Texas CCA and DA election roundup

Let's update the Texas DA and Court of Criminal Appeals races we discussed in the February podcast, as well as others that deserve mention. It was a rough primary for incumbents, and a number of open seats created opportunities for outsider candidates to elbow their way past more establishment figures.Keller narrowly prevailsFirst, Sharon Keller squeaked by in the race for Court of Criminal Appeals Presiding Judge, garnering just 52 percent of the GOP primary vote. She is without question the most and maybe only vulnerable statewide Republican in Texas, assuming there's any sort of "blue wave" occurring in November, as touted in the national press. If I were a Dem strategist looking for a blue victory in a statewide race, I'd be putting real money behind her general-election opponent, Judge Maria Jackson out of Houston. As my great grandfather liked to say when I was a child, there ain't never been a horse that can't be rode, never been a…

The Penalties for First Offense Burglary in NJ

0
0
New Jersey’s burglary offenses do not have any automatic upgrades for a second or third offense. While this is good news if you are accused of a second or subsequent offense, it also means that a first offense does not get any lighter treatment. If you were charged with a first-time burglary crime, it is important to talk to an attorney about your case. Especially if this is the first offense on your criminal record, you may be able to reduce penalties and avoid jail time. For a free consultation on your first offense burglary charges, call the Atlantic City burglary defense lawyers at The Law Offices of John J. Zarych today. Burglary Offense Grading for First Offenders Burglary is a very serious crime. In many states, it is considered a felony offense. New Jersey uses a different name for these kinds of crimes, referring to them as “indictable crimes.” There are 4 levels of indictable crime in NJ, known as first degree through fourth degree crimes, with first…

Elevating a California DUI to a Felony

0
0
The vast majority of California DUI’s are misdemeanors, which means by law a person cannot serve more than a year in jail. And most people who are convicted of a California misdemeanor DUI will never serve that much time, if any at all. However, if a person is arrested, charged, and convicted of a felony DUI, they most certainly will be facing jail, possibly even prison time. So how does a California DUI get elevated to a felony? The first way that a California DUI can get elevated to a felony is if the person has suffered three prior DUI-related convictions within the past 10 years. Prior DUI-related convictions include driving under the influence (California Vehicle Code section 23152), driving under the influence with injury (California Vehicle Code section 23153), reckless driving involving alcohol (“wet-reckless”) (California Vehicle Code section 23103.5), and out-of-state convictions that qualify as a priorable conviction. An out-of-state DUI conviction…

Constitutional Criminal Law is at the Heart of the Marijuana Battle

Legalized marijuana is in the news again, this time because of an announcement by the Trump administration ordering prosecutors to crack down on all usage and possession of the drug. Whether you are for or against its use and legalization, the battle is one that has roots all the way back to the time our country was founded. It is a study in the interplay between state and federal governments when it come to making and enforcing criminal laws. A History Lesson It is best to start with a basic history lesson. When our country was founded, the Founding Fathers had a fear of big government, coming off of having been ruled by a monarchy that told them what to do from a faraway land. Thus, wanting locals to have a say in their own governance, our federal and constitutional framework was set up to limit what the federal government could tell states what to do in many areas. One such area is criminal law, where states generally were given free reign to determine what would and would…

UNANSWERED QUESTIONS REMAIN CONCERNING FISA ABUSES

0

[Photo from wikipedia]Many questions remain concerning the alleged abuses of the FISA court process by top DOJ lawyers and FBI agents during the 2016 presidential campaign and thereafter. For example, will Attorney General Jeff Sessions appoint a special prosecutor to investigate this abuse of power? In an interview yesterday with Fox journalist Shannon Bream, Sessions again indicated that the FISA abuses would be investigated and that he has also appointed an experienced DOJ attorney from outside Washington to look into it.How does the FISA Court feel about reportedly being abused in this manner? But I also wonder how much information was obtained by federal agents?  How far did this corruption extend, after they allegedly abused the FISA court to spy on the opposition candidate during an election year, while using opposition research paid for by the Clinton campaign and the DNC? In other words, has anyone investigated how many tape recordings were made and with whom, or…

