One of four individuals accused of partaking in a multi-state sex trafficking ring that preyed on foreign-born women has admitted to her role in the criminal enterprise. Fangyao Wu, 23, of Irvine, Calfifornia pleaded guilty on Thursday in Washington County District Count to one count of felony racketeering after reaching a deal with prosecutors. Wu was originally charged with six felonies, so while it may sounds like she got off easy, here’s a look at part of the agreement she signed. Wu will received a stayed jail sentenced for her conviction if she: Cooperates with authorities on the criminal cases still pending against the three other individuals charged in the bust. Forfeits more than $700,000 she earned in proceeds from the sex-trafficking scheme. Authorities said they were willing to come to an agreement with Wu because she was willing to help the state formulate stronger cases against other more involved members of the sex-trafficking ring, and because authorities…

Juvenile (Younger than 17 Years of Age) and Shoplifting

$

No parent wants to learn their child has been accused of shoplifting, however it isn’t uncommon for minors (those younger than 17) to commit this crime. It can be very enticing to a young girl to stick a tube of lipstick in her pocket or purse; a young man just can’t resist a “five finger discount” that seems easy enough to get away with. As a parent you may experience disappointment, disbelief, even anger. While no parent should condone stealing, you don’t want your child to wind up in jail or with a criminal record. What should you expect? Depending on the item a teen is attempting to shoplift and other circumstances, many stores decide not to call the police and simply confiscate the item(s). However, if the manager or someone in an authority position does decide to call law enforcement in, the age of your child is the biggest factor in how the case will be handled. In the state of Michigan someone who is 17 or older is charged as an adult;…

Deaths of 10 People in a Trailer in Texas Highlights Human Trafficking Crimes

The recent deaths of 10 people who were crammed into an overheated tractor-trailer has again highlighted the hazards of the human smuggling industry in Texas. In July, the Department of Justice charged a truck driver accused of involvement in a human-trafficking incident. At least 10 people died in the parking lot of a Walmart in San Antonio, Texas and dozens more were injured. Police said as many as 100 immigrants were packed inside the trailer. A federal complaint was brought against James Matthew Bradley Jr. The 60-year-old truck driver was charged with one count of transporting illegal aliens. The charge carries the possibility of the death penalty, reported The Hill. Bradley denied knowledge that nearly 40 people were in the trailer he said he was transporting from Iowa to Texas. The trucker said he discovered the undocumented immigrants when he stopped at the Walmart in San Antonio for a bathroom break. He said he heard banging from inside the trailer. He claimed he…

Search Warrants and Russia Raids

Look sharp, feel sharp. The execution of a search warrant on a residence owned by Paul Manafort, President Trump’s former campaign director, raises some interesting questions.  Search warrants are rarely necessary in white-collar cases, yet their use seems to be more and more common. Here was my take on Brian Williams’s MSNBC show The 11th Hour: As I told Michael Schmidt of the New York Times: “A search warrant is very bracing for the person who is being searched,” said Jack Sharman, the former special counsel to the House Banking Committee during its Whitewater investigation of President Bill Clinton in the 1990s. “It’s very invasive and sends a loud statement from the prosecutors to the person that there should be no doubts about the seriousness of the investigation.” “The government will be investigating something like public corruption, and it knows that you know something about it,” said Mr. Sharman, now a…

Federal and Oklahoma Trucking Regulations

Federal trucking regulations and standards keep our roads safe in this country. Their chief goal is to reduce and prevent life-threatening accidents. Truckers and other large commercial vehicle drivers who fail to adhere to these regulations put everyone on the road at risk. There are some situations where Oklahoma state regulations outweigh federal regulations concerning intrastate travel. As long as the truck or commercial vehicle stays within the state, different laws apply. In the infographic below, we examine many important federal regulations, as well as some Oklahoma trucking regulations that affect or supersede the federal laws. As you’ll learn in the graphic, there are many, many regulations that truckers and trucking companies are required to follow. Any failure to follow just one of these rules can cause an accident, and place the truck driver or company at fault. When truck drivers or trucking companies fail to follow these regulations, they can cause…

$38.75 Million Settlement in Red Light Ticket Lawsuit

The city of Chicago's automated red light camera system has grown to over 350 cameras and has raised over $500 million through $100 tickets since 2002.Investigations beginning in 2012 exposed corruption, lack of oversight, and inconsistent enforcement, which lead to a class-action lawsuit against the red light camera program. Recently, the city settled the lawsuit for $38.75 million. The deal would qualify 1.2 million motorists from 20100 to 2015 for 50 percent refunds because the city didn't give adequate notice to red light and speed camera violators. $28.75 would go towards cash refunds to those who paid their fines and $12 million would be debt forgiveness to those who didn't pay the tickets because the city failed to send out second notices of the violation that was required until 2015. The city will use general fund revenue to pay the settlement. Over $11 million could go towards attorneys who filed the class-action lawsuit.Comments from Allen:The history of…

If you have been served with a restraining order in California (also sometimes referred to as a protective order) you likely have a lot of questions. While an experienced criminal defense lawyer can answer each and every one of your queries, the aim of this article is to address one of the most commonly asked questions: What can a California restraining order do? However, keep in mind that each restraining order is different and the possible effects discussed below may or may not be applicable in your case. The Possible Effects The effects of a California restraining order vary slightly depending on which type of protective order (i.e. civil harassment, domestic violence, elder/dependent adult abuse, or workplace violence restraining order) has been issued against you. However, the California Court’s website notes that California judges often order restrained people: Not to contact the protected person, or any member of their household; To stay away from the…

Nicole Hong reports for the WSJ, "Joaquín 'El Chapo' Guzmán, the Mexican drug lord awaiting trial in New York, wants to hire private lawyers. But they may have to join the case without any assurance of getting paid."Guzmán is presently represented by the federal defender.  His potential private lawyers want "blanket, prospective assurance" from the government that the money he uses to pay them won't be forfeited.  The government, unsurprisingly, said "fuggedaboudit," or something to that effect.See this post from last year on the Supreme Court's fractured decision in Luis v. United States and Dean Mazzone's article that I linked to yesterday.  Continuing with the WSJ article:Mr. Guzmán wants to hire a team led by Jeffrey Lichtman, most well-known for securing an acquittal for John A. Gotti, son of the notorious mob boss. The team also includes A. Eduardo Balarezo, William Purpura…

The Case for Asset Forfeiture Reform in Texas

$

It is said that everything is bigger in Texas, unfortunately, that isn’t always a good thing. In just under a decade, Texas has taken $540.7 million dollars’ worth of assets from its citizens.[1] Texas is one of the more aggressive states when it comes to the practice of civil asset forfeiture, earning an average yearly income of $41.6 million from the practice. [2] Legal Taking of Property? Civil Asset Forfeiture is the practice by which property can be confiscated from people without ever charging them with a criminal offense. Civil asset forfeiture is an actual civil suit brought against the confiscated item leading to bizarre sounding cases such as State of Texas v. One 2004 Chevrolet Silverado, and State of Texas v. .39 acres. Continue reading
