During a parole hearing, the Nevada parole board decided to grant former NFL star OJ Simpson parole when he becomes eligible to apply this October after he apologized for his involvement in the 2007 armed robbery. Simpson said that he had been a model prisoner, and promised not to have any conflicts if released.Over twenty years ago, Simpson was the focus of the 'trial of the century'. He was charged the murders of his ex-wife, Nicole Brown Simpson, and her friend, Ronald Goldman. Simpson plead not guilty. After the nine month trial the jury found him not guilty.In 2007, Simpson was arrested for a robbery at a hotel room in Las Vegas. He led an armed group of men into a hotel room to steal sports memorabilia. This antiquated doctrine that is the backbone of our real property system, the most adored and alienable of the estates in land, receives new life, a new purpose even, in Lee Anne Fennel’s compelling article, Fee Simple Obsolete. Fennel gives the reader just enough history about the development and context of the fee simple to lay the foundation for a discussion with the reader about the ways in which the old fee simple has become an anachronism in a largely urban society. See? Not even the police approve of Trump’s absurd and illegal call to rough up perps. Prominent police chiefs and prosecutors first raised their voices months ago against the Trump administration’s attempt to revive failed policing strategies and its repeated suggestion that fair, constitutional law enforcement is somehow inconsistent with public safety. Some of those officials spoke out again over the weekend, after President Trump gave a speech on Long Island urging police officers to rough up suspects arrested in their campaign against MS-13, a violent gang with roots in Los Angeles and Central America. That’s great that “prominent” chiefs and prosecutors spoke out. They should. Trump’s speech was typically moronic and wrong. The brass running police departments immediately realized the damage to their public relations efforts his rhetoric would cause. And, to be less cynical about it, they want their officers to behave…

Because of the widespread use of marijuana in our society, it is common to see criminal cases involving people who have been caught with marijuana and charged with Possession of Marijuana. While several States have legalized the recreational use of marijuana, Illinois is not one of those States. The furthest Illinois has gone to legalizing marijuana is to enact the Medical Marijuana statute which allows for the medical use of marijuana.  Unless you have been approved to use Medical Marijuana, it is illegal to use and possess any amount of marijuana in Illinois. So what could happen to you if you are arrested by the police and charged with possession of marijuana? As of about a year ago, if you were caught with any amount of marijuana whatsoever, you could be facing a Class A misdemeanor which carries a maximum punishment of up to one year in jail and a maximum fine of $2,500. But about a year ago, the law was changed to make the possession of 10 grams or less of marijuana…

Given the increasingly mobile-dependent state of our society, it should come as no surprise that law enforcement in recent years has zeroed in on cell site location information (“CSLI”) as a crucial source of potential evidence in criminal investigations. In 2016, AT&T alone received 70,528 law enforcement requests for CSLI, many without a warrant. That works out to nearly 200 CSLI requests per day. In fact, these requests have become so prevalent that cell phone companies now provide self-service portals to law enforcement to help meet the constant stream of demands. The way cell towers work is fairly straightforward: Each individual side or “site” of a cell tower contains antennas that detect the radio signals from your cell phone. SJC Clarifies Trial Court Judge’s Authority to Award Jail Credits

The Supreme Judicial Court recently issued a decision – Commonwealth v. Lydon – clarifying the trial court’s authority to award jail credit to defendants.  In the decision, the Court vacated the judge’s “order denying [the defendant’s] motion for credit for time being served in a house of correction for one set of offenses, while he was awaiting trial and sentencing in the Superior Court on a second, unrelated set of offenses.” The background was as follows. “While the defendant was on probation for various drug offenses (Roxbury charges), he was arrested and arraigned in the District Court for three new robbery offenses, for which he later was indicted and arraigned in the Superior Court (Dorchester charges). About five weeks after his arrest on the Dorchester charges, the defendant stipulated to violation of the conditions of his probation, was sentenced on the Roxbury charges, and began serving a six-month committed…
