The Governor of Texas has signed a new bill making some people convicted of DWI eligible for a petition for nondisclosure. Texas Knife Reform Bill: Are Illegal Knives a Thing of the Past?

Illegal Knives will be a Thing of the Past (unless you are under 18) Governor Abbot signed House Bill 1935, which will become law on September 1, 2017. Known as the Knife Law Reform Bill, HB 1935 removes the term “illegal knife” from the Penal Code. As a result, knives with blades of over 5 and a half inches, throwing knives, daggers, dirks, stilettos, poniards, bowie knives, swords, and spears are not considered illegal knives. Instead, any knife with a blade over 5.5 inches will be considered a “location-restricted knife.” Unlawful Carry of a Weapon Under 18 Penal Code 46.02 is amended so that it will be illegal for someone under the age of 18 to intentionally, knowingly, or recklessly carry a location-restricted knife on their person. So if you are under 18, it is generally illegal for you to carry a location-restricted knife on your person. Some exceptions apply. For instance, it will still be legal for someone under the age of 18 to carry a…

Baltimore Police Facing Criminal Charges – Numerous Cases Affected

Law enforcement officers are supposed to be the ones working to uphold the law and arrest violators, so it is always news when officers are the ones being accused of criminal offenses. Seven Baltimore officers are waiting behind bars for their trials where they will face charges for numerous crimes stemming from their work on the Gun Trace Task Force. Some of the charges include: Racketeering Extortion Robbery Drug distribution Filing false reports Overtime fraud Allegedly, the officers would rob people at traffic stops or during home searches and would steal money that was seized as evidence. According to reports, the officers even made a video of them reenacting a home search to cover up the fact that they already stole $200,000 from the home’s safe. New allegations state the officers discussed this video and a plan to lie in court while they were jail. The officers are far from the only criminal defendants affected by these charges. Prosecutors immediately began…

Mark Krogstad and Matthew Van Heuvelen, Domestic Asset Protection Trusts: Examining the Effectiveness of South Dakota Asset Protection Trust Statutes for Removing Assets from a Settlor’s Gross Estate, 61 S.D. L. Rev. 378 (2016). Phyllis C. Taite Self-settled domestic asset protection trust (DAPT) are trusts that permit a settlor to use a spendthrift provision in a trust where he is also a beneficiary to protect his assets from creditor claims. DAPTs evolved from offshore asset protection trusts which historically allowed self-settled asset protection trusts. Today, a majority of states within the US do not permit a settlor to create such a trust. DAPTs defy logic in that a person should not be able to place their assets in trusts, benefit from the trust, and then not have those funds available to pay to their debts. Yet, these trusts continue to gain popularity in the United States. A number of jurisdictions have enacted laws that permit self-settled DAPTs. Alaska was…

Beware revealing your cellphone ownership and password to the cops

Cringe-worthy is each time that a client tells me s/he revealed his or her cellphone ownership or password to the cops. The same goes for every time that clients tell me they admitted ownership or possession of bags, rooms, or other material or places where the police find contraband. That thing between your nose and chin, namely your mouth, can spell the difference between being prosecuted and convicted, or keeping your liberty. Silence is tremendously golden when an actual or potential police suspect. Hassan Atkins did not follow the foregoing advice. Atkins v. Virginia, ___ Va. App. ___ (July 5, 2017). After a rash of burglaries in Powhatan County, Virginia, a police officer stopped the car in which Atkins was a passenger, for a moving violation. A search of the car (Atkins apparently did not challenge the search on appeal) revealed a “backpack found at [Atkins’s] feet contained school papers bearing his name, checks payable to [burglary victim]…

Hard Test At Howard Law

How hard can a test question be at Howard Law? Hard enough that it took 504 days to answer it, and they still got it wrong. From the FIRE. On May 4, law professor Reginald Robinson was deemed responsible for sexual harassment after two students complained about a test question involving a Brazilian wax and an upset client. The test question was rather lengthy (it can be found in the link in the quote), and involves a procedure about which I know little more than it sounds painful at best. But apparently, one of Robinson’s students was more familiar with the procedure than Robinson (or me). During a September 2015 class, a female student challenged a test question’s premise that a person could sleep through a Brazilian wax. After a complaint to administrators by two students and a 16-month investigation, Robinson was informed that one of the students allegedly believed the question’s premise somehow required her to reveal to the class whether she’d had a…

Judge Richard Posner Demonstrates His Point

Joel Cohen asked two judges a question. One judge, Jed Rakoff of the Southern District of New York, ended up in a position he likely didn’t anticipate when he agreed to the gig: playing straight man for the other, Seventh Circuit Judge Richard Posner. Then again, Posner is either a master troll, a brilliant pedagogue or completely senile. Of course, these options aren’t mutually exclusive. The primary question was fairly straightforward, one that is subject to regular discussion with good reason. Under the Constitution, federal judges, having life tenure, can be removed only by impeachment and only for “high crimes and misdemeanors.” But should it be that way? While we know there are federal judges in their 80s and even 90s who perform admirably, shouldn’t there be mandatory retirement at a certain age? The problem of old judges, sitting beyond their expiration date, isn’t new, and is always worthy of consideration, both from the functional…
