A Missouri man who was in the Twin Cities to work at Super Bowl Live has been accused of offering two VIP tickets to the event in exchange for sex with a pair of teens. According to the criminal complaint filed in Hennepin County District Court, Justin Beard of Branson, Mo., has been charged with two counts of agreeing to hire a prostitute under the age of 16. He made his first appearance in court on Friday. Earlier in the week, the 33-year-old Beard responded to a sex ad on Craigslist which was actually a decoy ad placed by the joint sex-trafficking task force comprised of several local law enforcement agencies. Beard exchanged several text messages with an undercover officer who was posing as a man trafficking a 13-year-old boy and a 15-year-old girl. Eventually, Beard agreed to trade a pair of tickets to the Super Bowl Live event in exchange for sex with the teens. The tickets were valued at roughly $200. Placed Under Arrest After agreeing to the exchange, Beard was given an…

Why are Children More at Risk in Semi-Truck Accidents?

Trucking accidents are a terrible situation for those involved. Not only do these accidents usually occur at high speeds, but more often than not, the semi-truck has a severe size and weight advantage on a passenger vehicle. These accidents can often be devastating, even more so to small children who are more at risk than adults in any kind of accident. Data shows that nearly half of all car accident deaths are children under the age of 15. If your child was the victim of a terrible accident with a semi-truck, they have a much higher risk for injuries that are difficult to detect. In fact, car accidents are one of the major causes of death for children and infants under the age of 12 in the United States. These accidents can result in years of physical and psychological therapy, which can be incredibly costly if the trucking companies aren’t held accountable for their dangerous practices. Learn more below about the real dangers for young people in truck accidents. If…

Child Pornography Investigation: Police seize computers, phones.

Child pornography investigations often start like this: The police show up at your home or business and execute a search warrant.  They seize your computers, phones, hard drives and other electronics. You had no idea you were under investigation. You’re in shock. You’re scared. And, your family had no idea. Now you have to explain it to your wife. What do you do? It’s a nightmare. We handle multiple child pornography cases every year. Most begin with some version the aforementioned story. But child pornography investigations do not end with the search warrant. Your electronics are sent to a federal lab for analysis. The police search for any evidence of child pornography. They can uncover hidden directories and recover deleted files. Nothing you viewed or stored on your computer or phone is safe. The analysis may take months or years to complete. It is difficult to face anyone under these circumstances. But, immediately hiring an experienced lawyer can…

The Rape Kit Backlog and What’s Being Done about It

In 1985, Anthony Wyrick sexually assaulted two teenage girls in Charlotte. The police collected semen and other biological evidence but DNA testing was not available at that time and the crime went unsolved. Almost 30 years later, the case came to the attention of the Charlotte-Mecklenburg Police Department’s sexual assault cold case unit. Officers submitted the biological evidence for DNA testing. The results pointed to Wyrick, who lived near the scene of the crime in 1985 and who had since been convicted of an unrelated second-degree rape. Wyrick was eventually arrested, charged, and convicted. His conviction was affirmed last month in State v. Wyrick, which I how I learned of the case. Reading it got me wondering about the status of what is popularly known as the rape kit backlog. What’s a rape kit? It’s a set of biological evidence collected from a sexual assault victim during an extensive, invasive, multi-hour examination. More details are available here.…

Former Attorney General and U.S. District Judge Michael Mukasey has this op-ed in the WSJ with the above title and the subhead "If the investigation arose from partisan opposition research, what specific crime is he looking into?"The regulation that governs the jurisdiction of the special counsel requires that he be "provided with a specific statement of the matter to be investigated." The letter from Deputy Attorney General Rod Rosenstein appointing Mr. Mueller says he is to "conduct the investigation confirmed by then-Director James Comey before the House Intelligence Committee on March 20, 2017," which covers "any links and/or coordination between the Russian government and individuals associated with the campaign of President Donald Trump," and any matters that may arise "directly" from that investigation. But the investigation then disclosed by Mr. Comey was not a criminal investigation; it…

South Florida Criminal Attorney | DUI Attorney Blog Broward County Restraining Order How to Get a Restraining Order in Broward County I wrote about Florida restraining orders in general in 2016.  Click on this link to read the prior post: How to get a restraining order in Florida.  This article is titled Broward County Restraining Order.  It focuses on the specific steps needed to obtain a restraining order in Broward County.  It includes the locations and some general instructions. Disclaimer I would like to initially state that I have and continue to represent both Petitioners and Respondents in restraining order proceedings.  I am a criminal defense attorney so I typically defend individuals in restraining order hearings.  Any honest attorney will tell you that the majority of injunctions filed are either gross exaggerations or outright fabrications.  There are very few things that irritate me more than bogus restraining orders.  That…

Alcohol and motorcycles don’t mix in Georgia or anywhere else. If you are riding a high-powered machine, the last thing you need is alcohol or drugs in your bloodstream that will slow your reactions. However, the number of motorcycle wrecks linked to alcohol has steadily increased in Georgia, alarming public safety agencies. The Georgia Governor’s Office of Highway Safety notes that every year from 2008 to 2015, alcohol-related motorcyclist deaths rose. In 2015, a quarter of all motorcyclists who lost their lives on the highways of Georgia recorded a blood/alcohol content of 0.08 or higher. This equated to 36 riders. The report noted the 25 percent figure remains slightly below the national average of alcohol being a factor in 27 percent of motorcyclist deaths. Alcohol is a cause of motorcycle accidents in Georgia Increasing numbers of people are riding motorcycles in Georgia and elsewhere. In 2016, there were 196,227 registered motorcyclists in the state. In 2015,…

Hong Kong Announces 3-Year Plan to Ban Ivory Sales

On January 31, Hong Kong’s Legislative Council announced a plan to outlaw all ivory sales over the next three years. Hong Kong, which was home to the world’s largest legal ivory market for the past 150 years, will slowly increase restrictions until all traders must dispose of their ivory stocks in 2021. In 1977, the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) listed African elephants in Appendix II. This meant that countries that exported ivory would have to prove that its trade did not contribute to falling elephant populations. After years of hunting began to take a significant toll on the species’ survival, CITES upgraded the African elephant to Appendix I in 1989, which banned international trade of elephant ivory.[1] Although Hong Kong signed the treaty, they allowed domestic trade of ivory that had been imported before 1990, when CITES was established. This exception was problematic, however, because traders…

The Philadelphia Eagles won Super Bowl 52 41-33 over the New England Patriots. Almost immediately following the Eagles win, news reports started showing fans celebrating in the city of Philadelphia.  Fans were jumping off awnings, climbing light poles, going into gas stations and throwing food and chips around, flooding the streets in excitement. What would happen if the Arizona Cardinals had won the Super Bowl and that type of behavior was happening on the streets of  Tempe, Mesa, Gilbert, or Phoenix?  What kind of crimes could the celebrators be charged with?   Disorderly Conduct One of the most common crimes charged when people are excited and celebrating is disorderly conduct. Disorderly conduct is typically charged as a class one misdemeanor, which carries a maximum penalty of six months in jail and a $2500 fine.   Criminal Damage/Vandalism Another common crime that could be charged in a scenario like this, would be criminal damage. Criminal…
