Here in California, even a single DUI conviction can complicate your life greatly. A first-time conviction can cost you jail time, license restrictions, fines and mandatory classes—not to mention embarrassment in your home and professional life. However, these difficulties pale in comparison to what you could face for multiple DUIs. By the time you reach three or more convictions, California law places you in an entirely different category, in part thanks to the “three-strike” criminal penalty structure. If you are facing your third (or more) DUI conviction, you’ll need to be prepared for some major changes in your life. The penalties for three or more DUI convictions within 10 years are spelled out in California Vehicle Code 23546 and 23548. D.C Code §23-110, the main statutory language for ineffective assistance of counsel provides for the judicial officer an authority for reversal of sentence due to “denial or infringement” of the defendant’s constitutional rights. Specifically, if the court finds that: (1) The judgment was rendered without jurisdiction, (2) The sentence imposed was not authorized by law or is otherwise open to collateral attack, (3) There has been such a denial or infringement of the constitutional rights of the prisoner as to render the judgment vulnerable to collateral attack, The court may vacate under these circumstances the conviction and set aside the judgment or order a new trial. CA Reneges on Guard at Border:  After agreeing last week to dispatch National Guard troops at the California/Mexico border, the State has withdrawn the offer announcing that it will not allow its troops to fix and repair vehicles, operate remotely-controlled surveillance cameras to report suspicious activity to the Border Patrol, operate radios and provide "mission support," which can include clerical work, buying gas and handling payroll.   Elliott Spagat of the Associated Press reports that according to state officials these activities are too closely tied to immigration enforcement to be performed by the troops.  Negotiations between state and federal officials soured Friday and over the weekend after state authorities told federal officials that they would not participate in vehicle maintenance and the other jobs outlined for an initial phase across the border in California, Arizona, New Mexico, and Texas, the U.S. officials said.
