It is not unusual, especially in family law cases, to have a judge conclude a hearing with the phrase “I will seize myself of this case”. What that means is that the judge has decided that it is reasonable, necessary, or simply prudent for him or her to hear all future court applications regarding the case. Often this is good news to the parties and their lawyers, but other times it is a fate that is not welcomed. Madam Justice Martinson in AA v. SNA 2009 BCSC 387 explained the rationale behind a judge seizing herself of a case: “[77] It is imperative in high conflict family cases generally, and certainly in cases involving allegations of alienation like this one, that one member of the Court take charge of the case. It starts with trying to make the place more user friendly. Remember when colleges had students review their professors, rating them as part of a scheme to make students happier? How long did it take for the tyranny to begin, the inmates to seize control of the asylum, before profs figured out that if they were hard on students, rigorous in their demands or failed to adhere to the language or concepts most beloved at any given moment, their rating would suck? Tenure? Plum assignment? Popularity? Who doesn’t want to win the Miss Congeniality Award? And seeing how well that’s worked out in the campus setting, why not bring it to the courtroom? At Manhattan Criminal Court, judges are being urged to watch their language —avoiding legal jargon, calling people by their name rather than “the defendant,” and greeting people when they enter. Federal law holds that to be successful, a person arguing an appeal on the basis of ineffective assistance of counsel must show that substandard service negatively affected the trial’s outcome. Another flaw in trials, called a “structural error,” will result in a defendant being granted a new trial even if the error did not result in a person’s case being adversely affected. The Supreme Court case of Massachusetts v. Weaver, however, recently asked what requirements would exist if both ineffective assistance of counsel and a structural error are present. This case offers the opportunity to provide some clarity on how federal prosecutors will respond to this case. The Facts of the Case The defendant in this case was 16 when he was charged with shooting and killing a 15-year-old. The defendant eventually confessed to this crime.
