as her Counselor, and my working with her only impressed me more with her qualities.  She is a shrewd, decisive leader whose moral compass guides her every moment of the day.About a year ago, she joined the National Security Advisory Council (see this news story, which also outlines her career).  She could make a zillion bucks, and did when she was Vice President of Motorala, but she's a patriot and would give it up to render further…
