TD, a 52 year old machinist from Haverhill, is married with two children. On June 4, 4017 TD and his wife and children went to a Burger King for lunch and then to the movies at the Loop in Methuen. TD works third shift and typically goes to sleep around 1-2:00 pm. When they all left the movies his wife said they had to go to the supermarket. TD reminded her that he had to go to sleep to be able to get up to go to work. An argument broke out between the two of them; she was driving the family car and she began to poke TD with her right hand. He put his hand up to block her and pushed her right hand away causing it to bruise. She drove to the Haverhill Police Department and went inside and reported to the police that her husband had just assaulted her. The police came out of the station and questioned TD and then arrested him and charged him with a domestic assault & battery. His wife also took out an emergency restraining order against him. Idaho State Police detectives yesterday arrested two more suspects in the murder investigation that began on Oct. 21 when hunters discovered a deceased male in Owyhee County. Nicholas B. Vandenberg, 27, of Melba, Idaho has already been charged with first degree murder in that investigation. On Oct. 31, 2017, Idaho State Police arrested two more suspects and charged each with Conspiracy to Commit First Degree Murder. They are: - Montanna Rae Reed, 20, of Twin Falls (female) - Willie Keith Rabey, 34, of Mountain Home The two suspects are known associates of Vandenberg. ISP detectives arrested Reed in Twin Falls and Rabey in Mountain Home. They are currently being arraigned in those two cities and will be extradited Owyhee County Jail, however, a specific date/time for that extradition is not firm. Note to reporters: Photographs of the two suspects are not yet available - reporters should check with the Owyhee County Jail for booking photos. ###

A jury in a federal court convicted a former hedge fund manager of three out of eight counts related to securities fraud in early August 2017. The government had charged the defendant with multiple counts related to alleged defrauding of investors and misuse of corporate funds, as well as conspiracy to commit various fraudulent acts. United States v. Shkreli, No. 1:15-cr-00637, superseding indictment (E.D.N.Y., Jun. 3, 2016). The case is notable in part because of the high degree of infamy gained by the defendant for reasons unrelated to this case. The securities and wire fraud charges in this case added to the defendant’s unpopularity, presenting challenges for the defense team. The Securities Exchange Act of 1934 regulates the trading of various securities, particularly corporate stocks. On April 27, 2017, WO, a 26 year old warehouse worker from Haverhill, MA was arrested and charged with Domestic Assault & Battery on his girlfriend. WO works second shift at a warehouse and he got home on April 27, 2017 from work at about midnight. His girlfriend (who is also the mother of his two children) was asleep as were the children. WO suspected that she had been communicating with an old boyfriend. WO took his girlfriend’s cell phone and began to read through her recent text messages. Sure enough WO found intimate text conversations between his girlfriend and her (former) boyfriend. According to the police report WO went into the bedroom and woke his girlfriend up and pulled her out of bed and then proceeded to literally physically “throw” her out of the house. US v. Johnson, No. 16-50018 (11-2-17)(Paez w/Berzon & Christen). The 9th reverses the denial of a judgment of acquittal in an obstruction of justice prosecution under 18 U.S.C. § 1512(b)(3).  The prosecution, and conviction, was for failing to include material information about the use of force against a county inmate in the Santa Barbara Jail. (The jury acquitted on the assault charge).   The 9th held that the government failed to show a nexus with a federal prosecution, or that the information would have reasonably reached federal officers. In so holding, the 9th applied the standard of Fowler v. United States, 563 US 668 (2011).  Although Fowler concerned 1512(a)(1), witness tampering, it is applicable to obstruction.  Fowlerrequires a "reasonable likelihood" of tampering, and that standard should be used here.  In this matter, the prosecution only presented evidence that the defendant (a corrections officer) knew of the…

An Ohio man who spent 13 years in prison for a rape he did not commit is on his way to joining the police force, according to the Dallas Morning News. Innocence Project client Michael Green was exonerated in 2001 after DNA testing of evidence revealed he was not the perpetrator of the 1988 rape for which he was convicted. In September, Green graduated from Cuyahoga Community College’s Peace Officer Basic Training Academy and is looking for a position in which he can give back to his community and recruit local youth. “When I walked out of prison, I told myself I would be an advocate — that as long as I was able, I would help others,” Green told the Dallas Morning News. “For the longest time, it seemed I couldn’t get things right. KD, a 50 year old electrician from Plaistow, NH, had been in an on again off again relationship with a woman from Pepperell, MA. She had a serious alcohol problem and every time he would break off the relationship she would do something crazy. On one occasion she reported to the police that he had sexually molested his 16 year old daughter who lived with him (he had legal custody). As a result of that report he was investigated by the police and the Department of Children & Families. He was completely cleared of those allegations. In the late fall of 2016 they broke up. On a night in February of 2017 she called him and told him that she had no food in the house and that she needed him to repair an electrical outlet for her. He told her he would come over to her apartment and that he would bring in Chinese food to eat and that he would fix the electrical outlet.
