Sometimes it seems lawyers have a Latin phrase for everything: Self-represented litigants? They’re pro se. The thing speaks for itself? Res ipsa loquitur. Volunteer legal work? That’s pro bono to us. While attorneys have had an English word and Latin phrase to describe this last category, many public attorneys in North Carolina have historically had no mechanism for actually doing it. That’s because, until last July, G.S. 84-2 prohibited district attorneys, public defenders, and others from “engag[ing] in the private practice of law.” A person practices law when he or she provides legal services for another, regardless of whether the person is compensated for the work. See G.S. 84-2.1. Recent amendments to G.S. 84-2, however, allow some public attorneys who were previously disqualified to carry out certain types of pro bono legal work. A prostitution investigation involving an Elizabeth man resulted in his arrest for possession with intent to distribute heroin. This drug charge arose when police were conducting a prostitution investigation at a local hotel and uncovered about 120 baggies of heroin and a digital scale. The defendant, who was from the City of Elizabeth, was charged with distribution of CDS, specifically heroin, as well possession of drug paraphernalia. Distribution of a controlled dangerous substance like heroin is illegal under N.J.S.A. 2C:35-5. The severity of a possession with intent to distribute charge hinges on the quantity being sold. Irrespective, the offense is a felony that may only be dealt with at the Union County Superior Court in Elizabeth New Jersey. Distributing 5 ounces of more of heroin is a first degree crime. Distribution of at least one-half ounce but less than 5 ounces of heroin is a second degree crime. Selling less than one-half ounce of heroin, such as the 120 folds…

Rahway Man Arrested For Linden Burglaries

A string of burglaries in Linden has led to the arrest of a Rahway man. The individual has been charged with burglary, criminal mischief and theft, stemming from three break-ins over four weeks in the City of Linden. Burglary is a fairly common theft related offense in Linden, Rahway and elsewhere in Union County. A burglary is committed in violation of N.J.S.A. 2C:18-2 if an individual enters a structure without authorization for the purpose of committing a theft or other criminal offense. A burglary charge is typically a third degree crime but can be enhanced to a second degree crime if the actor: (1) purposely, knowingly or recklessly inflicts, attempts to inflict or threatens to inflict bodily injury on anyone; or (2) is armed with or displays what appear to be explosives or a deadly weapon. In this Linden case, there are no allegations of use of a weapon or threat to inflict physical injury by the Rahway defendant. The accused is therefore facing a third degree crime. A…

The primary roadside tool used by law enforcement officers in the enforcement of DUI laws is the Preliminary Breath Test (PBT) or Preliminary Alcohol Screening (PAS) breathalyzer device. These small devices can be easily held in one hand. The officer instructs the driver blow into a mouthpiece on the device. This testis conducted twice enabling the officer to confirm a consistent result. Remember, in California, a driver does not have to submit to a roadside breathalyzer test unless he or she has been arrested. And even after an arrest, the driver still is not required to submit to the roadside test but may request a blood test or a breath test on the more accurate breath testing machine located in all law enforcement stations. The breath test machines at police stations are larger devices and produce more accurate results than the roadside devices. Cardozo School of Law will host an all day symposium on the organization’s impact on law, policy, and scholarship. Speakers will include Innocence Project Co-Founders Peter Neufeld and Barry Scheck, Judge Jed Rakoff of the Southern District of New York, and leading criminal justice scholars, researchers, and reformers, including Jennifer Dysart, Rodney Ellis, and Ellen Yaroshefsky. The Innocence Project was founded in 1992 as a legal clinic at the Cardozo School of Law. I Didn’t Do It: Is There Justice for the Wrongfully Convicted?

My sense of justice really comes unglued when I read about another poor schlep who has spent years in prison for a crime he or she did not commit. One of the most recent is Romeo Phillion, now 74-years-old, who was wrongfully convicted of murdering Ottawa firefighter, Leopold Roy in 1967. Mr. Phillion spent 31 years behind bars, mainly because of his initial false confession, quickly recanted, which resulted in a plea deal, and the despicable suppression of crucial evidence by the Crown, that would have exculpated Mr. Phillion. Nothing really important…just uncontroverted evidence known by the Crown, that Romeo Phillion was two hundred kilometres away from the murder scene. You mean he was somewhere else? Yes, that’s right.
