One of the most influential frames for the police reform conversation has been procedural justice. Procedural justice, closely associated with the work of Tom Tyler, has replaced a number of other theories of police reform that have fallen, at least temporarily, into the dustbin of history. The procedural justice reform frame focuses on increasing police legitimacy and restoring community trust in the police to improve legal compliance. To achieve that goal, police officers are encouraged to respect human dignity and equality by treating all people with respect, by listening as people express their concerns and feelings in the course of their interactions with police, and by policing in a neutral, nondiscriminatory way. There was a time when being a member of the United States Sentencing Commission was a big deal. But that was before Booker, holding the Sentencing Guidelines advisory. Since then, most judges have come to the realization that the grid was more random numbers than reality, more Draconian aspiration than a reflection of sentences either appropriate under § 3553(a) or some empirically determined aggregation of actual sentences meted out by actual judges. That doesn’t mean the Commission doesn’t matter. There are still a few judges who refuse to recognize that the numbers on the sentencing grid, and calculations done to reach those numbers, are merely social engineering. And there are the younger judges, who never practiced law before the Mistretta went and screwed everything up, to whom the monstrously long sentences seem totally normal. A black 2000 Oldsmobile Bravada SUV driven by Leonard L Marshall, 47, of Nezperce, Idaho was travelling westbound when he lost control of his vehicle. He drove left of center, onto the eastbound shoulder and continued down a fifty foot embankment. Both the driver and passenger, Tami S Price, 45, of Nezperce, Idaho were transported to St Marys Hospital in Cottonwood by ground ambulance. It is unknown at this time if either occupant was wearing a seatbelt. The incident is still under investigation. KSW

Erroneous Murder Conviction Nets Record PayoutA Simi Valley man who spent nearly 40 years in prison for murder will receive more than $2 million from the State. Craig Coley spent more than 38 years in prison for the death of his girlfriend and her son. Coley always maintained his innocence. In 2016, the state released him following an updated investigation. In addition, DNA evidence thought to have been destroyed, showed that Coley did not commit the crime. Three current and former police officers also testified on Coley’s behalf. The California Victim Compensation Board said recently that it accepts that Coley is actually innocent. The Board voted to compensate Coley $140 per day for his nearly 14,000 days behind bars. Coley has been completely exonerated for the crime, but is now 70 years old. Coley’s attorney says he plans to file additional lawsuits, but has not yet done so. He has asked the State Legislature to expedite approval of the compensation payment…

Whether Sarah Katherine Campbell committed the crime of which she stands accused has yet to be determined. She is due the process, the fairness, that the law provides anyone accused of a crime, even if those who would have shrieked that she must be believed would have denied that to those she accused. Deputies said 18-year-old Sarah Katherine Campbell was charged with filing a false police report of a felony. According to deputies, the charges stemmed from a false report of a sexual assault. Clemson University Police responded to a report of a sexual assault at the Delta Chi Fraternity house on January 27, deputies said. The sheriff’s office said an investigation into the incident was launched and as evidence was gathered in the case, it was determined that the sexual encounter between Campbell and the male at the fraternity house was consensual. SEC’s Updated Cybersecurity Disclosure Guidelines Leave Questions Unanswered

As previewed in our previous post, the United States Securities and Exchange Commission (“SEC”) unanimously approved new cybersecurity interpretive guidance—a format used to clarify the SEC’s views on security laws and regulations—on Wednesday of last week. The guidelines make no mention of how they affect and interplay with other regulators’ data privacy requirements, so whether compliance with these guidelines absolves companies of liabilities is a crucial question left for another day.   The new SEC guidance builds on a 2011 SEC report on the same topic and calls for public companies to be more transparent regarding their cybersecurity risks—both before and after an attack.