Head-on accidents are often the most accuse types of collision, causing the most serious injuries. Just before the holidays, a man from Sharpsburg was reported to be in a serious condition after a head-on truck crash in Georgia. A report in the Newnan-Times Herald noted Austin Lanford, a 22-year-old, was transported to Atlanta Medical Center. The truck he was driving hit a semi-truck near Ashley Woods Drive in Newnan, according to a report from Trooper Chris Davison with the Georgia State Patrol. The accident occurred just before 1:30 a.m. on Dec. 24. Reports noted Lanford was traveling eastbound on Hwy. 16 in a GMC Sierra. He crossed a center line and hit a semi-truck head on, Georgia State Patrol stated. Witnesses reported a fiery scene. The collision caused an explosion. The tractor-trailer left the roadway.

When Your On the Job Injury is Weather Related: What Now?

0

There’s no doubt that many will remember the latest storm. At first, it seemed as though forecasters had missed the mark once again. By the end of the day, the combination of thunder, lightning, and snow seemed surreal. With certainty, this particular Nor’easter of “thundersnow” caused a number of weather-related on the job injuries. Most local Hudson County towns like Jersey City and Hoboken only had about six inches of snow. However, many heading out of city saw far more accumulation. Route 280 was a virtual parking lot for hours and saw a number of motor vehicle accidents. Meanwhile, multi-vehicle crashes occurred throughout the state. In fact, they are still are happening today. Back in 2014, the federal government estimated the number of incidents related to winter work accidents. In that year alone, there were 42,480 work injuries involved ice, sleet, or snow. Overexertion and bodily reactions are included in these statistics. It’s impossible…

Why you are Facing an Ignition Interlock Violation in Michigan

As a Michigan driver’s license restoration lawyer, I have seen a dramatic rise in the number of ignition interlock violations in recent years, along with a notable increase in the amount of people who lose their driver’s licenses as a result. Although being violated is not good news for anyone required to use an interlock, at least this doesn’t happen randomly, or without a clear reason. In fact, there is usually an objective and understandable cause underlying why most violations are brought. We may not like the reasons, but the whole license appeal and violation process is controlled by very specific rules. As it turns out, almost everyone who has his or her license taken away again because of an interlock violation could have avoided it. Perhaps the most regrettable of these situations is when I’m contacted by someone after they’ve gone in an tried to represent themselves in a violation hearing, lost, and then wonders if there’s…

Beyond the State-Owner Binary: Repositioning the State’s Property-Resource Responsibilities with Respect to All Community Members (Including Property Owners)

Laura S. Underkuffler, Property, Sovereignty, and the Public Trust, 18 Theoretical Inquiries L. 329 (2017). Lorna Fox O’Mahony Laura Underkuffler’s recent article, Property, Sovereignty, and the Public Trust, is part of a special issue of Theoretical Inquiries in Law. The collection as a whole is an important read for anyone interested in the relationships between individual property rights claims and the role and remit of the state in the “private property” sphere. The twelve articles collected in the special issue offer insightful and wide-ranging contributions to these important debates and, both individually and collectively, will hold much interest for Property section readers. Underkuffler’s contribution examines the theoretical basis for what she describes as the ubiquitous assumption in liberal democratic systems that government should forbear from interference with existing individual property entitlements. Her starting point is the…

Khan Acquitted, Yale Condemns Anyway

He said it was consensual. She said she was too drunk to consent, and it wasn’t. But unlike most accusations at college, Yale in this case, the matter was tried in real court. Mr. Khan’s lawyers worked relentlessly to discredit the account of the woman, who was not identified by name in the arrest warrant application. They asked repeatedly how much she had to drink, and how she could claim not to remember certain details, such as how she arrived back at her dorm room, but remembered others, such as the alleged assault itself. They parsed her text messages with Mr. Khan, asking if she had not been flirting with him in the days before the incident. They showed off her Halloween costume, a black cat outfit, and asked her why she had not chosen a more modest one, such as “Cinderella in a long flowing gown.” This quote, from a news article about the trial, curiously reflects the writer’s view. Was the victim discredited or was the truth revealed by…
