Cleaner Can Contaminate Breath Tests In Ohio DUI / OVI Cases

Clean hands is an obsession for some people.  In addition to frequent hand-washing, many people also use alcohol-based hand sanitizers. Aside from the potential issues with dry skin and weakened immune system (not to mention OCD!), use of hand sanitizers can also affect the results of a breath alcohol test. The impact of hand sanitizers on breath testing was the subject of a recent article in the Journal Of Forensic Sciences. A previous study concluded the absorption of alcohol from hand sanitizers has virtually no effect on blood alcohol concentration. The current study answered a different question: what if the hand sanitizer is on the hands of the breath test operator? To answer the question, the researchers had breath test operators apply hand sanitizer, rub their hands until dry, and then administer breath tests to subjects who had consumed no alcohol. On Wednesday morning a Sioux City man allegedly locked himself inside of the front porch at a stranger’s home, and began sexually pleasuring himself while simultaneously smoking methamphetamine. The woman occupant of a house containing a front porch noticed an unfamiliar man in the enclosure on January 10 around 8:20 AM. 30-year-old Leland Purgett arrived at the home and allegedly entered the structure. He was able to locate the keys to the house, and he secured himself inside the porch area. With the female occupant of the home in view Purgett reportedly began masturbating in front of her while he was concurrently smoking methamphetamine. Continue reading →

Das Bundesgericht bestätigt die Einschätzung des Bundesverwaltungsgerichts, dass Radio- und Fernsehübertragungen in Hotelzimmern keinen vergütungsfreien Privatgebrauch, sondern gebührenpflichtige Weitersendungen im Sinne von Art. 10 Abs. 2 lit. e URG darstellen, weil Gastbetriebe grundsätzlich einen Gewinn anstreben. Sodann liege auch keine Weitersendung an eine kleine Empfängerzahl im Sinne von Art. 22 Abs. 2 URG vor. Weiter konnten die beiden beschwerdeführenden Verbände GastroSuisse und hoteleriesuisse nicht ausreichend aufzeigen, inwiefern der angefochtene Tarif gemäss dem „3a Zusatz“ der Urheberrechtsverwertungsgesellschaften unangemessen sein sollte. Entgegen der Vorinstanz hielt das Bundesgericht eine bis auf den 1. Januar 2013 rückwirkende Tarifanwendung für überlang und daher unangemessen.
