FSU professor avoids federal conviction for embezzling from FSU organization

In U.S. v Doran, Dr. James Doran was convicted under 18 U.S.C. 666 of embezzlement form the Florida State University (FSU) as an organization receiving federal funds. He argued on appeals that he is entitled to a judgment of acquittal because any embezzlement was not from FSU and that the government did not prove that the victimized organization under the statutes was a recipient of federal benefits. Under the federal statute it is a federal crime for and agent of an organization to embezzle or convert to the use of any person other than he rightful owner any property valued at $5,000 or more that is owned or in the custody of that organization, government, or agency. The provision also requires that the organization, government or agency receive in any one year period benefits in excess of $10,000 under a federal program involving a grant contract subsidy, or other form of federal assistance. House Passes Kate's Law & "Sanctuary City" Bill

The House of Representatives today passed Kate's Law, H.R. 3004, toughening penalties against deported aliens who illegally reenter the county.  Text is here.  Section-by-section summary is here.  The vote was mostly on party lines, although 24 Democrats voted yes and 1 Republican voted no.The House also passed the No Sanctuary for Criminals Act, H.R. 3003, confirming the interpretation of existing law announced during the Obama Administration that cities that illegally forbid their employees to exchange information with immigration authorities are not eligible for Byrne grants, and it expands the ineligibility to "any other grant administered by the Department of Justice or the Department of Homeland Security that is substantially related to law enforcement, terrorism, national security, immigration, or naturalization."  Text is here.  Section-by-section summary is here.  My prior post on the "sanctuary city" case is…

GORDON SHUMINER HAS PASSED AWAY

This is for old-timers only. Sad news today has reached us that Gordon Shuminer, brother of Alan and Jeff Shuminer, passed away today-Thursday- unexpectedly. Gordon was a public defender in the 1980's. Gordon had immense talent and ability and is still famous for cross-examining an empty chair during closing argument, highlighting a state witness who wasn't called well before Haliburton prevented such brilliant tactics. For those of you who remember him, he was one of a kind. For many years only Alan Shuminer has practiced in Miami, and we are sure he would love to read the memories of his brother from those who knew him. May he rest in peace.Site Feed

Pursuant to both the United States and the Florida Constitutions, people have a right to privacy in their homes.  This means that the police normally cannot come into a person’s home and search for drugs or other evidence of criminal activity without a valid search warrant or consent from someone who lives there.  This right to privacy protection applies to homeowners, people who rent apartments and other residents.  It also applies to less traditional residences like rooming houses. Massachusetts Legislature Passes Pregnant Workers Fairness Act

Yesterday the Massachusetts Senate unanimously passed Senate Bill 2093, the Pregnant Workers Fairness Act (PWFA). Last month the House unanimously passed a similar bill, H. 3680. The PWFA is headed to Governor Charlie Baker, who has indicated he will sign it. What is the Pregnant Workers Fairness Act? The PWFA will amend Massachusetts’ anti-discrimination law (General Laws chapter 151B) to include pregnancy and related medical conditions (including breastfeeding) as protected categories. The law will also require employers to grant their employees reasonable accommodations related to pregnancy, childbirth, or related conditions if such accommodations do not cause an undue hardship on the employer. The law lists examples of the types of accommodations that might be required: more frequent breaks, time off to recover from childbirth, light duty, modification of equipment or seating, modified work schedules, and a private space for pumping breast milk.
