More reporting suggesting Vermont will very soon enact a novel form of marijuana legalization via a not-so-novel means

I explained in this post last week, "Could Vermont legalize marijuana by traditional legislation in just a matter of weeks?," how notable and valuable it could be, for policy-makers, citizens and researchers, to have a state embrace a distinctive approach to marijuana legalization through the traditional legislative law-making process. As...<img src="http://feeds.feedburner.com/~r/MarijuanaLaw/~4/LESO-i4o7Hc" height="1" width="1" alt=""/>

Tech people are a pretty cocky bunch.  Most tech believers will tell you that all of human “progress” has come via technology.  Obviously, they’re not focusing on our more deadly weapons or better ways to destroy the environment, they’re bragging about the most basic technologies–like how to start a fire.  After all, if we were still trying to figure out how to start a fire, you wouldn’t be reading this right now, and we would all be eating the original paleo diet. Often, new technologies mean job losses to someone, somewhere.  When elevators were first invented, nobody trusted these machines to magically transport them to another floor.  So, a human being was employed full time to operate the elevator.  Eventually, the “Elevator Operators Union” (it still exists) lost 17,000 jobs with the advent of automatic elevators.  And, who can forget the autoworkers losing their jobs to bright yellow…

Winning criminal cases with martial arts & contemplative practice

Winning criminal cases with martial arts & contemplative practice Winning criminal cases for the defense requires ability, knowledge and experience by the criminal defense attorney. As a Fairfax, Virginia criminal lawyer, I repeatedly crystallize my ideas about the path to court victory, including the benefits of martial arts and contemplative/mindfulness/meditative practice. Winning criminal cases calls for constant practice and attention While the principles of my martial art taijiquan, and of contemplative practice may be easy to understand, they are profound and call for correct and regular practice. Taijiquan is all about harmonizing imbalanced situations so that any bows and arrows that come my way are another exercise in effectuating taijiquan balance. Mindfulness/contemplative/meditative practice softens and opens my spirit, heart and mind in order to well absorb the necessary lessons and principles of effective criminal defense and life practice. Fairfax,…

A business in Van Nuys that is suspected of selling drugs through a telephone operated delivery service led to sixteen people facing charges. The service is said to have been selling heroin and cocaine to purchasers phoning in personal orders, in addition to selling bulk amounts to a drug ring. A 40-year-old man from Sylmar identified as Sigfredo Gurrola Barrientos is the alleged manager of the operation named Manny’s Delivery Service, and he supervised six others. They worked for the Van Nuys located operation by taking telephone orders, delivering of the narcotics in company designated vehicles, and a variety of other tasks pertaining to the service. Starting at the end of August, recorded conversations monitored by law enforcement documented that those involved with the drug ring had procured numerous kilograms of heroin and hundreds of thousands of dollars. Pacoima resident Jacqueline De La Rosa, 24, allegedly obtained large amounts of the drugs which she stored in…

A Daytona Beach man was arrested earlier this month after police allege they caught him making online arrangements to have sex with children. Detectives claim the man thought he was communicating with a woman who was going to allow him to have sex with her teenage daughters, but he was actually communicating with an undercover cop. The 29-year-old was arrested after investigators say he went to an arranged location in the city with the expectation of meeting the woman and her children. Undercover officers with the city’s newly created advanced technology and cyber crimes unit said they engaged with the man online after he allegedly posted an ad that read, “impregnate your daughter or sister or wife.” The undercover officer claimed to be a mother, offering up her 13- and 14-year-old daughters for sex. Officers said the man sent several nude photos of himself and made multiple comments about sexually explicit acts he wanted to perform. A judge ordered for the…

Here’s the story – You were in a car accident where you sustained injuries, and your vehicle is totaled. You took the correct steps to make sure you had your information straight before contacting the insurance agency, such as getting the police report, finding out the proper worth of your car prior to the accident, the final amount of your medical bills, and other relevant facts. After some time, the insurance company’s settlement offer turns out to be much lower than what you were expecting. You’re furious. What should you do now? First of all, you should be aware that is NOT the only money you could receive in this type of scenario. The insurance company’s first offer is always the lowest, as it is the starting point for negotiations. You have the right to counteroffer, but you need the right proof to support it. That is why you need an experienced automobile accident attorney on your side during this difficult time. The negotiation process goes…

New York’s Highest Court Rules that Juries Should be Briefed on Problems with Cross-Racial Identification

The New York State Court of Appeals issued a decision on Thursday requiring judges to instruct jurors about the unreliability of cross-racial eyewitness identifications in cases in which the defendant and the witness are or appear to be of different races. Eyewitnesses often have trouble identifying people of a different race than their own. According to the New York Times, an analysis of 39 studies found that participants were one-and-a-half times more likely to falsely identify someone of a different race. According to a brief filed in the case by the Innocence Project, of the 353 DNA exonerations nationwide, 70 percent involved eyewitness misidentification. Nearly half of those cases involved a defendant and a witness of different races. Thursday’s decision stems from the case of Otis Boone, a black man who was convicted of a robbery based on the identification of two white men. The court ruled that, in Boone’s case, the jury should have been instructed about the…

Inflammatory statements on social media are part and parcel of political debate in 2017. However, in some circumstances, they can cross a grey area into potential criminality. In Texas, a Fort Worth businessman is accused of possible criminality over a Facebook page that took aim at a local police chief. The Texas Tribune reported how the presidents of the Tarrant County Law Enforcement Association, Arlington Police Association and Dallas Police Association are accusing Bo French of committing a “scandalous crime.” The attack follows the creation of a satirical Facebook page set up in 2016 to criticize Bill Waybourn, a former Dalworthington Gardens Police Chief. French who is a Texas House hopeful, argued the page “Thief Bill Waybourn,” was a harmless joke. The three North Texas police associations took a different view. They are calling on the Texas Rangers to investigate what they describe as a “scandalous crime.” That statement said:…

The holidays are almost upon us, and while most people are out spreading holiday cheer, there are some grinches running around causing trouble for others. Our office always tends to get a little busier around the holidays because certain crimes occur more frequently this time of year. Today, we take a closer look at five common crimes that tend to spike around Christmas. Common Holiday Crimes Here are five crimes that tend to become a little more popular during the cold winter months. 1. Drunk Driving – Minnesota police have already announced that they will have extra law enforcement on the road looking for drunk drivers this holiday season, so be sure to make some good choices. Spirits tend to flow freely when people have time off and are gathering with friends and family, and one too many can lead to a costly DUI charge. 2.
