When it comes to prosecuting physicians for unlawful prescribing of opioids or scheduled drugs, federal authorities have more stringent laws and sentencing guidelines. Recently a physician was arrested last year by the San Francisco District Attorney's Office and charges were not filed. However, just more than six months later federal charges were filed against the same physician. On or about July 11, 2017, Christopher Owens, a physician licensed to practice in California, was indicted on charges relating to unlawfully prescribing oxycodone. Dr. Owens now lives in Indiana but previously practiced at UCSF. Dr. Owens is presumed innocent and charges in an Indictment are not evidence. The DEA is one of the investigating agencies and can also proceed administratively against the physician.The Indictment alleges that over a three-year period between September of 2012 and June of 2015, Dr. Owens intended to act outside the course of usual professional practice and without a…

Appeals Court Issues Decision Clarifying the Definition of “Accredited Preschool” Under School Zone Statute

The Appeals Court recently issued a decision – Commonwealth v. Cooper – clarifying what clarifies as an “accredited” preschool for the purposes of G. L. c. 94C, § 32J, the school zone statute. The defendant was convicted of drug distribution of a class E substance, in a school zone. In its decision, the Appeals Court ruled (1) that the evidence was sufficient to establish that the pills seized from the defendant at the time of his arrest were a class E substance (gabapentin); and (2) that the evidence was insufficient to establish “that the school furnishing the basis for [the defendant’s] school zone violation was an ‘accredited private preschool’ within the meaning of [G.L. c.94C,] §32J.” The background was as follows. Florida Municipalities Debate Dispensaries

As a follow up to my post on the City of Boynton Beach having its regulations overturned by Florida state law, other Florida municipalities are debating medical marijuana dispensaries. Those adopting or extending moratoriums on dispensaries: Marathon City, located in the Keys, has extended its moratorium for another 180 days. Winter Garden, located near Orlando, recently voted in favor of a moratorium. Collier County has also imposed a county-wide moratorium through the end of 2017. Coral Gables, located near Miami, has also voted to impose a ban on dispensaries. City of Sarasota, located south of Tampa, imposed a 60 day moratorium. Miami Beach is investigating a creative workaround to impose some local control on dispensaries.  Miami Beach is looking into changing the zoning rules for pharmacies within their borders since municipalities are required to regulated dispensaries as they do pharmacies. Meanwhile, the first dispensary in the City of Jacksonville, Florida…

Unlike the typical criminal case which includes charges of violence, defendants charged in domestic violence cases are often professionals where the stakes are high: not only is freedom at stake but even a conviction on a reduced charge could spell the end of one’s career.  At the same time, domestic violence cases are traditionally tougher to prove than the garden-variety case of violence due to the fact that oftentimes the only evidence is the word of the purported victim.  For this reason, prosecutors and law enforcement officers will use every bit of subterfuge at their disposal to trick a target into creating the very evidence required to charge and convict them.  The most important advice I can offer anyone who is being investigated for a crime of domestic violence is to simply resist the urge to explain your side of the story to law enforcement.  Resist the urge to discuss the matter with the purported victim – you are probably being taped…
