AG Sessions indicates that Obama-era federal marijuana policies remain in effect

Just a short five years ago it would have been unusual for a member of Congress to ask the US Attorney General about federal marijuana policies. But circa 2017 it now seems near impossible to have a congressional hearing involving the AG in which marijuana policy is not raised. But,...<img src="http://feeds.feedburner.com/~r/MarijuanaLaw/~4/QCEFyRaiv44" height="1" width="1" alt=""/>

Can I Get Fired for Suing My Employer if I Was Injured at Work?

The post Can I Get Fired for Suing My Employer if I Was Injured at Work? appeared first on Gregory & Waldo 702-830-7925. Whether you take it on faith or not, your employer has a legal obligation to provide you with a safe, non-dangerous place in which to work. Most do their best to meet this requirement, and this is fortunate since people do suffer workplace injuries every day. One of them could even be you, and if this should prove to be the case, we want to assure you that options do exist. The most useful of these consists of workers’ compensation. Prior to its advent in Wisconsin in 1911, any worker who suffered injury on the job due to his employer’s negligence could only gain relief by instituting a lawsuit. This was not an easy matter. The worker not only had to prove negligence on his employer’s part but also to scrape together sufficient funds to cover his attorney and court fees. If he happened to lose his case, he stood to collect nothing in…

How Is “at Fault” Determined in a Car Accident?

The post How Is “at Fault” Determined in a Car Accident? appeared first on Gregory & Waldo 702-830-7925.   For some motor vehicle accidents, determination of fault is an easy matter. There are cases in which only one of the cars involved could possibly have been responsible. However, the party whose negligence or carelessness lies at the heart of the matter can often be difficult to determine. To make matters worse, law enforcement, insurance companies and even the courts might differ in their opinions. Since the at-fault driver may be responsible for paying damages, we understand how important it is for anyone involved in a vehicular accident to make the determination correctly. Here is what we recommend you do. 1. Ascertain whether any of the drivers involved happened to be violating the law. Was one of them speeding? Did he or she fail to yield, blow through a stop sign or run a light that was obviously red? A driver who clearly failed to obey the rules…

Texas National Guard Gets into Dirty Business of Surveillance

Digital Receiver Technology, Inc. manufactures a security surveillance device called DRT 1301C. The devices are known in law enforcement and military circles as “dirt boxes.” It is referred to by that name because the police and military use it to gather “dirt” on private lives of both criminal and law-abiding citizens. Dirt boxes have joined the ranks of surveillance cameras, drones, GPS tracking devices, and a slew of other information-gathering technologies that allow the government to monitor the activity of its citizenry.   Dirt boxes have become the latest surveillance fad because the device can target 10,000 locations while simultaneously processing multiple analog and digital devices, including intercepting digital voice data. The thing that brings law enforcement to ecstasy is that the targets of dirt boxes never know they are under surveillance. This ten and one-half pound device costs roughly $100,000 from its Maryland-based manufacturer.…

Cliven Bundy Loses Bid to Represent Self in Standoff Trial

In another bizarre twist of events surrounding the Bundy family, Nevada cattle rancher Cliven Bundy just lost his courtroom bid to be able to represent himself (pro se) at his upcoming criminal trial. The extreme “state’s rights” advocate is scheduled to go to trial this fall for the armed standoff in Nevada with Bureau of Land Management (BLM) agents back in 2014.  Cliven Bundy and the other defendants currently face a retrial when they were acquitted by a jury for allegedly assaulting federal officer(s) and brandishing weapons. The defendants are accused of leading a conspiracy to prevent federal agents from removing Bundy cattle from illegally grazing on what is now Gold Butte National Monument. In September, Mr. Bundy filed court documents saying he wanted his current defense attorney, Brett Whipple, removed from the case. Mr. Whipple had responded by saying he is bound by legal ethics to respect his client’s wishes. However, U.S. Magistrate…

Editorial Calls for Investigation of Prosecutor for New Jersey Men’s Wrongful Conviction

An editorial by New Jersey’s Star-Ledger calls for the prosecutor who helped convict two innocent men to be removed from the case and investigated by the state. Innocence Project client Eric Kelley and Centurion client Ralph Lee were released from prison on bail last week after 24 years of wrongful incarceration. In September, a state superior court judge vacated their murder convictions based on DNA evidence that excluded them and matched to a known offender, Eric Dixon. Despite the evidence linking Dixon to the crime, prosecutor Camelia Valdes has refused to question him and instead spent months trying to keep Kelley and Lee from being released. The editorial board calls for the state’s Office of Attorney Ethics to look into the motives of Valdes and her staff. The Star-Ledger also calls for Attorney General Christopher Porrino to take over the case and to establish a Conviction Integrity Unit to re-examine other credible claims of innocence in the state.…

How to Avoid a DUI Charge

0

Getting pulled over for driving under the influence (DUI) can be a frightening experience. Fortunately, there are several ways you can avoid a DUI charge as well as getting pulled over in the first place. If you are going out to a party or any social event where drinking will be involved, be sure to adhere to the tips listed below.   Eat Something. Always eat something while you are drinking. By eating, you can slow down your body’s alcohol intake. If you drink on an empty stomach, your body will absorb alcohol quicker, causing your blood alcohol content or BAC to increase at a faster rate than if you had food in your system. Drive Safely and Ensure Your Vehicle is in Good Condition. If you do drive after a party or social event, be sure to drive safely and ensure your vehicle is in good condition so that the police do not have a reasonable suspicion to pull your over. Your headlights should be on and your vehicle should be free of leaks, shattered windows, broken…
