Lawsuit Claims Chicago Police Sergeant Framed 15 Men for Drug Crimes

Fifteen men are asking a Cook County judge to vacate their drug convictions, accusing Chicago police of extorting, framing, threatening and harassing them along with other residents of their South Side housing project. In a petition filed Wednesday by the Exoneration Project, attorney Josh Tepfer described misconduct by Chicago police within the former Ida B. Wells housing project that lasted over a decade. The plaintiffs claim that police, under former Chicago Police Department Sergeant Ronald Watts, extorted money from them, planted felony-level amounts of drugs on them and later forced them to plead guilty to the charges. Sergeant Watts was arrested in 2012 after attempting to rob someone he thought to be a drug courier but who was in fact an FBI informant. He pled guilty and was sentenced to 22 months in prison. Since Watts’ conviction, three defendants have had their drug convictions overturned due to evidence that Watts and his team planted the evidence.…

On November 4, 1988, HT, a then 21 year old fellow from Cambridge, walked into a bank and presented a check to the teller to be cashed. The check was made out to HT. Unfortunately the signature on the check had been forged. The teller suspecting there was a problem with the check alerted the branch manager who in turn notified the police. The police responded to the bank and HT was arrested and charged with forgery and uttering (trying to pass) a forged check. Both charges are felonies. HT was bailed out and then left Massachusetts. He failed to appear in Court. A subsequent criminal complaint was taken out against HT for Failing to Appear and a warrant was issued for his arrest on that charge as well. Twenty-nine years passed. HT married and now has six children and nine grandchildren. HT lives in Wyoming and is a truck driver. The warrants finally caught up with HT and Wyoming suspended his license due to the outstanding warrants in Massachusetts. HT contacted Attorney Robert…

Ohio Murderer's Death Sentence Upheld:   The Ohio Supreme Court voted 6-1 Wednesday to uphold the conviction and death sentence of habitual felon David Martin, who killed a man and severely wounded a woman during a robbery.  Guy Vogrin of the Tribune Chronicle reports that a jury convicted Martin on September 11, 2014 of the robbery, murder and attempted murder committed two years earlier.  The court's decision describes how Martin, a low level drug dealer, visited the apartment of Jeremy Cole, 21 and Melissa Putnam, 27, on September 27, 2012.  During the visit, Martin pulled a gun and had Putnam tie up Cole and herself.  After a fruitless effort to get  money and car keys from Cole, Martin shot him in the head, then shot Putnam.  Putnam raised her hand just before the shooting deflecting the bullet which struck her in the neck.  Martin's defense attorney argued that his incriminating statements to police should have been…

How many people would think twice about getting behind the wheel after having a few drinks knowing that they were above the legal limit? My guess is a lot. No longer must a person guess whether they are over or under the legal limit if they have their own personal breathalyzer. So can a personal breathalyzer prevent a DUI? I don’t see why not. Breathalyzers are so readily available nowadays that, in addition to the standard multiple-use breathalyzer, they have developed single-use disposable breathalyzers and breathalyzer apps for the smartphone. As you can imagine, the range in the quality and price of personal breathalyzers is quite large. Costs will vary between $15 and several hundred dollars. Breathalyzers under $50, and those coming on key chains have questionable accuracy from the start and accuracy continues to decrease after multiple uses. Unlike novelty breathalyzers, quality breathalyzers will be backed by the Food and Drug Administration (FDA). This means…

In Hurst v. Florida, the Supreme Court held that Florida’s death-penalty sentencing scheme unconstitutionally authorized judges to find facts necessary to impose a death sentence.  Under Florida’s unconstitutional system, juries recommended a life or death sentence, and then judges held a separate hearing to find mitigating and aggravating factors.  Judges then imposed a sentence after consideration of those factual findings and the jury’s recommendation.  In the immediate aftermath of Hurst, Professor Douglas Berman predicted there“will likely be multi-headed, snake-like litigation that will grow and grow again” in Florida, federal, and other state courts.  He coined the term “post-Hurst hydra” to describe that multi-headed litigation beast.  The Sixth Circuit was one of those courts that had to contend with the post-Hurst hydra.  In re Coley decapitates one of the post-Hurst hydra’s heads.
