New York Daily News Endorses Governor Cuomo’s Criminal Justice Reforms

In his state of the state address earlier this week, New York Governor Andrew Cuomo proposed a number of reforms to improve the criminal justice system in New York.  The New York Daily News published an editorial backing the governor’s proposals.  The Daily News cited the case of Innocence Project client Felipe Rodriguez to support reforms to the state’s discovery rules.   Related: Felipe Rodriguez’s First Father’s Day Home in 28 Years: ‘Being a dad is glorious’ Rodriguez, whose was released from prison after serving 26 years when his sentence was commuted by Gov. Kate Steinle Killer Gets Time Served:  The five-time deportee who fired the gun that killed 32-year-old Kate Steinle in 2015 has was sentenced to time served today.  Claudia Cowan of Fox News reports that last November a San Francisco jury decided that  Jose Ines Garcia Zarate had accidently fired the stolen gun that killed the young woman who was walking with her father on a crowded pier on July 1, 2015.  Garcia Zarate is expected to be turned over to U.S. Marshals for trial on federal charges of being an ex-felon and illegal alien in possession of a firearm.  If convicted he could receive a 10-year sentence and deportation.  His new defense attorney, the renown Tony Serra, called the federal charges a "vindictive prosecution."  

New Tax Law May Cause Divorce Rush in 2018

The recently passed federal tax reform law will do away with the popular alimony tax deduction for all divorces that are completed after Dec. 31, 2018. According to the IRS, about 600,000 people claimed the deduction in their 2015 returns. Spousal maintenance agreements that are created before the end of the year will still be able to claim the deduction in the future. Thus, some couples feel that they are facing a deadline to complete their divorces before the new law goes into effect. What Changes With the current tax laws, the person paying spousal maintenance after a divorce can deduct the payments when filing his or her taxes. In turn, the spousal maintenance recipient must report the payments as taxable income. The new tax law makes spousal maintenance payments tax neutral in the same way that child support payments are. The payer will no longer claim the deduction, and the recipient will not pay taxes on it. Why It Matters …

Much of the evidence presented comes in the form of verbal testimony from witnesses—people who saw what happened, people who can attest to your whereabouts, experts called to weigh in on certain matters, etc. The problem is this: Verbal testimony is based mostly on memory, and memory can be a fleeting thing. And the result is that, many times, when different witnesses offer conflicting testimony, it doesn’t necessarily mean one of them is intentionally lying. Contempt for Claiming Tax Exemption Against Court Order in Washington Child Custody Case

Tax exemptions can be a contentious issue in custody cases.  Washington child custody attorneys know that the allocation of tax exemptions can have a significant financial impact on the parties. A recent Washington appeals court decision addressed a case in which the mother claimed the tax exemption for her younger child in two years despite the court’s order allocating the exemption to her former husband in those years.  The order in effect at the time split the exemptions for the two children between the parents as long as the exemption existed for the older child.  When there was no longer an exemption for the older child, the exemption for the younger child would alternate. Under the order, the father had the right to the exemption in 2012, but both parties claimed it.  Consequently, the father was audited and had to pay the IRS more than $2,000.  He moved to have the mother held in contempt and asked the court to require the mother to sign a…

Last month at a U.S. District Court in Maryland, a judge stepped down from his bench to shake the hands of two defendants and tell them he was sorry. The two defendants had, at different times, pleaded guilty to drug charges years ago in that same judge’s court. The convictions had just been vacated by the judge. One of the men, Umar Burley, pleaded guilty to manslaughter and heroin possession. He had spent seven years of his 15-year sentence when he was released. The other man pleaded guilty to drug charges and had served four years when he was released. So why did the judge shake these men’s’ hands and apologize? Because they were both innocent. Last spring, Baltimore prosecutors charged at least eight officers, who were members of a special police task force, with gross misconduct, including planting drugs on innocent people. Under California law, an alcohol beverage manufacturer is prohibited from offering premiums, gifts, or free goods in connection with the sale or distribution of alcohol. This is a long-standing public policy that prohibits manufacturers of alcoholic beverages from giving something of value to their retailers or consumers. Beginning this year, the law has been relaxed to allow manufacturers of alcoholic beverages, including distillers and wineries to provide free ground transportation home to consumers who attend an invitation-only event relating to the promotion or sale of their product. It also permits breweries or beer manufacturers to offer free or discounted rides directly to consumers through taxi cabs, ride sharing, or other transportation services in the interests of public safety. On May 18, 2017, BT, a 70 year old retired social worker, drove from her home in Winchester into Harvard Square. BT spotted a parking space on the side of the street. She proceeded to pull into the space scraping the entire side of a car already parked on the street. She got out of her car as if nothing had happened and headed across the street to do some shopping. Fortunately or unfortunately – depending on your point of view – a Cambridge Police Officer witnessed the entire episode. The officer approached and asked BT to return to the scene of the accident. BT accompanied the officer and told the officer she had no idea what he was talking about. The officer told BT to look at the damage to the car. Again she repeated that she had done nothing and she had no idea what he was talking about.The officer issued BT a citation for failure to use care and leaving the scene of a property damage accident. Police Arrest More Than 60 Party Guests for Less Than One Ounce of Pot

Over 60 people attending a birthday party on New Year’s Eve in Cartersville, GA were taken into custody after officers discovered marijuana on the premises. They have all been charged for possession, though a vast number of them say they had no involvement with the substance in any way. A nearby resident returning from an evening out called 911 to report what he believed were the sounds of gunshots in the area. When police responded they came across a party taking place, and they detained the remaining attendees while inspecting the premises to try to determine the origin of the reported gunfire. When people at the party were questioned they alleged that the shots heard coming from the 21st birthday celebration were fireworks, and not a discharged weapon. Continue reading →
