Am 9. März 2018 hat der Bundesrat an seiner Sitzung die totalrevidierte Liegenschaftskostenverordnung verabschiedet (Vorabdruck hier abrufbar). Die Verordnung konkretisiert die im Zuge der Energiestrategie 2050 beschlossenen neuen Abzüge für Hausbesitzer bei der direkten Bundessteuer. Die Verordnung bietet interessante Planungsmöglichkeiten und weist folgende Eckpunkte auf:(i) Abzüge bei der direkten Bundessteuer für energiesparende Investitionen.(ii) Abzüge für den Rückbau im Zuge eines Ersatzneubaus: (a) Als steuerlich abzugsfähiger Rückbau gelten dabei die Kosten der Demontage von Installationen, des Abbruchs, des Abtransports und der Entsorgung des Bauabfalls. (b) Die Geltendmachung der Rückbaukosten ist nur möglich, wenn innert angemessener Frist ein Ersatzneubau auf dem gleichen Grundstück errichtet wird.(iii) Übertragsmöglichkeit der Investitionskosten, die dem Energiesparen und dem…

Anyone who has attempted to describe a person's face after meeting him or her for the first time likely knows how difficult it is to provide an accurate description. When the describer is under stress and likely in a dark or poorly lit room, the accuracy of that description could be called into question. A man in Dekalb has been arrested and charged with burglary based on details created in a sketch of a suspect. The incident that led to the man's arrest happened in March. According to reports, a man cut the power to a woman's house before entering it. She claims he began touching himself in the room she shared with her young son while she slept. The woman says that her main concern was protecting her son so she grabbed a chair and started pushing the man out of the house. She reportedly provided details to a sketch artist, and a police officer claims she noticed similarities between the sketch and someone she had arrested previously. That person was…

I recently read an article by an anonymous author urging readers to avoid becoming attorneys, noting various troubles facing the profession and the difficulties facing those starting out. Violent Crimes Will Get Federal Jail Time, Says U.S. Attorney – True?

Although many serious violent crimes can be charged as federal offenses, such crimes are generally charged and prosecuted at the state level. However, this may be about to change according to some new initiatives being put forth the by U.S. Department of Justice.   A recent opinion piece by federal attorney D. Michael Dunavant outlines the DOJ’s intention to become more involved in violent crimes. The DOJ has indicated an inclination to prosecute violent crime under initiatives like the Project Safe Neighborhoods program designed to reduce gun and gang crime. These new initiatives mean that the DOJ is more likely to pick up cases involving violent crimes to burnish its law and order bona fides.   Will proposed initiatives become an actual cause of action?   That remains to be seen.   The bottom line, though, is that violent offenders across the U.S. need to be aware of this possibility, because federal convictions tend to lead to more severe sentences…

Domestic violence is a serious issue in the United States. In Illinois, victims have remedies and options available to them through the Illinois Domestic Violence Act. One such remedy of this is act is an order of protection, also referred to as a restraining order. The court will grant an order of protection to protect the victim. With any system, though, there are flaws. Orders of protection can be granted inaccurately, severely impacting the life of the accused. Types of Orders of Protection Illinois law provides three different types of orders of protection: Emergency orders. An emergency order is issued, much like it sounds, when there is an emergency. The court does not need to hear testimony from the accused. The accused does not even need to be given notice of the hearing/potential order. These emergency orders last for 21 days. Massive credit card fraud scheme ends in prison term

In New Haven, Connecticut, two leaders of a credit card fraud scheme were apprehended and sentenced to prison. The scheme that occurred between 2014 and September 2015 consisted of nearly $180,000 in fraudulent purchases at stores in several states. According to the U.S. Attorney for Connecticut, the head of the group, Mei Bao Lu, age 31, was sentenced to 18 months in prison and three years of probation. He was also ordered to pay $179,000 in restitution. The second leader, Yang-Shi Lin, age 31, was sentenced to one year in prison. Both men are from Flushing, New York. Prosecutors claim the men engaged in the distribution of 120 counterfeit credit cards that were made with stolen information. They supplied the credit cards to other members of their group who used the cards to make fraudulent purchases in a number of states, including New York, Connecticut, New Jersey, Florida, Pennsylvania, Maine, West Virginia and Massachusetts. Iowa State Student Charged with First Degree Harassment Story County authorities have charged an Iowa State student with first degree harassment, an aggravated misdemeanor, after the student made threatening comments online and one student said she felt unsafe.  Aggravated misdemeanors in Iowa are punishable be a fine of up to $6,250 and up to 2 years in prison. Harassment is one of a small number of specific intent crimes in Iowa.  Specific intent crimes differ from general intent crimes in that they require the State to prove that not only did a defendant commit a certain act, but that the defendant intended the act to have a certain result.  In the context of harassment in Iowa, that means a defendant must commit an act with the intent to “intimidate, annoy, or alarm another person.”  This results in an ultimately more difficult case to make for prosecuting authorities.
