Personal injury has a great range when it comes to what qualifies. Personal injury can be anything from falling on a dangerous playground, falling on a wet floor, and even defamation of character. Yep, you heard that right. Personal injury isn’t always a physical injury; rather, it’s an injury of any kind to character or the physical body. So, if you’re dealing with a scenario where what’s being said about you is false, and also causing harm— you might be eligible for a defamation of character lawsuit. But what does this type of lawsuit cover? And how do I prove that the statements made are causing harm? Defamation of Character as Personal Injury: Proving that Slander is Harmful How does defamation work? Essentially, for a statement(s) to be defamation, it must be 1) false, and 2) resulting in harm of some kind. Typically, the type of ‘harm’ associated with slander, is that of harm to the reputation. But, how do you put a number on what…

There was a day and age where truck drivers were revered. But, it seems that in the past ten to fifteen years, that sentiment has faded and given way to a different view. It seems that, for most, the image that comes to mind is an uneducated, cat-calling, killer-type. It’s harsh, but, for many— the image that your mind crafts is overall unflattering. But where did the stereotype go south? When did the hardworking and driven men and women of the trucking industry lose all their street cred? Truck Drivers: When Did the Stereotype Go South? It begins in and around the ‘90s, when movies such as “Joy ride” and “Maximum Overdrive” came out; diving fear into the hearts of mass America. The characters were fictional, and the director— surely didn’t have a vendetta against hardworking truck drivers. However, in Reefer Madness fashion, the sentiment began to shift until the majority opinion was changed. Cat-Calling Truckers If you…

Yesterday, the American Civil Liberties Union (ACLU) of Texas, the national ACLU and Arnold & Porter filed a federal class-action lawsuit against Galveston County, Texas, for violating the constitutional rights of individuals arrested for misdemeanors and felonies. The lawsuit is part of the ACLU’s Campaign for Smart Justice, which aims to reduce the U.S. jail and prison population by 50 percent and to combat racial disparities within the criminal justice system. The lawsuit was not only brought against Galveston County, but also the county’s judges who hear felonies and misdemeanors, the county magistrates and the district attorney. The lawsuit alleges that Galveston County’s money bail system violates the Constitution by keeping people in jail if they cannot afford bail. The people who can afford bail, however, are allowed to go home to their families, jobs and communities. “A person’s wealth should never decide their freedom, but…

While Oklahoma City isn’t among the most dangerous cities for driving, anyone who’s spent time here knows getting to your destination isn’t always a piece of cake. On-ramps and off-ramps don’t always flow well, and popular areas cause traffic to jam. Three of the country’s major highways–running both east-to-west and north-to-south, converge in OKC, bringing commuters into the same path as travelers from across the country and thousands of semi-trucks hauling freight. More than 140,000 Oklahomans commute for work in and out of Oklahoma County each day. Using the information from 14 years of fatal vehicle crashes gathered from the Oklahoma Department of Transportation’s Fatality Analysis Reporting System (FARS), we’ve discovered these six stretches of road are the most dangerous highways in and around Oklahoma City. These are areas where you’ll want to make sure your mirrors are adjusted, the radio is not a distraction, and…

Houston Chef Indecency With a Child Claims Questioned

A prominent Houston chef with no legal history of sex crimes has been charged in Harris County with two counts of indecency with a child. Bruce Molzan, owner of Ruggles Black restaurant, was arrested and posted a pair of $10,000 bonds. Appearing in court Monday, Molzan was told he cannot go within 200 feet of a school or anywhere children congregate. Like many Americans, has Molzan been falsely accused of a sex crime? His attorney thinks so. He attributes the indecency with a child claims to ongoing child custody and visitation issues in a family court proceeding following Molzan’s divorce from his wife and former business partner. In a statement released to KTRK ABC13, Molzan’s attorney said there is “no better way of gaining leverage in a child custody matter than by filing false complaints.” He’s confident about proving to the grand jury that the charges are false, and he believes the charges will be dismissed. Have you been falsely accused of a…

“Will I Have to Move Away if Convicted as a Sex Offender?”

$

If you’ve recently been convicted as a sex offender, you may be wondering if you’ll have to move away from your home. First, you should know that your status as a sex offender depends on the state in which you live. In Texas, a sex offender status doesn’t necessarily mean you have to move away from your current home. It depends on the circumstances. Under Texas laws, persons who are convicted sex offenders aren’t allowed to live, work or even visit certain public places. If a convicted sex offender violates such rules or other terms of their supervision, they can face even more penalties. Depending on the severity of the crime, penalties and restrictions can be more strict. Some of these restrictions may involve where a convicted sex offender can live in Texas. For example, a judge might order that a convicted sex offender cannot be present in or near what’s known as a “child safety zone.” Those are places where children, often in…
