The criminal defense attorneys of SLG Law often get calls from people asking us what they can and can’t do when it comes to recording people.  A mother in Virginia recently found out the hard way that recording someone without their knowledge can lead to felony charges.  According to the article, the mother was concerned about another child at school bullying her child.  She wanted to get proof of the bullying, so she sent her child to school with a recording device.  Recording devices are prohibited at the school and school officials discovered the device.  Subsequent to an investigation, the mother was charged with a felony for violating state law relating to recording someone’s communications without their knowledge.  So, what about here in Jacksonville, Florida? Increasingly, media outlets have begun to cover the growing indigent defense crisis taking place in the United States, shedding light on public defenders’ stifling caseloads and the poor people failing to receive the legal representation to which they’re entitled by the Constitution. Last week, for example, a story on Stateline, a news site connected to Pew Community Trusts, examined how public defenders’ offices around the country are trying new tactics to expose and address the ongoing issue of being overburdened, underfunded and understaffed. According to Stateline, public defenders—from Washington state to Illinois to Missouri to Louisiana and Massachusetts—are speaking out and pushing back in response to what they describe as “crushing” caseloads that prohibit them from adequately representing clients. The numbers of cases assigned to these attorneys is shocking. In New Orleans, for example, 60 public defenders are responsible…

Man Charged for Ejaculating in Co-workers Food and Workspace

A man working in an office in La Palma has been accused of tainting a female co-worker’s water bottles, honey jar and computer hardware with his ejaculate. He allegedly continued this behavior over a span of nearly two months. The victim unknowingly ingested the honey on several occasions. Stevens Millancastro began working with the woman in 2014, and starting in November 2016 he was suspected of masturbating in her office and depositing semen in various locations. The victim had noticed on two different days that her water bottles had an odd coloration to them and she threw them in the trash. Millancastro has also been accused of putting his sperm inside a jar of honey that the victim kept stored in her office. She ate the polluted honey every other day for nearly two months without realizing it had been tampered with. Continue reading →

Damaging a Statute or Other Property in New York: Understanding Criminal Mischief and Criminal Tampering Crimes

During summer 2017, a New York man, David Hedeen, was arrested and charged with Criminal Mischief when he vandalized four statues outside of a church in SoHo. The case highlights how seriously New York State and her prosecutors deal with crimes of vandalism. Simply, no statue, or any property of another person, should ever be tampered with or destroyed. Criminal Mischief charges in New York are separated into four different classifications. Reverend Mario Julian, who is the priest at the church, stated that the damage done equaled close to $10,000. If that turns out to be true, and as now reflected in the indictment, Hedeen faces charges of Second Degree Criminal Mischief. This charge, New York Penal Law 145.10, includes intent to, and actually causing damage that is greater than $1,500. If convicted, Hedeen could face up to seven years in prison on a class “D” felony. Debo llamar la atención en dos temas, primero NO es por todo un año sino hasta cuando se agoten los SETENTIDOS MILLONES PRESUPUESTADOS. Y la segunda y más importante es que se otorga INDISTINTAMENTE a la persona mayor de 18 años sin carga familiar o la familia que haya ocupado (no indica si era alquilada, propiedad o se  ejercía la posesión por cualquier otro título). Las invasiones se REALIZAN por familias enteras y traficantes, donde los padres hijos e hijas se apropian  de lo ajeno, resultando que una de esas familias resultan "dueñas" de tres o más terrenos en la zona invadida y cada hijo o hija "dueña" de un terreno, jajajaj!!!!! Before he resigned as Health and Human Services Secretary, Tom Price created a bit of an uproar over comments about medication-assisted treatment for opioid addiction. It was reported that former Secretary Price stated that providing drugs that reduce craving for opioids is just replacing one opioid for another. To a point, that is true. But it is not that simple. Secretary Price’s comments were somewhat more nuanced but the news reports that Secretary Price suggested that medication-based treatment for opioid addiction was not an effective treatment prompted 600 medical experts and academics to pen a letter to Secretary Price asking him to reconsider. Secretary Price is no longer head of Health and Human Services but the issue of medication-assisted treatment as one option to address this country’s opioid crisis. The medication treatments most commonly used to treat opioid addiction, buprenorphine, naltrexone, and methadone, are called “opioid agonists”…

LIES, DAMNED LIES, AND STATISTICS In 1989, declaring that drivers under the influence present a danger on the roads and in an effort to deter and punish driving under the influence, the California Legislature passed a bill that ordered the California DMV to establish and maintain data on driving under the influence violations. The purpose of this bill was to provide an evaluation tool for the legislature in the development of future regulation of driving under the influence. The bill became law under Section 1821 of the Vehicle Code. The information the DMV is required to provide under this law is left to the DMV but the statute makes suggestions. This report is supposed to be submitted annually by the DMV to the legislature and it must include a ranking of the efficacy of punishments for DUI and alternative intervention programs. The latest Section 1821 report submitted by the DMV is dated January 2015 and covers statistics only through 2012. In compliance with the statute,…
