Have you ever yelled at your spouse, perhaps out of frustration or even anger? If you say “no”, I don’t believe you. For those of us who on those rare, embarrassing occasions have sounded off rather loudly, best keep away from England, since Britain’s highest court has found that raising your voice to your spouse qualifies as domestic violence. This is truly a case of “words mean what I say they mean” and the “I” is Baroness Hale of Richmond, who was the first woman appointed to the prestigious House of Lords in 2004 and in 2009 took her place on England’s new Supreme Court of the United Kingdom. She is the most senior female judge in Britain. The case involved 35 year-old Mirhet Yemshaw who lived in government subsidized housing with her husband and children. She brought an action against the housing authority for refusing to provide her with her own apartment after she left the home she shared with her husband because of…

In a recent Massachusetts assault case, the defendant pled guilty to assault and battery on a girlfriend and her child. A judge sentenced him to 2 1/2 years in the house of correction, but he only had to serve six months with the balance suspended for three years. He was sentenced to three years of probation on the second charge. He moved to revise and revoke the sentence. He asked if he could serve the sentence on weekends. The sentence was stayed until 2015, and on that date, the judge allowed the motion. The Commonwealth appealed, arguing the judge had made a mistake in granting the defendant’s motion. It argued the defendant didn’t meet the criteria provided under M.G.L. c. 279 section 6A that would allow him to serve a special weekend sentence. After the appeal was entered, the judge held a hearing on the sheriff department’s petition to modify after the appeal was entered. The sheriff argued that the defendant should not be eligible due to his priors,…

Witnesses provided deputies with a description of the moving truck. Shortly afterward, deputies stopped a 10 foot U-Haul truck with roof damage, driving north on Gulf Winds Drive at 64th Avenue in St. Pete Beach. Officials said the man told them he attended a party at Hotel Zamora. A spoliation letter helps keep evidence from being lost or destroyed. It makes obtaining evidence for a case much easier by putting the evidence holder on notice. The letter is given to the involved parties and ensures that they must do their due diligence to keep key evidence from being destroyed, tampered with, or misplaced. The most important part of any personal injury, workplace injury, or trucking accident case is to gather meaningful evidence to be used in court. This vital step will ensure that proper information and facts pertaining to the accident can be preserved and prepared to fight for justice. A Spoliation Letter is All About Preserving Physical Evidence In the video above, Chris Hammons, Founding Partner at Laird Hammons Laird, explains the benefits of acquiring a spoliation of evidence letter. “As soon as we sign up with the client, we’re finding out the contact information for the trucking company,” he said. This is important, because,…

How the Specificity of the Description of a Suspect Can Affect a Maryland Criminal Case

$

In many criminal defense cases, one of the most important aspects of the case may be getting (or failing to get) evidence excluded. One way in which you may be entitled to suppression is if the police stopped you but did not have a reasonable suspicion to do so. One circumstance in which that can happen is when the description of the suspect the police use contains only a race and very general descriptive information. Arguing successfully these types of Fourth Amendment issues is something that can often benefit from the skill of an experienced Maryland criminal defense attorney. A recent case involved a robbery in Gaithersburg. As is normal, dispatch sent out a call about the robbery and information about the suspects. Initially, dispatch simply stated that the suspects were “three black males.” One officer, who was in the area, responded and spotted three black males in the area of the apartment where the robbery took place. According to the officer, the men he…
