I had a daughter make it through college without getting raped. Not even sexually assaulted or harassed. She might have heard a dirty joke or two that would count as a microaggression or marginalize the vulnerable, but she laughed instead. Because it was funny and she wasn’t searching for excuses to be traumatized. Amazing, given that the rep being spread is that colleges are rape factories. And my daughter is very pretty, even if I’m her father. I had a son make it through college without being charged with rape, or even compelled to have a sit down with the Title IX administrator. There was one time when it might have happened. His best friend was in a suite with an ex-girlfriend, and he would visit his friend regularly. His ex would see him, and complained to an RA that my son’s presence in the suite made her feel “uncomfortable.” The RA, knowing both of them, told her to grow up. She survived and both graduated. That taps out my children. I was…

Which Police Agencies Can Make DC DUI Arrests?

The District of Columbia is unique for a lot of reasons, not the least of which is the fact that there are dozens of police departments whose officers regularly patrol the city. Between the Metropolitan Police Department, the United States Secret Service, the Metro Transit Police, the United States Park Police, the Capitol Police, the myriad university police forces and more, D.C. residents can practically be pulled over or arrested anywhere by any force at any time. That being said, it is always helpful to have an understanding of the different federal and local police forces which have jurisdiction in Washington, D.C. and to know their jurisdictions. Here is an overview of some of the most prevalent police forces in D.C. who can pull you over and potential arrest you for a DC DUI or DWI: 1. District of Columbia’s Metropolitan Police Department (MPD) The Metropolitan Police, or MPD, is the local police force for the District of Columbia, and its jurisdiction covers the…

Exploring (long-term) ups and (short-term) downs of police shootings in Texas

Last month's Reasonably Suspicious podcast from Just Liberty featured a new segment titled "Suspicious Mysteries" which focuses on questions to which there are no definitive answers. The topic this time: possible reasons why deaths in police custody in Texas doubled from 2005 to 2015, then steeply declined in 2016. A friend in another city asked if I could pull the 4-minute segment out as a stand-alone for use by advocates, so here you go:For more:Why the increase in number of Texans shot by police?Texas police almost never punished when they break rules and kill peopleBest Practices: Police training should prioritized deescalation, get rid of the 21-foot ruleAnd from Grits' contributing writers:Eva Moravec's Point of Impact series producing narrative journalism on Texas police shootings of unarmed people.Amanda Woog's Texas Justice Initiative project documenting deaths at prisons, jails, and in police custody.Podcast conversation between Eva…

Short Take: Are We Dead Yet?

I got an email from a senior federal judge (not from Nebraska, so no, not the robed rider), which ended with something that scares the daylights out of me. “…a dying profession.” Is law dying? Are lawyers part of a dying profession? If so, then why am I wasting my time and energy trying to keep it from dying? There are objective criteria that suggests the profession is dying. Bar exam pass rates are outrageous bad. Are we only getting the dumb kids going to law school? The bastion of the old guard, the American Bar Association, has forsaken anything to do with the practice of law in favor of becoming a shining beacon of social justice.  Academics are making dime on A2J, Access to Justice, where starving lawyers are supposed to starve some more for the sake of people who don’t want to pay for lawyers. The prawfs aren’t donating their paychecks to the Legal Aid Society. Then there were the geniuses at #AppellateTwitter who were outraged at the…

Fighting Your Child’s Connecticut Boarding School Sex Assault / Rape Investigation

Some of the best boarding schools in the country can be found in Connecticut: Choate Rosemary Hall, the Taft School, Hotchkiss, Loomis Chaffee and the Kent School. But if your child is being accused of rape or sex assault at any of these Connecticut boarding schools, you need to protect them from criminal and civil penalties as soon as you learn about the accusations. Not only is their professional reputation at stake, but their freedom is as well if the accusations rise to a criminal level. A Connecticut Boarding School Investigation Can Escalate to a Criminal Case Almost all private high schools and colleges are adopting Title IX-like policies in the wake of national high profile sexual assaults at boarding schools that went unchecked, were swept under the rug, or were not properly handled by the secondary school. (Title IX and its legally required investigation protocols only apply to private schools that accept federal funding). As a result, whenever an accusation of…
