Hello, folks! You may remember be. This is Sam Goldberg (AKA “Attorney Sam”). I used to be your friendly blogger on this site on a daily basis. When last we spoke, I told you that I would be back and also doing more regular blogs elsewhere. 1.4 Million Illegals Using Stolen SSA Numbers:  An audit by the U.S. Treasury Inspector General found that most illegal immigrants who pay taxes have stolen someone else's legal identity.  Stephen Dinan of the Washington times reports stolen Social Security numbers were used on an estimated 1.4 million returns filed in 2015.  The IRS tries to mark the files of fraud victims with electronic filings but it misses about half of them.  The IRS is not currently allowed to communicate with the Department of Homeland Security to identify who is using the stolen information and where they are.  Identity theft has become one of the most prevalent crimes in the U.S. with over 12 million victims annually.  Mexico Sets Homicide Record in May:  New government statistics indicate that May was the bloodiest month in Mexico in twenty years with 2,186 reported murders.  Peter Orsi and Lisa Martine Jenkins of the Associated Press report that there…

The question of mandatory reporting gets murkier when the alleged crime takes place online The brutal sexual assault of a 15-year-old girl on Facebook Live in March 2017 is raising important questions about whether individuals who view a live stream of a criminal act should be held criminal responsible for failing to report it. According to an NPR report, six attackers sexually assaulted the girl. Two of the attackers — both teenagers themselves — have been arrested, and the police continue to search for the others. Police also know that about 40 individuals watched the attack live on Facebook as it was streamed. Sadly, police say this is not the first time they have seen individuals stream video of a crime as it occurs. Now, many have called for the approximately 40 people who watched the assault in real time to be held accountable for not only watching the video, but failing to notify the police in an effort to stop the assault. North Carolina’s Commercial Social Networking Ban for Sex Offenders Is Unconstitutional

In Packingham v. North Carolina, the Supreme Court of the United States struck down G.S. 14-202.5, North Carolina’s ban on sex offenders accessing commercial social networking websites. The law violates the First Amendment. I’ve been writing about Packingham since 2013 (the first mention was here), so I’ll give only a brief summary of the facts today. Lester Packingham is on the sex offender registry for indecent liberties with a child. In 2012, he was convicted after a jury trial for violating North Carolina’s commercial social networking ban for sex offenders for being on Facebook. The court of appeals reversed his conviction (as described here), concluding that the law was facially invalid under the First Amendment. State v. Packingham, 229 N.C. App. 293 (2013). The State sought and obtained review in the Supreme Court of North Carolina, which reversed the court of appeals and held that the law was “constitutional in all respects.” 368…
