Facebook Security and Social Media Employee Guidelines

Here’s the story. Three Facebook Messenger users sued Facebook, seeking class-action status on behalf of users who were affected by the revelation of the social media platform’s data being shared without permission. The lawsuit alleges that Facebook violated user’s privacy by collecting phone calls and text messages. Let us not forget to mention the Cambridge Analytica scandal that rocked news waves for the past two weeks, which accessed over 50 million Facebook user’s personal data without their permission either. Because of these incidents and many more that have occurred over the past few months, we thought it would be timely to talk about social media security and New Jersey law. Unfortunately, there are no New Jersey laws and guidelines that govern people’s personal Facebook accounts. Not yet anyway. But based on all of these failures to protect personal data, there most likely will be new laws forthcoming. When it comes to the workplace,…

DOJ INSPECTOR GENERAL TO INVESTIGATE FISA ABUSES

[Image from wikipedia]     It finally has been confirmed by various news reports today that the D.O.J. InspectorGeneral has opened an investigation into the FISA abuses by top members and agents of the D.O.J. and F.B.I.  You will, of course, recall that, according to the Nunes memo, a small group of top D.O.J. and F.B.I. officials, among other alleged abuses, used the "salacious and unverified" dirty Steele dossier to obtain FISA warrants to spy on the Trump campaign. If substantiated, this would be the first reported time in American history that one candidate (and top administration officials) have spied on the opposing party's candidate during an election year.     As a former federal prosecutor, I cannot imagine a larger, more serious white collar crime! Here's hoping that justice will be served and that such abuses never occur again. Here's also hoping that the guilty are brought to…

Washington Plaintiff Not a Business Invitee Despite Delivering Goods to Client

The duty of care a landowner owes to a person on his or her property depends on the person’s status as either an invitee, a licensee, or a trespasser.  The highest standard of care is owed to an invitee.  A business invitee is a person invited to come onto or remain on the property for purposes directly or indirectly related to his or her business dealings with the person in possession of the land.  A licensee is a person who is allowed to enter or remain on the property because of the possessor’s consent.  A licensee can be someone who is on the property for their own purposes or a social guest.  Since the duty owed to a person is based on their status, a Washington premises liability case may turn on their status, as seen in a recent case. The plaintiff worked as an aesthetician at a plastic surgery office.  One of the defendants had been the plaintiff’s client for several years.  The plaintiff arranged to visit the…

Few things can be as jarring as an auto accident. It feels as if time stands still and the earth stops spinning on its axis in those few seconds when you and your vehicle are sent spiraling out of control. While an auto accident can be traumatic, it is important to try to keep a cool head after the incident. If the car accident was the result of someone else’s negligence or inattention, you may be eligible for compensation for all damages. That is why it is essential to do everything possible to preserve your rights to compensation after an auto accident. A 70-year-old Miami man was convicted of illegally steering state-court defendants to a corrupt clinic, which in turned fraudulently billed Medicare for more than $63 million. He was sentenced to five years in prison, plus three years of supervised release. And he must pay back a staggering $9.9 million in restitution. He was found guilty of getting illegal payments from a corrupt clinic called in Miami, which fraudulently billed the Medicare system for more than $63 million. The man got a flat monthly rate based on the number of patients he referred to the clinic. In all, the clinic apparently paid him$432,829 over six years, aside from his regular salary as a mental health care worker. The clients referred to the clinic cost taxpayers between $9.5 million and $25 million in bogus claims between 2006 and 2012. The man was arrested in June 2017. He pleaded guilty to one count of conspiracy to defraud the United States and receive healthcare kickbacks. The federal government has…

A teacher at an Arizona elementary school has been arrested for alleged sexual misconduct with a student. The 27-year-old was taken into custody Thursday morning. Police said they were notified by the school’s principal Wednesday night. They say the allegations were brought to the principal by the parent of the 13-year-old boy, who reported finding text messages between the teacher and the boy. The teacher is accused of having sex with the boy in both the classroom and in her car since Feb. 1. Police also claim the pair traded sexually explicit texts, and that she also sent naked pictures of herself to him. A teacher can be prosecuted for a sexual offense even if sexual acts with a student are consensual. Like any sex crime, a teacher who is convicted of having sex with a student faces a lifetime of social stigma as a registered sex offender on top of jail time and other consequences. Even if a teacher is not found guilty of having sex with a student, their career could…

Making Claims for Occupational Diseases: What You Need to Know

Although the term occupational disease somewhat speaks for itself, you might not really understand it. In addition to traumatic accident claims, New Jersey Workers’ Compensation laws allow benefits for different types of on-the-job exposure. If you suspect your illness is related to something at work, you may be able to make an occupational disease exposure claim. Perhaps the most well-known compensable occupational disease claims concern workers exposed to asbestos. According to the New Jersey Department of Health, asbestos is mined and milled from rock. It is also contained in at least 3,000 different commercial products. Unfortunately, a number of people who work with asbestos become sick with Mesothelioma or cancer. Sadly, many may die as a result of the exposure. The New Jersey Workers’ Compensation Act offers some guidance as to what is considered a compensable occupational disease. A breakdown of the definition contained in NJSA 34:15-31 includes: Disease…

Innocence Project Lawyers Support Texas Prosecutor

$

On Tuesday, the Innocence Project filed a brief on behalf of Texas prosecutor, Eric Hillman, who claims he was fired for defying an illegal order to hide exculpatory evidence from a defendant. In response to losing his job, Hillman filed a lawsuit, which an appeals court ultimately dismissed. The Innocence Project’s brief supports reinstating Hillman’s lawsuit on the grounds that his termination was unjust. In 2013, David Sims was charged with intoxication assault and leaving the scene of an accident. According to court records, Hillman located a witness who was not listed in the police report. The witness told Hillman that Sims was not drunk at the time of the accident. Hillman reported this information to his supervisor, who ordered him not to disclose it to the defense because it developed from Hillman’s independent investigation. Hillman consulted with legal ethics experts who disagreed with his supervisor’s opinion. Hillman then shared the…
