You feel entirely justified. After all, you only punched the guy in the nose after he said something derogatory about your sister. Meanwhile, even a few moments in cuffs has you concerned. Now that you’re facing assault charges, you are downright worried. Could you wind up in jail? First, you should be aware that under New Jersey law, there are two different types of assault charges. According to NJSA 2C:12-1, you could be arrested for either simple assault or aggravated assault. Although the penalties are less for simple assault, a conviction could still find you behind bars. For many Kentucky companies, a critical part of operating a smooth business is guaranteeing the proper education of its employees in regards to safety. This is even truer for organizations that rely on the use of heavy equipment, machinery and chemicals among other things, to create a product or provide a service. Unfortunately, even with the most rigorous safety guidelines in place, accidents can sometimes happen and put the lives of workers at risk.  This was the case in a recent incident in Virginia when a female worker was injured in a workplace accident. The woman was operating a forklift in an industrial area at the Navy Exchange Service Command Distribution Center located near Kenyon Court. Investigators determined that the machine fell off of a loading dock after overturning while the woman was operating it. The length of the fall was approximately five feet. First responders had to rescue her from the forklift because she was restrained by her seatbelt.…

Many of us have had the experience of a near miss while walking or driving through a parking lot. Maybe we were crossing a lane or pulling out from a space, when all of a sudden a driver appears, barely avoiding a motor vehicle accident. Unfortunately, these types of collisions are increasingly common, with reckless driving behaviors such as speeding and distracted driving to blame. Parking Lots Accidents and Injuries Parking lot accidents are often considered ‘fender benders,’ so minor that drivers fail to report them to their insurers. According to the National Safety Council (NSC), these accidents actually have the potential to be quite serious, killing roughly 500 drivers and pedestrians each year, and causing serious injuries for as many as 60,000 others. Distracted driving, such as using cellphones and texting behind the wheel, are among the most common causes. The NSC claims that nearly 70 percent of drivers admit using their phones to call or check in…

Last week I wrote about studies examining the prevalence of driving with drugs in one’s system. Research has shown that an increasing number of drivers have detectable drugs in their symptoms. What we don’t yet know is how many of those drivers are impaired by drugs and whether the incidence of drug-impaired driving is increasing. We do know, of course, that drug-impaired driving is dangerous. Policy-makers in North Carolina and elsewhere have attempted to combat the problem by enacting zero-drug-tolerance laws and provisions that prohibit driving with a threshold of a drug or its metabolites in one’s body. And law enforcement officers across the country have created detection protocols that are geared specifically toward the drug-impaired driver rather than a driver impaired by alcohol. How can you get your license back? The road to reinstatement is not as easy as the Secretary of State rule book makes it sound. For one thing, you will not automatically regain your driving privileges just because you successfully completed the terms of your DUI sentence. You will still need to apply for reinstatement. Following a first or subsequent DUI conviction, your license will be revoked for at least one year. A Kansas man’s drug indictment was dismissed due to misconduct on behalf of the prosecutor, who is also facing allegations of misconduct in the wrongful conviction of Lamonte McIntyre. U.S. District Judge Julie Robinson freed Gregory Orozco on Tuesday, saying that federal prosecutor Terra Morehead violated his right to a fair trial. A potential witness for Orozco, Jose Luis Ruiz-Salazar, was threatened by Morehead that if he testified in Orozco’s defense, she would make trouble for him in his pending case. Morehead is also accused of witness intimidation and prosecutorial misconduct during her time as a Wyandotte County assistant prosecutor in the case of McIntyre, who spent 23 years in prison for a double murder he did not commit and was released just this past October. Homeless Sparked Fire in Bel Air:  Los Angeles investigators have found that the source of the fire that destroyed six homes and damaged a dozen others in the exclusive Bel Air neighborhood was a nearby homeless encampment.   Gale Holland, Laura J. Nelson and David Zahniser of the Los Angeles Times report that the encampment was in a canyon a few hundred feet from the 405 freeway, which was shut down due to the fire during rush hour last Wednesday.  There are an estimated 58,000 homeless living in the Los Angeles area, with many thousands living the West Los Angeles hills, home to some of the most affluent neighborhoods in the country.  "We knew it was only going to be a matter of time before something horrible happened," said one Bel Air resident.  The homeless population Los Angeles has increased dramatically over the past several years.
