New Law Overhauls California Sex Offender Registry

Gov. Jerry Brown signed legislation modernizing California’s sex offender registry, allowing potentially thousands of current sex offenders to be removed from the publicly accessible list beginning in 2021. The measure was introduced by Los Angeles District Attorney who noted that the registry, with over 105,000 names, has become so large and all-encompassing that it undermines the registry’s intended purpose – to assist in investigating and prosecuting new sex crimes. The current registry requires law enforcement to spend “hours on paperwork for annual evaluations of every offender,” according to the Los Angeles Times. Considering that one out of every 400 Californians is on the sex offender registry at this point, that amounts to a lot of wasted resources. As one of the only four states in the country that require lifetime registration for a sex crime, the database includes offenders who have not offended in decades and pose no risk to the public…

Burglary in Florida is defined as entering a dwelling, structure, or a conveyance with the intent to commit an offense therein, unless the premises are at the time open to the public or the defendant is licensed or invited to enter. F.S. § 810.02(2) indicates that burglary is a felony of the first degree if the offender assaults or batters another person or becomes armed within the dwelling, structure, or conveyance, with explosives or a dangerous weapon.  It can also be a first-degree felony to use a motor vehicle as an instrument to assist in committing the offense and damaging the dwelling or structure or to cause damage in excess of $1,000.00. Emotional Domestic Abuse Can Lead to PTSD

When we think about domestic violence, we tend to think of the victims who suffer physical abuse. As we should. But, we often push the victims who suffer from emotional and psychological abuse to the backburners in our mind. Enduring any kind of emotional or psychological abuse, regardless of how long it might have gone on, can result in some form of trauma. One form of trauma that victims of domestic abuse can suffer from is post-traumatic stress disorder or PTSD. This type of trauma can make victims relive their horrible experience of abuse through flashbacks, nightmares, and night terrors; which in turn can interfere with the victim’s ability to function normally on an everyday basis. This can be accompanied by sudden mood swings and changes in personality. Here’s a startling fact. 88 percent of women who are survivors of all domestic violence incidents living in domestic violence shelters all have some type of PTSD. National Poetry Month: A Poem by Exoneree Victor Rosario

In honor of National Poetry Month, today we are featuring a poem titled Inside the Cage, which CPCS Innocence Program (CPCS) and New England Innocence Project (NEIP) exoneree Victor Rosario wrote in 2013 while he was incarcerated for a crime he did not commit. In 1983, Rosario was convicted of eight counts of murder and one count of arson and was sentenced to life in prison. In 2006, attorney Andrea Petersen began reinvestigating Rosario’s case and eventually involved NEIP and CPCS. In 2012, Lisa Kavanaugh of CPCS and Petersen filed a third motion for a new trial. In July 2014, Middlesex County Superior Court Judge Kathe Tuttman vacated Rosario’s convictions, granted him a new trial and ordered him free on bond. When the prosecution appealed, the Innocence Project, NEIP, and the Boston College Law School Innocence Program filed an amicus brief insisting that Judge Tuttman’s ruling be upheld.
