Casino Trespass And The Voluntary Exclusion Program

In 2010 Maryland’s first casino opened in Cecil County, a location picked due to its proximity to gambling establishments in nearby Delaware and New Jersey. Lawmakers and citizens were growing tired of losing out on millions of dollars in tax revenue and thousands of jobs to neighboring states, and the response was legalizing casino gambling. Since the Hollywood Casino of Perryville opened roughly 8 years ago five more casinos have opened their doors, with the newest being the billion-dollar MGM National Harbor Casino in Prince George’s County that opened at the end of 2016. The casinos are spread pretty evenly across the state from the Rocky Gap Casino in Allegany County to the Ocean Downs on the Eastern Shore. The Horseshoe in Baltimore and Maryland Live in Anne Arundel County are the closest together distance wise, but draw from a large customer base and have no trouble keeping the profits flowing. Average monthly revenue from the casinos is approaching $150…

Pilots And DUI / OVI In Ohio: Avoiding A Crash Landing

After years of working as a first officer for a commercial airline, Andrea is finally about to become a captain. To celebrate, she goes to dinner with friends and has a couple drinks. On the way home, she forgets to signal a right turn, and an officer stops her. The officer smells alcohol and has Andrea perform field sobriety tests. The officer says he notices ‘clues’ on the tests and arrests Andrea for DUI (called OVI in Ohio). As the cuffs go on, all she can think about is what will happen to her pilot’s license and her career. Legal Turbulence For The Pilot And Her Attorney It seems logical that a pilot’s license would only be jeopardized if the pilot is convicted of OVI. What makes sense logically is not always what occurs with the federal government. And it is the federal government, specifically the Federal Aviation Administration (FAA), which has responsibility for pilot (“airman”) licenses. The FAA will, in fact, impose sanctions for…

The assistant director of nursing of a Michigan home health agency, Juan Yrorita, age 63, was sentenced to 36 months in prison on March 29, 2018 by U.S. District Judge Drain for his role in a case involving approximately $1.6 million in Medicare claims for home health services that were procured through the payment of kickbacks, and that were also allegedly medically unnecessary and not provided.Mr. Yrorita plead guilty after four days of trial to one count of conspiracy to commit health care fraud and wire fraud. As part of his guilty plea, Mr. Yrorita admitted that his co-conspirators at Anointed Care Services (Anointed), a Detroit-area home health agency, paid kickbacks to recruit Medicare beneficiaries.  Mr. Yrorita further admitted that as Anointed’s assistant director of nursing, he falsified medical records to support Anointed’s fraudulent claims to Medicare for services that were medically unnecessary and never provided. Miami is starting to reap the benefits of Mayor Gimenez's rapid capitulation to Miami not being a sanctuary city. The City and the feds announced over the weekend a thirty-two million dollar grant to fund ground breaking on a new criminal courthouse.  Parking-lot 26,  which adjoins the side of the old courthouse, will be the site of the new courthouse (tentatively to be named the Jefferson Beauregard Sessions Miami Justice Center). When the new courthouse opens, the REGB will be imploded and a modern ten story parking garage will be built which will have room for police, lawyers and witnesses. There are plans, starting in 2020, to open a small mall in the public parking lot across from the courthouse which will include office space, an LA Fitness, retail and fine dinning. Things are looking up. However things are also looking down. Fresh on the success of the State Speedy trial rule allowing prosecutors to demand a speedy trial, the legislature is…

A mother in Maryland is facing charges after allegations that she used a saw to try to decapitate her 11-year-old autistic son when she became overwhelmed with concern about the child’s future. 46-year-old Kristina Petrie and her husband of 15 years share a home in Aspen Hill with their two autistic sons. Kristina is a stay-at-home parent while her husband Andrew reportedly has a full-time professional career. One of the Petrie’s neighbors stated that Kristina appeared to spend many of her days taking her children on outings and working outdoors maintaining her yard. On the afternoon of March 12, Petrie’s 11-year-old returned from school to find his mother allegedly having mood swings that took her from crying to laughing within minutes. The child saw his younger brother in tears on the sofa and he proceeded upstairs to his room to play video games before beginning his homework. Continue reading →

The Nasty And Necessary Bond

Bobby Berreta’s office was on 161st Street in the Bronx, between the Supreme Court and Criminal Court just below the Grand Concourse. It was a crappy little storefront, with a pull-down gate and a sign that guaranteed that the guy inside had no aesthetic at all. It read, “Berreta Bail Bonds.” Bobby was short and fat, but he usually had a smile on his face. When he didn’t, he made Sam Gompers look handsome. He sat in his crappy little office with a picture of a yacht behind him. There was a lot of money to be made on 161st Street. Cash money. Phil worked for Bobby. He was part errand boy, part skip-tracer. Phil was the guy who would meet up in court with the paperwork, take the fee and security and file the bond with the court. He met me for a graveyard arraignment. When I called, he came. If I told him that it was a good bond, that the guy wouldn’t run, there was never any problem. My clients didn’t run, and they never lost a dime on me.…

Judge O’Neill’s Conflict

$

As the retrial of Bill Cosby heats up, a challenge has been raised to the judge handling the case. It’s not so much that the judge has done anything wrong, although one could well argue that his latest decision to allow the testimony of five additional women at the trial of the alleged rape of Barbara Constand, is very wrong. But even if the ruling, that this evidence is sufficiently valuable to show Cosby’s unique pattern of sexual assault rather than his propensity, is questionable, the challenge is to what might be going on in the judge’s head. It’s referred to as “the appearance of impropriety,” because it sounds less offensive an accusation than the reality of impropriety. Judge Steven T. O’Neill of the Montgomery County Court of Common Pleas grew emotional and paused twice to compose himself as he read a statement defending his wife, Deborah V. O’Neill, a therapist at a University of Pennsylvania center where she counsels…
