You’re driving along a California highway, minding your own business, when you get pulled over by a police officer on suspicion of DUI. It can happen to anyone, even drivers who have had nothing to drink—but how you respond in this situation can make things far more difficult for you or, in some cases, much easier. To give you a better chance at the latter, we’ve compiled a list of “don’ts”—eight things you should only do if you are a glutton for punishment or hell-bent on making your DUI arrest more difficult than it needs to be. 1. Don’t be rude to the police. In this situation, the ancient proverb applies: “A soft answer turns away wrath.” Continue reading

Why Is It Illegal to Pump Your Own Gas in New Jersey?

The Garden State distinguishes itself from other states for a variety of reasons. If you aren’t a resident of New Jersey or really haven’t spent much time traveling through the state, then this example of uniqueness might surprise you. Pumping your own gasoline in New Jersey is illegal. But, how and why is this happening? Before we explain, you should know that New Jersey is the only state that doesn’t allow drivers to pump their own gas. Until quite recently, that wasn’t the case. Oregon just recently abolished a 64-year-old law that kept drivers from pumping their own gas. The reason for Oregon’s ban on self-serving gas pumps was to keep drivers from getting stranded in remote areas of the state after gas stations closed for the night and their employees went home. We aren’t kidding. It was a big problem because of the state’s expansive terrain. But, let’s get back to the east coast. The banning of drivers using New Jersey gas…

What Are The Different Types of Drug Charges?

Anyone who has watched a couple episodes of a cop TV show or loves a good drug bust movie is familiar with some of the lingo used in drug charges. Paraphernalia, possession, drug trafficking; we have heard all of these terms uttered by our favorite grizzled veteran cop or begrudgingly loveable antihero. However, do you know what all of the different types of drug charges are and what exactly they mean? The Law Offices of Elliot Kanter in San Diego specializes in criminal defense for drug charges, and we can explain the most common types of drug charges. Drug Paraphernalia Charges Drug paraphernalia is a term used to describe equipment and tools used to prepare, store, and use illegal drugs. Paraphernalia can also be used to refer to equipment that is used to conceal or produce drugs. Using or owning drug paraphernalia is illegal, but it is also illegal to sell, export, or import any kind of drug paraphernalia. Examples of drug paraphernalia include bongs, pipes, rolling papers,…

Artificial Intelligence: In Law, Logic Only Goes So Far

Do you ever wonder why some gifted small children play Mozart, but you never see any child prodigy lawyers who can draft a complicated will? The reason is that the rules of how to play the piano have far fewer permutations and judgment calls than deciding what should go into a will. “Do this, not that” works well with a limited number of keys in each octave. But the permutations of a will are infinite. And by the way, child prodigies can play the notes, but usually not as soulfully as an older pianist with more experience of the range of emotions an adult experiences over a lifetime. You get to be good at something by doing a lot of it. You can play the Mozart over and over, but how do you know what other human beings may need in a will, covering events that have yet to happen? Not by drafting the same kind of will over and over, that’s for sure. Reviewing a lot of translations done by people is the way Google Translate can manage rudimentary translations in a…

Legal Cannabis and Workers Compensation

If you live in a legal state, you might think that passing a work-related drug test for legal cannabis might be a thing of the past. But, recent reports have shown that this might not be the case when it comes to workers compensation. Say you live in California, are a recreational or medicinal cannabis user, and you end up getting hurt. Whether it be a fall, a broken bone, or even just a sprain— you put in a workers compensation claim just like anyone else. But, your cannabis use can be a big problem when it comes down to it. But how does that work? And how can a state that legalizes marijuana, also deny claims for those who use it? Legal Cannabis and Workers Compensation The number of cannabis users in legal states increases every day. It’s a medicine, it’s a fun-substance, and it’s part of many peoples daily lives. In turn, it is also typically still in the system of someone who actively uses it. This can be a big problem when it comes down to taking…

Jury Bias and Motorcyclists: Getting Past the Daredevil Stigma

An accident is traumatizing, especially if you were on a motorcycle. No matter who’s fault it is— you’re lucky to be alive after colliding with another vehicle. A motorcycle is smaller, more dangerous, and more difficult to balance. Unfortunately, many people forget motorcyclists are vulnerable, or have a desensitization to it, because of the image they portray. That of daredevils racing through traffic, when in all actuality, you’re just a weekend rider who finds it relaxing. This becomes a major issue in court, because it brings about jury bias. A rider who is not guilty, will often not be seen this way because of the stigma surrounding their hobby. Jury Bias and Motorcyclists: Getting Past the Daredevil Stigma First things first, what is jury bias? If you’re not familiar, jury bias simply means that the jury has a bias towards one party, or thing, that keeps them from analyzing the situation fairly. For instance, say there is a mother who lost…

Internet Becomes Battleground for Intellectual Property Crimes

The Internet provides a wealth of opportunities for the sharing and sale of different products and ideas. Much of the materials, services, and goods you are likely to find online are copyrighted or trademarked. Using others’ ideas, selling or copying their products, and accessing their services without permission or by going through improper channels can end up leaving you in serious hot water. Internet crimes can result in civil lawsuits as well as criminal charges, which have the potential to seriously impact your freedom and financial security, now and in the future. Intellectual Property Crimes Online It is easy to share ideas and information you stumble across online, or to incorporate these things into your own online store, website, or social media pages. While you may assume what you are seeing, sharing, or selling is perfectly legitimate, the fact is that you may be infringing on someone else’s trademark or copyright. This has become an increasingly…

The New York Times, Still Lying Against Donald Trump

The New York Times is a wonderfully reliable mouthpiece for the interests of criminals, drug pushers in particular, and it does not disappoint in yesterday's editorial.  What it adds, however, are two  point-blank lies early in the piece designed to smear Donald Trump.  Here is the editorial's first sentence:  "In the decade or so before Donald Trump became president, America's approach to criminal justice was changing fast -- reckoning with decades of destructive and ineffective policies that had ballooned the prison population and destroyed countless lives."The proposition that our criminal justice policies were "ineffective" is not merely breathtakingly false but upside down.  Over roughly the last three decades, starting in the term of President George H. W. Bush, crime rates fell by half.  These policies, in particular more police, more aggressive policing, determinate sentencing systems, and increased…

I previously noted here and here the controversy over an op-ed by professors Amy Wax and Larry Alexander.  In Saturday's WSJ, Professor Wax has an article headlined "What Can't Be Debated on Campus," with the subhead "Pilloried for her politically incorrect views, University of Pennsylvania law professor Amy Wax asks if it's still possible to have substantive arguments about divisive issues."It's even worse than we thought.

As California Law Relaxes, Self-Driving Car Accident Raises Concerns

There is no denying that self-driving cars are the wave of the future, and California drivers continue to see more of these vehicles on the roads. The justification is that autonomous vehicles remove or reduce the potential for driving errors, which are the most common cause of car accidents and injuries. There are concerns, however, about limitations in these new technologies and over reliance on them on the part of drivers. Recent incidents in our area and in other parts of the state highlight the need for drivers to remain alert, even when operating a vehicle with self-driving features. Safety Concerns Over Self-Driving Technology A January 2018 Newsweek report about a self-driving car accident in Culver City highlights the concerns many have about autonomous vehicles. The accident involved a Tesla in autopilot mode, which crashed into a fire truck parked in an emergency vehicle lane. While the truck was clearly visible with lights flashing, the self-driving Tesla failed…
