United States v. Ochoa, — F.3d —, 2017 WL 2836820 (9th Cir. July 3, 2017): Reentry defendant’s prior deportation held invalid because crime of conviction was not categorical match to removable offense; concurrence calls for en banc review to modify collateral attack caselaw Mexican citizen Jose Ochoa was convicted of conspiracy to export defense articles without a license in violation of 18 U.S.C. 371 and 22 U.S.C. 2778, and deported. He returned and was charged with illegal reentry in violation of 18 U.S.C. 1326. He raised a collateral attack upon his prior deportation, arguing that the crime of which he was convicted was not a categorical match for the removable offenses enumerated in the Immigration and Nationality Act (INA). The Ninth Circuit agreed. The INA identifies conspiracy to commit illicit trafficking in firearms and firearms offenses as removable, but the statute Mr. Ochoa was convicted of having conspired to violate swept more broadly than the…

In Alameda county, California lawmakers are considering a contentious bill that would end lifetime registration for certain sex offenders. The lawmaker who introduced the bill, Nancy O’Malley, and the District Attorney of Alameda County’s intent is to save the state money, since it is extremely expensive to monitor sex offenders. Senate Bill 421 would reorganize the sex offender registry into a tiered system and group existing registered offenders into three categories based on the severity of their crimes. A certain number of offenders would be dropped from the list as soon as 2018. “There are people who are still registering who are now 80 years old and they register every year because when they were 18 years old they exposed themselves, there’s injustice in some of that,” says Ms. O’Malley. The bill passed the state Senate’s Committee on Public Safety on last month. Proponents of the new bill say that lightening the work load of law…

Checkpoints are frequently utilized by law enforcement officers in North Carolina. If the checkpoint is Constitutional and follows the statutory requirements laid out by the General Assembly, a vehicle entering the checkpoint can be stopped without any reasonable suspicion of criminal activity. However, the question remains “what is the legality of stopping a vehicle that turns before entering a checkpoint?” View our video here, or read the article for more in-depth discussion. This article will analyze the legality of police stopping a vehicle based on the driver making a turn ahead of a checkpoint. Standard for the Stop: Checkpoint or Reasonable Suspicion In a case where a vehicle is stopped for allegedly avoiding a checkpoint, the Court must determine if there was reasonable suspicion for a stop to occur. A checkpoint stop itself would not require reasonable suspicion. Therefore, “[t]he stop must be based on specific and articulable facts, as…
