There is some reason to doubt whether Deputy Attorney General Rod Rosenstein was within his authority when he gave Special Counsel Robert Mueller a scope of investigation and prosecution that exceeds the scope of Attorney General Sessions's recusal.  Only the Attorney General and Acting Attorney General can appoint a special counsel (28 CFR § 600.1), and Mr. Rosenstein is Acting Attorney General only as to those matters on which Mr. Sessions is recused.  Business dealings of Paul Manafort that have nothing to do with the 2016 political campaign are not within that scope.  So Mr. Manafort may well have a legitimate claim that the Special Counsel has no authority to prosecute him for unrelated matters.Even so, filing a separate civil suit to restrain prosecution was doomed to failure, and today Judge Amy Jackson dismissed it.But a civil case is not the appropriate vehicle for taking issue with what a prosecutor has done in the past or where he might be…

Long-time readers and drug-reform afficianodos will recall that, in 2007, the Texas Legislature approved a pilot needle exchange program in San Antonio. But then-District Attorney Susan Reed vowed to prosecute government employees (or anyone else) associated with the program, then-Attorney General Greg Abbott agreed she could do so, even though the Legislature had authorized it, and so the program never got off the ground.However, in the wake of losing his primary election, Bexar County DA Nico Lahood is reversing his predecessor's position and giving the go-ahead to a needle-exchange pilot in River City, the SA Express-News reported.This is excellent news!In 2015, the Texas House passed a bipartisan bill that would have allowed private charities to legally operate needle exchange programs without being prosecuted, but the Senate never considered the legislation. Before giving you a breathalyzer test, the officer must wait 20 minutes and must check the inside of your mouth for foreign substances before and after that period. Certain substances, such as blood, can lead to an artificially high result. In People v Ernsting, the court held that the defendant’s breath test was unreliable because of blood in her mouth. The officer had neglected to check her mouth as required. We lost a legal legend on Friday. Famed Miami Criminal Defense Attorney Alan Ross died on Friday after a courageous battle against pancreatic cancer.However good you thought Alan Ross was...he was better. No one out worked him. No one out thought him. And certainly no one had the presence Alan did when he walked into court. Alan was the type of lawyer that brought comfort to his clients just by being on their side. He was so good; so respected; and so feared as an opponent that clients intuitively felt that he was their champion. And he was. But Alan Ross was so much more than just the very best at his profession. He was a friend to many; a mentor to those lucky enough to work with him; a devoted family man. A man at a park in Menifee was arrested for allegedly molesting a little girl after parents chased him and forced him to stay at the location until the authorities arrived. On Tuesday afternoon several people were enjoying La Ladera Park, many of which were parents with their children and others were there for a Pony League baseball practice. Around 6:30 p.m. while a 9-year-old girl and her friend were playing together, a man allegedly approached the young girl and tried to encourage her to perform sexually inappropriate actions such as asking her to do the splits on top of him. Try as he might, Mayor Rahm Emmanuel’s post-Obama White House clout wasn’t enough to keep the video of the killing under wraps, although it was sufficient for Rahm to escape unscathed in the aftermath of recreated history of everything pre-Trump being wonderful. As Florida – and the rest of the country – have been grappling with a crisis of opioid addiction, law enforcement and prosecutors have been pursuing criminal action against those who make these drugs available. Drug-dealing has never been legal, but increasingly, prosecutors are going after doctors, pharmacists and others with murder charges against those who distribute drugs that lead to fatal overdoses. Recently though, a circuit court judge in Central Florida has tossed several first-degree murder charges against dealers accused of doling out a fatal dose of fentanyl, based on the fact that the cases were reportedly initiated under a faulty legal premise.
