Today, in a short published opinion, United States v. J.A.S., the Sixth Circuit rejected a 17-year-old defendant’s challenge to his conviction for sexually assaulting an 8 year old through vaginal penetration.There was no medical evidence to show an assault, so the government’s case rested on the testimony of the victim.The defendant made two arguments: (1) that the court shouldn't have admitted video of a forensic interview of the victim, and (2) that the victim's testimony was insufficient to convict him.The court quickly dispatched the evidentiary argument. The video, the court concluded, fell under Rule 801(d)(1)(B)(ii), which allows for admission of prior consistent statements if offered to rehabilitate a witness after cross-examine.The court also upheld the sufficiency of the evidence, distinguishing decisions from four other circuits that rejected convictions based solely on victim testimony. In a tragic turn of events, seven adults were shot at a University City apartment complex pool party earlier this month. One woman named Monique Clark was killed. Witnesses say that  49-year-old Peter Selis, a resident at the upscale La Jolla Crossroads complex, never even left his pool chair when he opened fire on a birthday party.  The question left in everyone’s mind is whether Selis was motivated by race, something that the witnesses and survivors of the shooting believe to be true. An article in The Daily Journal about California possibly lowering the passing score for the State Bar Exam—essentially dumbing down the test because “too many” people fail it—caught my attention. The article was published Monday, but I’m a few days behind on reading. At any rate, I’ve been hearing about this off and on for a while now. Mostly, I’ve ignored the news; I have little confidence that anything I have to say is going to affect whether or not bar passage rates are lowered. Supreme Court Decision Sends Shockwaves to Michigan Criminal Law

In a decision that has shocked many in the legal community across the country, The United States Supreme Court made a controversial ruling on June 26th stating that evidence found by police officers after illegal stops may be used in court if the officers conducted their searches after learning that the defendants had outstanding arrest warrants. Justice Clarence Thomas, writing for the majority in the 5-to-3 decision stated that such searches do not violate the Fourth Amendment when the warrant is valid and unconnected to the conduct prompted by the stop. While Thomas is no stranger to controversy, this decision may have a profound effect on the state of Michigan and the criminal law landscape. The case, Utah v. Strieff came about from government surveillance of a home in South Salt Lake based on an anonymous tip of “narcotics activity” there.
