In September 2013, I co-founded Lumer & Neville, a small civil rights and criminal defense firm in New York City. We had some real successes and met all of my personal goals and targets. But life is is not static and things change. Which is my way of saying that I have moved on to form the Lumer Law Group.The firm will continue to be located in the same office in the City Hall area of Manhattan, and my practice will be very much the same. I am hoping to find the time to resume blogging, and look forward to hearing from you all again.

Dramatic Changes in New York Criminal Conviction Sealing Law Passed By New York State Legislature

We receive many phone calls from individuals in New York with criminal records who wish to have their convictions sealed or expunged. In a huge change of the existing law, the governor recently signed into law (effective October 2017) a change in the criminal sealing law pursuant to Criminal Procedure Law § 160.59 which allows judges to seal up to two eligible convictions, but just one felony.  While most offenses are now eligible for sealing, not all are: DWI offense are eligible, but many serious violent felonies including sex offenses, Homicide, Assault and Robbery offenses are not (along with most class A felony convictions).   Some Caveats  Two important points: first, individuals convicted of multiple crimes as part of the “same criminal transaction” will be permitted to have all of these eligible offenses sealed as if they were just one offense (CPL § 160.59(1)(a)); and second, any eligible offense may be sealed only after at least 10…

Multi Vehicle Crash in Meridian Sends Two to Local Hospitals

For Immediate Release: 5/29/2017 at 12:55 p.m. Please direct questions to the District Office On May 28, 2017, at approximately 8:12 p.m., Idaho State Police investigated an injury crash on Interstate 84, near the Meridian Exit at milepost 44. Tony D. Meyer, 45, of Hansen, ID, was driving a 1991 Chevrolet pickup eastbound when an item fell out of the rear of the vehicle. Boise City Police Officer Ty Clark was behind Meyer in a 2015 Ford Explorer. Clark activated his emergency lights and slowed to a near stop. Brayan D. Velez Alvarez, 23, of Boise, ID was driving behind Clark in a 2007 Mazda MZ3. Velez Alvarez did not yield to the slowing vehicles and struck the rear of the Explorer. Velez Alvarez's passenger Stacy R. Velez, 28, of Boise, ID, was transported by ground ambulance to St. Luke's Meridian Medical Center. Clark was transported by ground ambulance to St. Alphonsus Regional Medical Center in Boise. All subjects in all vehicles were wearing seatbelts. …

The use of Jeralyn Merritt’s “life plus cancer” as the rhetorical means of making the point that our notion of punishment has run out of room to inflict harm has an analogy on the health care debate. It’s hard to see at first, but reared its ugly head in the final paragraph of Elisabeth Rosenthal’s op-ed: Today, Mr. Albert, 52, is not happy with the price of his family’s high-deductible Obamacare policy: $2,000 a month. Even so, he said: “The A.C.A. was a lifesaver for us. Everyone in my family has something that could be defined as a pre-existing condition.” For the lawyers reading this, let me do the math: that’s a deductible under the ACA of $24,000 per year.* It’s unclear where that comes from, or whether that’s all deductible and co-pay is on top of it. There is a nobility in Cervantes’ Don Quixote’s quest to tilt at windmills despite the fact that we know he’s nuts and won’t win. It’s romantic to fight for a lost cause in the name of morality. For the rest of his life, Unamuno urged his fellow Spaniards to practice quixotism, which meant adopting the moral courage necessary to fight for lost causes without caring what the world thinks. Today, when much of society and politics — both in and outside the United States — looks like a lost cause to a great number of people, we might do well to consider Quixote’s brand of lunacy. There is an obvious flaw to the exhortation: morality is a highly subjective goal. Both sides of the same fight believe in the morality of their cause, and both may be right. They just don’t agree. That’s why claims of morality may be heartwarming, “without caring what the world thinks,” but unavailing as a metric for policymaking.…
