In September, a New Jersey Court vacated their convictions for a 1993 felony murder and robbery based on DNA evidence identifying another suspect. After the court set a bail that the two men could make, the prosecution appealed their release and they waited, once again, to walk out of prison. On November 8th, the New Jersey Supreme Court rejected the prosecution’s arguments, allowing the men to post bail. New Gang Sentencing Enhancements

Two new sentencing enhancements related to gangs will come into effect for offenses committed on or after December 1, 2017. Session Law 2017-194 made numerous changes to North Carolina’s gang suppression laws. For starters, it dropped the “Street” from the title of the “Street Gang Suppression Act” in Article 13A of Chapter 14, replacing it with “Criminal.” It is the “North Carolina Criminal Gang Suppression Act” now. Numerous conforming changes are made throughout Chapters 14 and 15A. Among the other changes in the law are two new felony sentence enhancements, both added within Structured Sentencing (Article 81B of Chapter 15A). Today, I spoke with a client that suffers from multiple sclerosis (MS) and is charged with DWI or driving while intoxicated.  For those of you who don’t know what multiple sclerosis is, MS is a disabling disease of the central nervous system which consists of your brain and spinal cord.  The disease attacks the protective covering around your nerve fibers.  Think of the plastic covering on copper wire.  The comparable covering on your nerves is called myelin.  MS attacks the myelin and causes communication problems between your central nervous system and the rest of your body.  The damage can become so severe that a patient can have problems walking and later may not be able to walk at all.  Is this the first client I have had that has been charged with DWI when they have not been drinking?  No.  I’ve had multiple clients charged with driving while intoxicated when they are suffering from a disease of the nervous system…

Three teenagers were arrested for drug possession following a traffic stop by Nassau County Police. One of the men was linked to an 18-year-old student’s nonfatal overdose that occurred inside the classroom of an unspecified New York high school. Investigators identified Kevin Staiano, 18, as the individual who sold drugs to the overdose victim. Staiano was a passenger in a car being driven by Brandon Bromberg, 18, when they were pulled over during the traffic stop. Officers searched their vehicle and found a backpack that contained a cache of drugs including Ecstasy, Xanax, cocaine, marijuana, ketamine and psilocybin mushrooms. Authorities also learned that Staiano was sharing a rented apartment in Queens with Nicholas Gennaro, 19. They discovered even more drugs there, along with $8,000 in cash. The drugs were estimated to have a total street value of around $500,000. All three teenagers were charged with drug possession. Staiano was charged with 19 counts of criminal…

New Jersey Volunteer Santa Arrested on Drug Charges

A Pompton Lakes man who volunteers as a Santa Claus impersonator was pulled over while driving on Monday and arrested for alleged drug charges. Charles R. Smith, a retired New Jersey Transit worker, currently does volunteer work dressing as Santa Claus for the Toys for Tots Foundation. He had been driving down Route 46 around 2:00 in the morning on Monday when South Hackensack police pulled him over for a routine traffic stop. Smith stated that he was on his way to a nearby motel at the time. One of the officers spotted a crack pipe next to Smith’s Santa suit which was hanging in the vehicle, and a search of the car allegedly uncovered empty plastic bags containing crack cocaine and heroin residue. A hypodermic needle was also said to be amongst the contraband items. 66-year-old Smith was taken into custody and faces two counts of possession of drug paraphernalia. He was released shortly after his detainment and awaits a court hearing. It is unknown whether Smith has…
