Observers reported that it was not that nearly dramatic, nor poignant, nor bittersweet, as Michael Grieco signed the rights waiver former and answered the plea colloquy questions from Judge Sam Slom in a clear and steady voice on Tuesday morning. Hours before arriving at court, Grieco, as required by his plea agreement, resigned as City Commissioner for Miami Beach, perhaps ending a promising political career. And perhaps not. Because adjudication was withheld, and all the plea agreement requires is that Grieco not run for office during the time he is on probation. Stranger things have happened. And perhaps with an eye to the future, Grieco sent out this email to his supporters. I spend hours of time at least once a month traveling to various prisons around the State of Georgia. Most of these facilities are far away and involve travel deep down Interstate 16. Very little substantive progress is made on cases in these visits. They tend to be venting/counseling sessions. And, for an hour or two of client discussion, the lawyer is away from the office for a day. It is difficult to mix a prison visit with productivity in other areas. Many times, I have had things arise where I had to work as a mobile office from a Subway, Cracker Barrel, or Public Library out in the hinterlands. It all works quite well except that there is still the matter of the multi-hour drive home. Added to the time-consuming nature of doing the prison visit is the fact that you need to set up the visit in advance by faxing paperwork and getting on the phone. Contrast this process with seeing an inmate at a county jail, which is generally local and able to handle drop-in visits. Also,…

As many people know, the federal government classifies certain drugs according to a schedule.  In fact, the Drug Enforcement Agency is permitted by statute to make the rules which determine in which class a particular drug belongs.  Criminal statutes and penalties are enacted based on those classifications.   Schedule I drugs are considered the most dangerous and the most addictive.  Examples of Schedule I drugs are heroin and LSD.  Schedule V drugs are the least dangerous.  An example of a Schedule V drug is the cough medicine Robitussin. Despite Schedule I including the most dangerous and addictive drugs and substances that have no accepted medical value, cannabis, or marijuana, is still considered a Schedule I drug.  Basically, the federal government is saying  marijuana is just as bad as heroin and bath salts.  Also, despite the fact that doctors all over the country, and all over Florida, are prescribing marijuana to patients to…

Earlier this year, Attorney General Jeff Session vowed a federal crackdown on doctors and pharmacists who are doling out a disproportionate number of opioids.
