On the afternoon of March 7, a mother reportedly left her 2-year-old son locked inside of her SUV in the heat for over half an hour while she was shopping. On Monday around 2:45 p.m. Mt. Juliet police received a call from someone stating that they were concerned upon discovering a young child by himself in a vehicle in the parking lot at a Walgreens store. Officers dispatched to the location and observed the toddler alone inside of the parked car. The boy was allegedly crying and soaked with perspiration from the heat and the police determined that he needed to be removed from the vehicle. One of the officers broke the window in order to retrieve the boy and paramedics arrived to make sure that he did not need medical assistance. They found him to be in good condition. Anyone who reads a newspaper, surfs the internet of listens to radio, knows about the overflow of legitimacy, ethics and personnel problems inside the Massachusetts State Police. Now, before loyalists and aficionados of the state police get all worked up that I’m “attacking” or “dumping on” the state police, I’m not. I have known and now know several honest, ethical, productive state troopers, as well as administrative personnel who work for the state police. But something is wrong at this agency, and there’s no denying it. Just a few of the revelations staining the department in the past few months: Continue reading

Innocence Project Senior Staff Attorney, Karen Thompson, authored the following post in honor of her client Philip Barnett’s mom, Tammy Barnett. In my five years as an attorney at the Innocence Project, I’ve met many parents who keep their children afloat through the long nightmare of a wrongful conviction. Tammy Barnett is my client Philip Barnett’s mom. While wrongful conviction is hardly a unique or unheard of phenomenon, Tammy is one of the first mothers I have worked alongside who has not one, but two children living through and surviving a wrongful incarceration. I represent her eldest son Philip who, along with his brother Nathan and two other men, was wrongly convicted of murder. After conducting DNA testing on crime scene evidence, we uncovered a DNA profile that “hit” in the CODIS federal DNA database to a man with a long history of violence against women and children. That profile excluded both Barnett brothers as well as their…

A young Hopatcong man caused a commotion recently after striking a curb with his car while driving drunk. On October 9, Hopatcong police received a report that a black Jeep had struck a light post as it exited the town, and arrived at the scene shortly thereafter. They determined that the light post was intact, but a vehicle had struck the curb near it. At the local Quick Chek, they found a black Jeep with body damage indicative of the struck curb, and waited outside for the driver to emerge from the store. His arrival likely did not go the way they expected. First, Joseph Hannivig, 24, blew off the damage by saying the car was a rental. He then told police that he’d been drinking at home earlier, and then had more to drink at a local restaurant. He was unable to complete NJ officer’s field sobriety tests, and was taken into custody. At the police station, Hannivig became combative as officers attempted to test his blood alcohol level, demanding that they…

Employer’s Tort and Work Injury: What’s My Best Option?

Worker’s compensation claims should be cut and dry. A worker receives injury, sees a doctor, rehabilitates, and comes back to work. However, all worker’s compensation claims might not go that way. Actually, there is the potential for other factors, such as employer’s tort, which can make the case more complex. An employer’s tort can be any number of things, and tort does not have to occur just as a result of your employer. Instead, it can be a number of instances, people, or occurrences which lead to emotional or physical trauma. But what exactly is ‘tort’? And how could it affect my case? Employer’s Tort After Work Injury: What Are They and When Do They Occur? First off, what is employer’s tort? The term ‘tort’ refers to a civil wrong that causes someone to become hurt or injured. In these cases, the person who commits the wrongdoing acts as the ‘tortfeasor’. When it comes to worker’s comp, this…

It Looks Like the Cannabis Industry Means Big Money

When the cannabis industry expands in New Jersey, one thing is certain. There’s no doubt that it will explode and mean big money. The State will take in its share of revenue and hopefully eliminate some budget concerns. Meanwhile, cultivators and dispensary owners are also expected to profit if recreational marijuana becomes a reality. The numbers speak for themselves. A company named BDS Analytics provides some critical data concerning the legal sale of cannabis. By the end of 2017, the cannabis industry was already a $9 billion business nationwide. Tax revenue for that year alone amounted to $1.4 billion. With certainty, those numbers are already up with California’s approval of recreational weed. When it comes to determining opportunities, prospective cannabis business owners have a few things to consider. Not only are compliance issues critical – it’s a matter of what consumers will invest in. For example, will New Jersey law allow concentrates or…

Drunk NJ Driver Causes 9-Car Wreck in Pennsylvania

A man driving with a suspended New Jersey driver’s license is facing serious charges across the border in Pennsylvania after causing a 9-vehicle-accident that left another driver injured. Responding to calls of shots fired, Easton, Pennsylvania, police arrived on the scene to find the massive wreck, with driver Raymond Shields, 28, too drunk to speak or perform field sobriety tests. Another driver, who had been in a gray Honda Civic, suffered what police called a “serious bodily injury” and was transported to the hospital. Shields made this very bad situation worse by providing police with a false name. Eventually, officers located his driver’s license and learned that it was suspended, and that Shields has an outstanding arrest warrant in Essex County, on drug-related charges. Shields is currently residing in Northampton County Prison after failing to post bail for a host of charges, including DUI, vehicular aggravated assault, giving a false ID to…

Rapper Fetty Wap Faces 15 Counts After Drunk Drag Race Incident

New Jersey’s own Fetty Wap is in hot water after he was caught drag racing with another vehicle on the Gowanus Expressway in Brooklyn. According to police, Wap, whose real name is Willie Maxwell, was driving a black 2012 Mercedes westbound at approximately 100 miles per hour around 1:00 a.m. on Friday, November 3. He was racing Zane Richards, 29, of Woodland Park, New Jersey, who was driving a 2008 Chevy Impala, also at speeds around 100 miles per hour. Aside from the excessive speed, the pair were also making sudden lane changes, tailgating other drivers, and at one point, raced through an active construction zone. To make matters worse, once Wap was pulled over, he gave police his New Jersey driver’s license, which is currently suspended. Perhaps unsurprisingly, Wap also showed signs of intoxication, and blew a .09 on a field sobriety test. A second test at the police precinct confirmed the initial result. Both men are facing 15 counts related to the…
