Carjackings Climbing in Chicago:  After declining for seven years, carjackings in Chicago started increasing in 2015, nearly doubling in the next two years.   An in-depth report In today's Chicago Tribune by writer Jeremy Gorner notes that while the focus over the past several years has been on the city's astronomical murder rate, virtually all types of violent crime have been increasing in Chicago with carjackings heading to a 10-year high in 2017.  Although most of the nearly 600 murders in the city have been in the poorer high-crime districts, the 661 carjackings have occurred all over Chicago including the trendy Wicker Park, Bucktown and Logan Square neighborhoods.  Both homicides and carjackings had been lower in 2014, compared to previous years, but both crimes began to increase after the highly-publicised October 2014 police shooting of Laquan McDonald.  While correlation does not prove causation, some officers believe that the…

Florida Police Officer Makes Illegal DUI Arrest Outside of His Jurisdiction

With some exceptions, police officers generally work for a county or city department.  In Florida, we do have the Florida Highway Patrol and officers who work for multiple agencies and federal law enforcement officers, but most cases of common crime, like DUI cases, will involve a county or city police officer.  Those police officers are generally only allowed to investigate crimes and make arrests for crimes that occur within their jurisdiction.  There are a couple of exceptions. One is when the police officer is pursuing a suspect.  For instance, if a police officer observes a crime occur in his/her county and the suspect runs or drives into the next county, that police officer can chase the suspect into the next county. The police officer cannot chase the suspect forever and should contact a police officer in the next county to take over, but the officer does not have to stop at the county line.  Another exception is when exigent circumstances…

Recently, the Louisiana Supreme Court made national headlines by ruling 8-1 that a defendant who said, "Why don't you just give me a lawyer, dog?" wasn't really asking for a lawyer.In the same vein, Texas 14th Court of Appeals in Texas ruled on October 31st that a defendant who said he wanted to call his sister to ask her to get him a lawyer also didn't unambiguously say he wanted a lawyer. In part, that's because the detective kept interrupting him to keep him from being more explicit! And at the end of the day, the ploy worked! The appellate court said the defendant's desire for representation was insufficiently explicit to be binding, even though it's obvious to any sentient person he wanted an attorney because it was "the only option I have."This garbage has been going on as long as I've been around the criminal-justice arena and it's indefensible.
