Where should the prosecution and the defense sit in a courtroom? Does it matter?In a small courtroom on the third floor of the REGJB, it recently came to pass that the prosecution's table and podium was next to the jury box which holds the defendants that are in custody.  The courtroom is one of the smallest in the courthouse. If a realtor was showing it they would call it "charming", "comfy" and "a good starter". In reality, the third floor is where the judges with the least seniority are sent to adjudicate the miasma of the REGJB.One day our intrepid CJ of the criminal courts division covered the calendar. Sensing a possible security issue, she had the prosecution and the PDs switch tables and podiums. Understanding Safe Injection Sites in The United States

Philadelphia is about to become the first city in the United States to establish places for people to use heroin and opioids under medical supervision. Questions remain about how federal law will control these “safe injection” sites. Legal analysts anticipate that a unique loophole in federal law will help to protect these areas. Part of the 1970 Controlled Substance Act offers immunity to state officials who commit drug crimes while in the process of enforcing local laws. While the law was designed to protect law enforcement officers who purchase drugs during sting operations, the new application of this law will take on a new life because the law will protect states that establish “safe injection” sites. This immunity law have never been applied in such a unique manner, and there are few past cases to determine if this argument would be successful. We recently passed the first anniversary of criminal justice reform in New Jersey.  As discussed regularly on this blog, these far-reaching changes to criminal practice and procedure in the State affect the handling of all criminal cases in the Superior Court.  The primary areas that these changes impact upon are bail reform and the speed with which criminal cases progress through the system. As discussed in previous posts, the new procedures assume those charged with criminal offenses will not be incarcerated pending trial or other case disposition.  Prosecutors can, however, seek to detain a defendant while their case is pending before the court.  This is accomplished by means of a detention motion filed by the State, which is followed by a detention hearing.  After considering, among other things the arguments of counsel and the Public Safety Assessment (the “PSA” – a sort of score sheet that rates the defendant for risk of failure…

Over the last couple weeks, I have a number of friends—and probably at least at one point, even my wife—who have wanted to disown me, or “unfriend” me, or at least get me to STFU. They’d kick me out of the “progressive left” club, if I were part of it.
