0
Sex trafficking isn’t just a problem during the lead up to the Super Bowl, and citizens and police officers around the area are doing their part to crack down on the crime. Residents in Washington County are trying to spread awareness and do their part to combat sex trafficking by forming a group called Citizens Against Sex Trafficking (CAST). CAST is an auxiliary unit of the East Metro Human Trafficking Force, which is a partnership involving Washington County and other suburban law enforcement agencies. Each group has its own agenda: EMHTF is focused on tracking and breaking up sex trafficking rings in the area. CAST is focused on a public awareness campaign. Proactive Approach Sex trafficking has grown in recent months, even though law enforcement officials are doing everything in their power to combat it. They recently busted rings in two separate Woodbury locations and in Mahtomedi. The goal of the law enforcement-led task force is to go out and find sex traffickers,…

Stopped for Driving on a Suspended License in MA?

0
0
There are many reasons why your Massachusetts driver’s license may be suspended or revoked. These include specific driving violations, such as excessive speeding tickets or driving without insurance. You could also lose your license due to criminal offenses, such as operating under the influence or violation of other state laws. Whatever the reason, driving on a suspended or revoked license is never a good idea. Choosing to do so may result in additional consequences, and even jail time. Suspended vs. Revoked Massachusetts driver’s licenses can be temporarily suspended or permanently revoked: With a suspension, you are not allowed to drive for a certain period of time, but you may have the opportunity to get your license back at a later date. With a revocation, your driver’s license is canceled, and you only have the opportunity to get it reinstated if you submit to an investigation. In either case, license suspension and revocation are both red flags to…

Racial Impact Statements for Crime Law Changes

Few politicians have been as disappointing, following a promising start, as now-departed New Jersey Governor Chris Christie.  Now we learn that on his way out the door, Gov. Christie signed a particularly bone-headed piece of legislation.  Corinne Ramey reports for the WSJ:Changes to criminal-justice laws in New Jersey now require an analysis of their impact on racial and ethnic minorities, making the state among only a handful in the nation to do so. A bill mandating the analyses, which outgoing Republican Gov. Chris Christie signed Monday, requires the state's Office of Legislative Services to prepare so-called racial-impact statements for policy changes that affect pretrial detention, sentencing and parole. To justify such legislation, the soft-on-crime crowd trotted out its favorite warhorse, the Fallacy of the Irrelevant Denominator.New Jersey has the largest disparity between white and black incarceration rates in the country,…

The court of appeals decided another significant Rodriguez case yesterday, ruling (again) in State v. Reed that the highway patrol trooper who stopped the defendant for speeding on Interstate 95 detained the defendant for longer than necessary to carry out the mission of the stop without reasonable suspicion of other criminal activity. The friendly pit bull case. When Trooper Lamm of the State Highway Patrol approached the car David Reed was driving, he saw energy drinks, trash, air fresheners, and dog food scattered on the floor of the vehicle. Reed’s fiancée, Usha Peart, was sitting in the front passenger seat and held a female pit bull in her lap. She told Trooper Lamm the dog was friendly, and he petted the dog. Meanwhile, Reed retrieved his New York driver’s license along with the registration and rental agreement for the vehicle. Please exit the vehicle. Trooper Lamm told Reed to get out of the car and to come sit in the patrol car. When Reed got out…

7th Circuit Overturns Death Sentence:   In a ruling announced on January 11, a unanimous panel of the 7th Circuit U.S. Court of Appeals overturned the death sentence of an Indiana man convicted of the 2004 murders of a young mother and her 4-year-old daughter.  The Associated Press reports that, unless overturned, the ruling will require a new sentencing hearing for Frederick Baer, who pled guilty to the murders, but claimed that he was mentally ill. On February 24, 2004, Baer saw 26-year-old Cory Gardener moving some boxes on her front porch.  Gardner was alone with her daughter, Jenna, while her husband was away looking for work.  Baer asked the woman if he could borrow a phone to call his boss.  When she went inside to get a phone, Baer followed and sexually assaulted her.  He then slit her throat.  Jenna saw the attack on her mother and ran to another room, where Baer slit the child's throat, stole her mother's purse, and…

What is a DCF Fair Hearing?

If your children may be taken from you due to false allegations of child abuse or neglect, it is important to know your rights. Unfortunately, false accusations are more common than most people think. This is especially true in dysfunctional family situations, or during parental custody disputes. In addition to being extraordinarily damaging to an individual’s reputation, accusations of child abuse and neglect can result in removal of the child from the family home, and even jail time. 51A Report When reports of child abuse and neglect are made, the Department of Children and Families’ (DCF) will investigate the situation to determine whether the reports are credible. In MA, anyone can report another person to DCF, whether or not a problem actually exists. These reports of abuse and neglect are called 51A reports, and they are often made by ex-spouses and others who seek some sort of revenge or advantage. If DCF believes that the report of abuse or neglect is an…

Can A Sports Injury Become a Personal Injury Case?

0

With the NFL Playoff Conference Championship Games only days, the Law Offices of Anthony Carbone thought it would be timely to enlighten you on how a sports injury can become a personal injury case in the eyes of the law. For today’s article, we are going to focus on high school athletes specifically. First, you should know that having your child participate in a sport is voluntary in nature, but it’s still a question of who will pay their medical bills if a child is injured during a game or practice. There are various causes of sports injuries. Just playing in a game can put yourself at risk for a significant injury. But there are times when defective equipment can play a role in the injury sustained. Take the concussion issues that have been plaguing football in a major way for several years now. Just one hard hit and your child can experience a terrible brain injury that can be life-altering. In addition, not everyone out there plays in favor of the rules. If…

In a 100 Years, Who’s Going to Remember?

I’ve been recording bands and artists since my high school days, but I sold my recording studio back in 2010.  Recently, I was going through a box of wires (junk) and I stumbled across some old ADAT tapes, and reel to reel tapes. Now, there’s something you should know about these tapes.  You cannot play them in an ordinary reel t0 reel machine, because these tapes were made especially for use with my old 8-track Fostex recorder.  Same goes for the ADAT tapes.  These tapes are, technically, VCR tapes, but they don’t work in a VCR, they only play on an Alesis ADAT multitrack machine.  I got a little sentimental when I ran across these old band recordings, but I just don’t have the equipment to play these tapes. These band memories captured on ADAT and Fostex are lost forever.  Maybe forever is slightly dramatic, given the fact that I can pay a ridiculous ransom to some “vintage collector” and maybe, just maybe,…

When You Should Not Pay a Traffic Ticket in Maryland

0
0
Let’s set up the scenario. You’re pulled over by a police officer and issued three separate tickets. The first and second tickets are payable tickets. Payable tickets in Maryland are less serious offenses and typically moving violations. If a driver receives a payable ticket, they have three options: pay the ticket and potentially receive points to your driving record; request a waiver hearing; or request a trial. Pay the Ticket If a driver elects option 1, paying the ticket, then they can go online and make payment or visit any District Court and pay the preset fine on the ticket. However, by paying the ticket, the driver is admitting fault and guilt. By pleading guilty and paying the ticket, points will be assessed to the drivers motor vehicle administration record. Waiver Hearing Option If a driver elects to “request a waiver hearing,” the driver must mail in the ticket with the waiver hearing boxes selected and wait for a court date. This…
